The following regulations have been made by the Town Council of Happy Valley-Goose Bay under the provisions of the Municipalities Act, 1999, SNL 1999 c. M-24, and were approved by me on the 23rdday of October, 2012.

## WATER & SEWER REGULATIONS
- Interpretation - In these Regulations unless the context otherwise required:
- (a) "Act" means the Municipalities Act, 1999, SNL 1999 c. M-24;
- (b) "Commercial Scrvice" means any service other than Domestic Service ;
- (c) "Council" means the Town Council of the Town of Happy Valley-Goose Bay;
- (d) "Customer" means any person, firm or corporation who or which contracts to be supplied with water or the disposal of sewage from the system;
- (e) "Domestic Service" means the type of service supplied to the owner or their authorized agents or to the occupant or tenant of any space or area occupied for the distinct purpose of a dwelling house, rooming housc, apartment or flat:
- (1) "Regulations" mean these Water and Sewer Regulations;
- (g) "System" means the public water supply and sewerage system consisting of a plant and equipment for the production, transmission, delivery or furnishing of water to or for the public in the Town and for the conveyance and disposal of sewage from the system within the Town, which System is owned and operated by the Town; and,
- (h) "Town" means the Town of Happy Valley-Goose Bay as defined under the Act and/or any regulations or Orders made pursuant thereto.
2. Contracts - No water or sewerage service shall be provided by the System until a regular application form thereof has been signed by the prospective Customer,
- Life of Contract - Standard contracts shall be for a period of one year and thereafter shall be self renewing from month to month terminable by either party on one month's written notice.
4. New Installations - The cost of any new installation for which application is received by the Council shall be payable within two years from the date of such installation, save that these Regulations shall not apply to any installation in respect of which previous agreement had been made with the Council. The cost of any new installation for which application is received after installation shall be paid by the Customer before the water is turned on from the main and the sewerage connection completed.
5. Payment of Bills - Bills for water rates shall be rendered to each customer on a yearly basis. All bills shall be payable within thirty days after the date rendered, which date shall be clearly shown on the bill.
6. Refusal or Suspension of Services for Non-Payment of Bills - The Council shall have the right to refuse or suspend service from the System to Customers whose bills for water rates, sewerage rates or service charges remain unpaid after the year end.

Access to Customer's Premises - Representatives of the Council shall have the right of access to all parts of a Customer's property or premises at all reasonable hours for the purpose of inspecting any water or sewer pipes or fittings, or appliances of the System, or for the purpose of installing, removing, repairing, reading, or inspecting meters in respect of the System, and the Council shall have the right to suspend service to any Customer who refuses such access.
- Improper Use or Waste of Water - No Customer shall permit the improper use or waste of water nor shall they sell or give water to any person except under such conditions and for such purposes as may be approved by the Council in writing.
10. Repair to Services - If a leak or other trouble occurs in a service pipe in the System it shall be repaired as soon as possible. If the leak or trouble occurs between the main and the street line, it shall be repaired by the Council at its expense. If the leak or trouble occurs elsewhere on the System's service pipe it shall be repaired at the Customer's expense. The Council may make such repairs to the System for any Customer when requested to do so, and the Customer shall pay the cost of the repairs before the water is turned on. If a leak occurs on the Customer's portion of the service pipe of the System the Council may discontinue the supply of water to such service pipe if, in its opinion, such action is necessary in order to prevent wastage of water. The Council shall notify the Customer affected of its intention to discontinue the supply of water.
11. Thawing of Service Pipes - If freezing occurs in a service pipe of the System it shall be Thawed as soon as possible at the Customer's request and expense.
12. Interference with the System - No person, unless authotized by the Council, shall draw water from, open, close, cut, break, obstruct from free access to, or in any way injure or interfere with any hydrant, water main, water pipe, stop cock, meter or other part of the Notwithstanding this provision, and for greater clarity, nothing contained in these Regulations shall be deçmed to prevent an officer or member of the Fire Department, when engaged in the work of such Department, from using any hydrant or other part of the System.
13. Any person who neglects or fails to comply with, ot acts in contravention of any of the provisions of these Regulations shall be guilty of an offence and shall be liable on summary conviction
- (a) for a first offence to a fine of not less than $100 and not more than $500 or to a term of imprisonment of not more than one month or to both the fine and imprisonment; and,
- (b) for a subsequent offence to a fine of not less than $500 and not more than $1,000 or to a term of imprisonment of not more than 3 months or to both the fine and imprisonment.
15. The Town of Happy Valley Goose Bay (Water Supply and Sewerage) Regulations effective February 22, 2001 are hereby repealed.
