AIRGUN BY-LAW Pursuant to the powers vested in it under and by virtue of Section 414 (2) (ee) of the Municipalities Act of Logy Bay-Middle Cove-Outer Cove Municipal Council in regular session convened on this 27 day of July A.D. 2009, hereby passes and enacts the following By-Law relating to the use of airguns in the Town Logy Bay- Middle Cove- Outer Cove. BY-LAW 1. This By-Law may be cited as the Town of Logy Bay- Middle Cove-Outer Cove Airgun By- Law. 2. For the purpose of this By-Law: a. Airgun includes those guns commonly referred to as B.B. and Pellet guns; 3. Except as hereinafter provided it shall be unlawful for any person to fire or discharge an airgun in the Town of Logy Bay-Middle Cove-Outer Cove. 4. No airgun shall be transported or moved from the airgun holder's private property except under the following conditions: a. The airgun shall be rendered inoperable; b. The airgun shall be, at all times, fully encased and enclosed in a case or holder made and used specifically for transporting the airgun and no part of the airgun shall be exposed to the public; and c. All ammunition and compressed gas cylinders that may be used for the operation of the airgun shall, at all times, be entirely separate from the case in which the airgun is fully encased or enclosed. 5. A police officer may seize any airgun where there are reasonable and probable grounds to believe that an offense has been committed pursuant to section 3 or Section 4. Where a charge is not laid pursuant to Section 3 or Section 4 within a period of 30 days from the date of the offence, any airgun seized pursuant to Section 5 shall be returned. 6. The provisions of this By-Law shall not apply to: a. Any person where prior approval for the discharge or use of an airgun has been received from the Town; and b. The firing or discharge of an airgun on a range approved by the Town for the said use. 7. Every person who contravenes or fails to comply with any provision of this By-Law shall be guilty of an offence and liable on summary conviction to the penalty as set out in the said Act; and in addition, the presiding Judge may order the firearm or weapon used in violation of the By-Law to be forfeited.
