2 | 5 2.1 Licence Fees 2.1.1 A non-refundable dog licence fee in the amount as set from time to time by the Council, is payable for each dog or dangerous dog over the age of six (6) months. 2.1.2 Notwithstanding the provisions of subsection 2.1.1, every dog licence fee paid by an owner will be reduced by the amount as set from time to time by the Council upon production of proof, in accordance with s.1.2 of these regulations, that the dog is neutered or spayed. 2.1.3 A dog licence will be provided at no charge, for an assistance dog or assistance dog in training, which has been certified by a training facility acceptable to the Animal Control Officer, provided that appropriate proof of such certification is provided to the Animal Control Officer. 2.2 Period of Licence Validity 2.2.1 Every dog licence expires on a five (5) year annum, expiring on the thirty- first day of December, commencing the year in which such dog licence takes effect. 2.3 Replacement Dog Licence 2.3.1 A replacement dog licence may be issued upon payment of the fee in the amount as set from time to time by the Council. 2.3.2 The issuance of a replacement tag does not affect the period of licence validity as set out in s.2.2 of these regulations. 2.4 Change of Ownership 2.4.1 In case of a change of ownership of a licenced dog during the calendar year for which such dog is licenced, the original owner of the dog must notify the Animal Control Officer of such change of ownership. 3.0 INTERPRETATION 3.1 For the purpose of these regulations, unless the context otherwise requires: ACT means the Municipalities Act, 1999 SNL 1999 Chapter M-24 as amended. ANIMAL CONTROL OFFICER means an employee of the Town appointed to the job position or title of Municipal Enforcement Officer or acting in another capacity on behalf of the Town for the purpose of the enforcement of one 3 | 5 or more of the Town regulations; or, an officer of the Royal Newfoundland Constabulary. ASSISTANCE DOG means a dog specifically trained to assist a person with physical or sensory disabilities in the performance of daily activities. COUNCIL means the current Council of the Town. DANGEROUS DOG means: (a) any dog that has killed or injured: (i) a person, or (ii) a companion animal or domestic animal while running at large; or (b) any dog that an Animal Control Officer has reasonable grounds to believe is likely to kill or seriously injure a person; (c) any dog that aggressively harasses or pursues a person or companion animal or domestic farm animal while running at large; or (d) any dog owned primarily or in part, for the purpose of dog fighting or that is trained for dog fighting; or (e) any dog that according to the records of the SPCA, Royal Newfoundland Constabulary or other municipality, or to the knowledge of the owner, has killed, injured, or aggressively harassed or pursued a person or animal. DOG means any member of the canine species which is six (6) or more months of age. DOG LICENCE means a tag issued by the Town for the life of the dog or dangerous dog, on which is stamped the licence number for the dog or dangerous dog. DOG LICENCE FEE means the fees as set from time to time by the in Schedule A of the Town of Labrador City Municipal Fees, which are charged upon registration of a dog. LEASH means a device, or use of a device, of leather, metal, nylon or other similar strong material no more than three (3) meters in length and of sufficient strength and design to restrain the size and strength of dog or dangerous dog for which it will be (or is being) used. One end is securely affixed to a collar or harness which is securely attached to the dog or dangerous dog with the other end held by a person capable of controlling the dog or dangerous dog at all times. 4 | 5 OWN/OWNED includes possessor, harbourer, or keeper, and "owned" includes possessed harboured, or kept. OWNER means a natural person or body corporate who has legal title to a dog, and includes any person who has custody of a dog, either temporarily or permanently, or harbours a dog, or allows a dog to remain on his or her premises. TOWN means the Town of Labrador City as defined by Order-in-Council dated the 27th day of June, 1961, and any amendments thereto, according the Act. 4.0 OFFENCE AND PENALTY 4.1 Non-compliance or contravention of any of the provisions identified in these regulations shall result in liability for the penalties and fees established from time to time in Schedule A of the Town of Labrador City Municipal Fees; and, 4.2 Pursuant to the Town of Labrador City Violation Notice Regulations: 4.2.1 The Town may issue a violation notice with respect to failure to comply with a provision of these regulations; and, 4.2.2 Where a violation notice has been issued by the Town, a person shall be liable for penalties pursuant to the Town of Labrador City Violation Notice Regulations. 4.3 Pursuant to s.419(1) of the Act: 4.3.1 a person whom contravenes these regulations commits an offence; and, 4.3.2 Pursuant to s.419(2) of the Act, each day upon which the same offence is committed or continued is a separate offence. 4.4 Each person who commits an offence under these regulations or who acts in contravention of or fails to comply with any provision thereof, or neglects or refuses to do so shall be liable on summary conviction to a fine pursuant to s.420(1) of the Act. 4.5 The conviction of a person for failing to comply with a requirement or obligation referred to in section 4.4 shall not operate as a bar to further prosecution under these regulations for the continued failure on the part of the person in comply. 5 | 5 5.0 REPEAL 5.1 All previous Dog and Cat Regulations or Amendments thereto for the Town of Labrador City, are hereby rescinded. 6.0 SEVERABILTIY & CITATION 6.1 If a court of competent jurisdiction should declare any section or part of a section of these Regulations to be invalid, such declaration shall not affect the remainder of these regulations and the remainder of these regulations should be valid and shall remain in force. 6.2 These Regulations may be cited as 'Dog Licencing Regulations, 2019'.
