Animal Control Regulations
The following Animal Control Regulations have been approved by the Town Council of
The Town of Logy Bay- Middle Cove-Outer Cove under the provisions of the
Municipalities Act, Chapter M-24, effective January 1, 2000.
1.
These regulations may be cited as the "Town of Logy Bay-Middle Cove-Outer
Cove Animal Control Regulations".

In these regulations, if not inconsistent with the context, the following words and
expressions shall have the meanings assigned to them respectively in this Section.
(a)
"Act" means the Municipalties Act 1999;
(b) "Council" means the Town Council of the Town of Logy Bay-Middle
Cove-Outer Cove;
(c) "Town" means the Town of Logy Bay-Middle Cove-Outer Cove;
(d) "Municipal Enforcement Officer" means any person appointed as such by
the Council;
(e) "Animal" means any domestic animal, but shall not be held to mean dogs
and cats.

The Municipal Enforcement Officer through his/her appointment by Council is
given the authority and responsibility for the enforcement of these regulations
and shall keep a record of animals/owners who are violators of these regulations.
4.
Any person who has custody, charge or possession of any animal or who is the
owner of any property or premises where an animal is kept, shall be deemed to be
the owner of the animal for the purposes of these regulations.
5.
No person shall permit any animal of which he or she is the owner to roam at
large in the Town.
6.
Every owner of an animal within the Town shall keep that animal safely tethered
or in secure pasture such that the animal cannot escape and does not have access
to streets or private property within the Town.
7.
No person shall keep any animal which for any reason is a nuisance to persons in
the neighbourhood.
8.
The Municipal Enforcement Officer may destroy any animal found at large in the
Town if in his/her opinion said animal is diseased or injured or vicious or in
such condition that it ought to be destroyed.
9.
Should an animal be observed to be at large in the Town by the Municipal
Enforcement Officer, the following seen-at-large violation fees shall be paid by
the owner of the animal or added to taxes:
Violation Notice - First Offence
$ 50.00
Violation Notice - Second Offence
$ 75.00
Violation Notice - Third Offence
$ 100.00
Subsequent Violation Notices within a twelve (12) month period will
result in an additional $ 100.00 per violation.
10.
Prosecution under these Regulations may be taken summarily by any member of
the Council or by any police officer or by any person authorized by the Council of
the Town of Logy Bay-Middle Cove-Outer Cove.
11.
Any persons or persons interfering with the Municipal Enforcement Officer in the
course of his/her duties will be considered in violation of these regulations and
subject to prosecution under Section 12 of these regulations.
12.
Any person who is guilty of an offence under these regulations or who acts in
contravention of, or fails to comply with any provisions thereof, or neglects or
refuses to do so, shall be liable on summary of conviction in accordance with the
Municipalities Act.
(a)
For the first offence, to a fine of not less than $ 100.00 and not more than
$ 500.00 or to a term of imprisonment of not more than one (1) month or
to both the fine and imprisonment.
(b)
For a subsequent offence, to a fine of not less than $ 500.00 and not more
than $ 1000.00 or to a term of imprisonment of not more than three (3)
months or to both a fine and imprisonment.
All previous Animal Regulations or Amendments thereof, are hereby rescinded.
AMENDMENT TO TOWN OF LOGY BAY-MIDDLE COVE-OUTER COVE
NEWFOUNDLAND AND LABRADOR ANIMAL CONTROL REGULATIONS.
