." ... ## ANIMAL CONTROL REGULATIONS 1 ## PUBLISHED BY AUTHORITY The following Regulations have been made by the Town Council of Happy Valley-Goose Bay, under the provisions of the Municipalities Act, 1999, SNL1999, c. M-24, and were approved b me on the 23r8 'day of October, 2012 <!-- image --> along. Mayor ## ANIMAL CONTROL REGULATIONS - In these Regulations, unless the context otherwise requires: - "Animal" or "Animals" means any owned Horse, mule, ass, Bull, Sheep, Pig, goat or Fowl, or any other animal species whatsoever, whether a quadruped or not, Which has been, or is, owned by an Owner, but does not include a dog of a cat; - (b) "Animal Control Officer" means any person empowered by the Council to enforce these Regulations. "Act" means the Municipalities Act, 1999, SNL1999, c. M-24; - "Bull" includes any cow, bullock, heifer, calf, steer or ox; - "Council" means the Town Council of Happy Valley-Goose Bay; - (e) "Fowl" includes any cock, hen, chicken, capon, turkey, goose, gander, duck, drake or guinea fowl; - (t) "Horse" includes any mare, gelding, pony, foal, colt, filly or stallion; - (g) "Impounded" means to seize and hold; - (h) "Mischievous", as applied to Animals, means any cross or dangerous Animal which is roaming at large, or which has been shown to have trespassed upon land enclosed by a lawful fence by breaking or jumping over the fence; - (i) "Odor" means any smell which has an unpleasant effect on the senses; - (i) "Owner" means the owner of an Animal, and includes a natural person, corporation, partnership or any other association; - (k) "Depart off or the Reams amy member of the Town Municipal Enforcement <!-- image --> - (1) "Pig" includes any boar or sow; 2. (In) "Property" means properties located within the Town in a built up area; - (11) "Regulations" means these Animal Control Regulations; - (0) "Sheep" includes any ewe, lamb or ram; 5. (p) "Town" means the Town of Happy Valley-Goose Bay as defined under the Act and/or any regulations or Orders made pursuant thereto; - (9) "Veterinarian" means a legally qualified Veterinarian as provided in the Veterinary Medical Act 2004, SNL, 2004, c. V-4.1. 7. All Animals shall be ponned and/or constrained in a suitable building or enclosure that is detached from the main living accommodation, except when in the opinion of the Animal Control Officer a reasonable alternative exists and has been approved in writing. 8. No Owner shall permit their Animal to roam at large within the Town. 9. The Owner of any Animal roaming at large shall be liable for all damages and/or injuries committed or caused by the said Animal. 10. in The Owner of Animals shall ensure that any Odor produced by their Animals shall not aggrieve the gencral public. 6. The Council may order that upon the complaint of any Odor referred to in Section 5 of these Regulations, that the Odor shall immediately, where possible, be mitigated by the Owner of the Animals to the satisfaction of the Town. 7. Any person authorized by the Council, in general or specific torms, may Impound any Animal roaming at large. 13. An Owner may recover an Impounded Animal on such proof of their ownership as the Impounder may require and upon payment of all fees and expenses in connection with the Impounding and keep of the Animal. 14. The following fees shall be paid by owners of any Animals seized or Impounded, or deducted from the proceeds of any sales of such Animals: 15. (b) All other expenses incurred in Impounding the Animals. 16. (a) Seizing and Impounding fee - $50.00; and, 10. The Animal Control Officer, having regard to all circumstances, shall keep any Impounded Animal in the pound for a 24 (twenty-four) hour period oi, if held over a weekend or statutory holiday, until the next working day, and after expiration of such period shall offer such Animal for sale by public auction, and if the Animal be sold, all monies so received shall be retained by the Town Council. 11. Should there be no purchaser of any Animal offered for sale under section 10, the Animal Control Officer may forthwith destroy the Animal. 12. The Animal Control Officer may destroy any Animal found at large within the Town if in their opinion such Animal is diseased, injured, vicious, or in such condition that it should be destroyed for humane reasons. 13. The Town shall keep records of all their activities, and all reports of Animals Impounded. 14. No hunting, including bow hunting, is allowed within one thousand (1,000) meters of the boundaries of the municipal landfill. 15. Any person who contravenes any of the provisions of these Regulations is guilty of an offence and is liable on summary conviction; 7. (a) for a first offence to a fine not less than $100.00 and not exceeding $500.00 dollars, or to a term of imprisonment for a period not exceeding one month or to both the fine and imprisonment; and, 8. (b) for a subsequent offence to a fine of not less than $500.00 and not more than $1000.00 or to a term of imprisonment of not more than 3 months or to both the fine and imprisonment. 16. The Town of Happy Valley-Goose Bay (Animal Control) Regulations passed on September 22, 2002 are hereby repealed. 17. Thes Regulations were passed and adopted by Council on the.... \_ day of 2012 and may be cited as the Town of Happy Valley-Goose Bay Animal Control Regulations.
