## TOWN OF MASSEY DRIVE
## Water Conservation By-Law
The Newfoundland and Labrador Towns and Local Service Districts Act (2025) enhances local governance by providing municipalities with greater authority to implement water conservation measures. The Act enables municipal councils to enact by-laws for protecting water supplies, reducing unnecessary usage, and establishing appropriate restrictions.
Town of Massey Drive purchases treated water from the City of Corner Brook under a Water and Sewerage Agreement between the two municipalities. Water costs are based on a Basic Water Rate per residential or commercial unit, which includes a maximum allowable daily consumption per unit. If water usage exceeds this daily limit, the city charges the Town for the additional consumption. The rate applied to this excess usage is defined in the Water and Sewerage Agreement.
The Town of Massey Drive Water Conservation By-Law is designed to promote responsible water use through increased public awareness and education, a reduction in excessive residential and commercial consumption that may lead to cost savings for the Town, and the encouragement of environmental stewardship.
## 1.0 POWERS AND DUTY
- 1.1 The Massey Drive Town Council shall ensure that residents of the Town use treated water provided by the City of Corner Brook and flowed through the Town's water distribution system in a responsible manner.
## 2.0 DELEGATION AND ENFORCEMENT
- 2.1 The Council will delegate the day-to-day administration of the Water Conservation By-Law to the Town Manager/Clerk.
- 2.2 This By-law may be enforced by the Town Manager or a person designated by Council to enforce by-laws.
- 2.3 Utilizing municipal enforcement capacity will be at the discretion of the Town Manager.
## 3.0 WATER CONSERVATION MEASURES
- 3.1 water: For water conservation and/or efforts by the Town of Massey Drive to conserve
- 3.1.1 The Town will restrict the watering of lawns and gardens:
- 3.1.1.1 From midnight to 6:00am.
- 3.1.1.2 While it is raining.
- 3.1.2 New lawns, landscaping or major lawn repairs will be exempt from the lawn watering restrictions for a period of sixty (60) days following installation and plantation of the new lawn and landscaping, but must adhere to restrictions set out in section 3.1.1
- 3.1.3 Hand watering of trees, shrubs, flowers and vegetable gardens with a water can or hose with an automatic shut-off nozzle will be permitted at any time.
- 3.1.4 Using Town water to melt or remove snow and/or ice from properties, or to remove debris and dirt from lawns is strictly prohibited.
- 3.1.5 The domestic washing of cars within residential zones or on residential lots will be permitted with the use of a hose with an automatic shut-off nozzle.
- 3.1.6 Car washes for fundraising must receive prior approved from the Town and will only be permitted subject to the use of an automatic shut-off nozzle.
- 3.1.7 Free-flowing car washes that utilize unrestricted flow of water, whether for the purposes of fundraising, are not permitted.
- 3.1.8 Siding and window washing will be permitted subject to the use of an automatic shut-off nozzle.
- 3.1.9 The cleaning of commercial parking lots utilizing water is prohibited, however, the use of commercial sweeping equipment on a commercial parking lot is permitted.
## 4.0 PENALTIES
- 4.1 Pursuant to section 289 of the Towns and Local Service Districts Act, any person who is guilty of an offence against the By-Law or who acts in contravention of or fails to comply with any provision thereof or neglects or refuses to do so shall be liable on summary conviction.
