Pursuant to the authority delegated by the Minister of the Department of Municipal &
Provincial Affairs under The Municipalities Act, Section 180, The Town of Irishtown-Summerside
has made the following Snow Clearing Regulations.

REGULATIONS
1. These regulations may be cited as the Town of Irishtown-Summerside Snowclearing Regulations,
2011.
2. Interpretations: In these regulations unless the context otherwise requires:
- a. "Council" means the Town Council of Irishtown-Summerside.
b. "Municipality" means the Town Council of Irishtown-Summerside.
- c. "Street Reservation" means the land reserved by the Council for a highway, street, lane or
sidewalk.
- d. "Vehicle" means a device in or upon which a person or property may be transported or
drawn upon a highway.
3. During the period from and including the first day of December in each year to and including the thirty-first day of March in the succeeding year, no person shall park an unattended vehicle
2. upon any street reservation within the Municipality between the hours of 12:00 midnight and
8:00 a.m.
- At any time during a snow storm and for the twelve hours thereafter, no person shall park an unattended vehicle on any street reservation within the Municipality. Any unattended vehicle parked on any street reservation within the Municipality in contravention of these regulations may be removed and impounded by the Council and the cost
- of such removal and impounding shall be recovered from the owner as a civil debt. Any person who violates any of the provisions of these regulations is guilty of an offence and
- liable on summary conviction to a penalty.

## TOWN OF IRISHTOWN-SUMMERSIDE
Pursuant to the authority delegated by the Minister of Municipal Affairs under Section 167 & 180 of the Municipalitles Act, The Town Councll of Irishtown-Summerside hereby make the following (Road Maintenance Regulations.
## REGULATIONS
These regulations may be cited as the Town of irlshtown-Summerside (Road Construction & Maintenance Regulations, 1999 and amended 2011.
Interpretations: In these regulations:
- a) "Act" means The Municipalitles Act
- b) "Council" means the Town Councli of Irishtown-Summerside.
- c) "Town" means the Town of Irishtown-Summerside
- . Before any road is taken over for maintenance by the Counci, the road shall be brought up t tandard by the residents who request that the town provlde maintenanc
- a) The road must be a minimum of Forty (40) feet wide and shall be adequately ditched with a 5 foot ditch on both sides.
- b) The road shall serve at least three (3) permanent residences.
- c) The road shall begin and end on publle property.
- d) The road shall be topped with good Class A material.
- e) A turn-around shall be provided at the end of the road to provide space for the snow plow and /or grader to turn without problem.
- f) an 18" culvert shall be properly installed at the intersection of the Main road and the newly constructed by-road, so as to provide adequate drainage and prevent flooding and washing out problems:
2. Any person who constructs a driveway which Intersects with a public road shall property install an 18* ....... To drain into the ditch on the public road, thus avolding flooding and run off damage to t he public road.
3. Where existing culverts or drainage pipes are not standard size and begin to cause problems such as plugging up, flooding or washing out, Councii shall order that the property owner replace the pipe with an 18° culvert. If the property owner does not comply, the Counci shall have the work done and the owner shall be responsible for payment of all costs incurred.
4. No person shall, within the Town of Irishtown-Summerside, erect a fence of any other structure within 25 feet of the center line of a public road, so as to impede or hinder winter maintenance and snowclearing of the road.
5. Where an existing fence or other structure has been erected within 25\_ feet of the center line of a public road, prior to the date that these regulations come into effect, the Town of Irishtown- Summerside shall not be responsible for damage that may occur to such structures during normal snowclearing operations.
- 6: No person shall, within The Town deposlt snow upon a public road.
7. No person shall, within the Town, engage in the watering of a public road with a garden hose, or pipe
of any kind, thus creating ruts and other damage to the puble road.
'8. No person shall, within the Town, dig up a public road, for the purpose of ditching, Installing a
waterline, or for any other purpose whatsoever, without the prior consent of the Council.
9. No person shall, within The Town, ditch his/her property so as to allow water to run onto a public
road, thus creating flooding and damage to the road.
- Any person found to be in contravention to these regulations shall be ordered to make the necessary
- completed and charging the property owner (s) for all costs incurred. These regulations were adopted by resolution of Council at a meeting held on Wednesday, the 13 day
repales or corrections. Fallure to comply with the order shail result in Council having the work
of October, 1999. These regulartions were amended by resolution of Council on the 22*, day. of
November, 2011.
