1 TOWN OF IRISHTOWN-SUMMERSIDE RECREATIONAL VEHICLES REGULATIONS 2022 Pursuant to section 10(2) of the Motorized Snow Vehicles and All-Terrain Vehicles Act, R.S.N.L 1990 and section 414(2)(5) of the Municipalities Act 1999 and all other power enabling it, the Town of Irishtown-Summerside hereby enacts the following regulations adopted by Council at a public meeting held on (dd) day of (month), A.D. 2022. TITLE 1. These regulations will be known as the Town of Irishtown-Summerside Recreational Vehicles Regulations 2022. DEFINITIONS 2. In these regulations: a. - vehicles or vehicles modified with the wheels removed and replaced by tracks, designed, or adapted for off-road use; b. wn of Irishtown-Summerside; c. -Summerside; d. council for all-terrain vehicle use; e. ined by the Highway Traffic Act; f. reserves, owned or maintained under the jurisdiction of the Town of Irishtown- Summerside; g. hway Traffic Act R.S.N.L 1990; h. snowmobile, where the driver sits astride a seat, and which is designed for operation over snow covered land and ice; i. -Terra Newfoundland and Labrador Motorized Snow Vehicles and All-Terrain Vehicles Act, R.S.N.L 1990; j. jurisdiction of the Town of Irishtown-Summerside; k. -road m -wheeled motorized vehicle that is being used off-road or is not registered under the Highway Traffic Act, and specifically includes a trail bike. 2 DESIGNATED ROUTES AND TIMES OF OPERATION 3. The designated route has signage posted: a. All-terrain vehicles are permitted to be operated on any by-road or public pathway in the Town of Irishtown-Summerside unless otherwise restricted by these regulations ; b. The route includes all by-roads namely Lane, Mu ; c. The ATV/UTV route does not include Route 440. A person may drive, operate or move a vehicle across a highway (Route 440) only at those points where the drive has not less than 100 meters of visibility in both directions along the highway; d. No person shall operate an all-terrain vehicle in accordance with these regulations before May 1 or after November 30 of each year; e. The person does not operate an ATV on a designated route earlier than _____ or later than ______ on any day. OFF-ROAD MOTORCYCLES 4. No person shall operate any two-wheeled motorized vehicle that is being used off-road or is not registered under the Highway Traffic Act within the Town of Irishtown- Summerside. SNOWMOBILES 5. Snowmobiles are not permitted to be used on any highway within the Town of Irishtown- Summerside. RULES OF OPERATION 6. No person shall operate an all-terrain vehicle upon a Town highway unless: a. That person travels upon a designated route as outlined in Section 3 of these regulations; b. The vehicle and its driver operate in accordance with the Motorized Snow Vehicles and All-Terrain Vehicles Act; c. That person is at least 16 years of age and the holder of a class of driver s license issued under the Highway Traffic Act; 3 d. That person or the vehicle being drive carries a valid liability insurance policy and proof thereof can be readily produced when requested by an enforcement officer; e. The all-terrain vehicle must be equipped with an exhaust system that is of the original equipment manufacturer design and has not been modified to increase sound. The exhaust system must be in working order and in constant operation; f. The all-terrain vehicle must never exceed any posted speed limit and further, regardless of the posted speed limit, shall never be operated at a speed exceeding 40 kilometers per hour on highways; g. The driver of an all-terrain vehicle must at all times yield the right of way to drivers of all other classes of vehicles on the highway; h. A person under the age of 16 years shall not operate an ATV in the Town unless: i. The person is at least 14 years of age and operating an ATV with an engine size of 90 cc or less; and ii. The person is accompanied by a person who is at least 19 years of age; iii. Accompanied means the person has visual and voice communication with the operator. i. Unless otherwise stipulated in these regulations, the driver of an all-terrain vehicle must adhere to the rules of the road as described in the Highway Traffic Act. SIGNAGE 7. Council may erect warning, cautionary, directional, limiting, or prohibiting signs regarding the operation of all-terrain vehicles and the operator of any vehicle who fails to obey such signs is guilty of an offence under these regulations. PENALTY 8. A person who contravenes or fails to comply with these regulations is guilty of an offence and where no penalty is otherwise prescribed for such offence in the Motorized Snow Vehicles and All-Terrain Vehicles Act, the Highway Traffic Act, or any other provincial statues or regulations, is liable on summary conviction to a fine or to a period of imprisonment in accordance with section 420 of the Municipalities Act 1999. 4 5 6
