<!-- image --> ## PUBLISHED BY AUTHORITY <!-- image --> Pursuant to powers conferred by Part XVI, Regulations, s. 414(2)(s) and s. 414(2)(ii) of the Municipalities Act, 1999, the Community Government of Nain has made the following regulations. kaven bel ders Town Clerk, Karen Dicker AngajukKak, Tony Andersen - These Regulations may be cited as the: ## COMMUNITY GOVERNMENT OF NAIN RECREATION VEHICLE REGULATIONS, 2013 2. Interpretations: In these regulations, unless the context otherwise requires: - c) "Council" means the Community Government of Nain. - d) "motor vehicle" means as defined in f) below - g) "sled" means any snow sled or snow toy designed and made for a child, and having no rigid towing apparatus. - h) "owner" means: - "Act" means the Municipalities Act, 1999. - "Town" means the Community Government of Nain as defined by Order-in-Council dated the 30th day of October 1970 or any amendments thereto made. - "Town Clerk" means the Town Clerk of Nain. - "vehicle" means all motorized vehicles designed and constructed for travel on or immediately over land, water, snow, ice, marsh, swampland, and other natural terrain, including four-wheel drive or low-pressure-tire powered vehicles, low-pressure-tire motorcycles and related two-wheel vehicles, snowmobiles, amphibious machines, ground effect or air-cushioned vehicles, but does not include a motor vehicle. - i) the person who holds the legal title to a vehicle but, in the case of a vehicle which is the subject of a mortgage, the mortgagor if he/she is entitled to possession of the vehicle; - ії) in the case of a vehicle which is registered under the Motorized Snow Vehicles and All Terrain Vehicles Act, the person in whose name it is so registered; 1 <!-- image --> - ili) in the case of a vehicle which is the subject of a hire-purchase agreement, the person in possession of the vehicle under the agreement; or - iv) in the case of a vehicle which is the subject of a conditional sale contract, the buyer under the conditional sale contract if he/she is entitled to possession of the vehicle. - i) "joy riding" means operating a vehicle within the Community with no particular destination to be reached. - "person" means any person, firm, partnership, association, corporation, company or organization of any kind. - The driver of a vehicle shall at all times yield the right of way to drivers of all classes of motor vehicles within the Community. - No person under the age of sixteen (16) years shall operate a vehicle within the Community. - The owner of a vehicle shall not knowingly permit any person to drive a vehicle within the Community in contravention of the provisions of Section 4 of these Regulations. - There shall be no towing of sleds within the Community at any time if the sled is carrying any person or persons. - All vehicles must be equipped with a noise muffler or other noise reducing equipment, which shall be kept in good working condition and which shall prevent excessive or unusual noise. A person shall not equip a vehicle with a muffler cut-off, straight exhaust, gutted muffler, Hollywood muffler, bypass, silencer or other device which has the effect of by-passing or reducing the efficiency of that noise reducing equipment. - No person shall operate a vehicle within the Community: - without due care and attention; - without reasonable consideration for other persons or property; - while under the influence of intoxicating liquor, narcotics or habit-forming drugs; - which has defective head lights, or head lights which are not in operation after sundown; - at a speed greater than 25 km. per hour; <!-- image --> - f) for the purpose of "joy riding" between the hours of 10.30 p.m. and 7.30 a.m. 2. Pursuant to s. 419(1)() of the Municipalities Act, 1999, every person who contravenes these Regulations commits an offence and is subject to the penalties outlined in s. 420, more particularly 3. (a) For a first offence to a fine of not less than $100 and not more than $500 or to a term of imprisonment of not more than one month or to both the fine and imprisonment. 4. (b) For a subsequent offence to a fine of not less than $500 and not more than $1000 or to a term of imprisonment of not more than three months or both the fine and imprisonment. 10. All previous Municipal Recreation Vehicle Regulations or amendments thereto are hereby rescinded. 6. These Regulations were adopted and passed by Council on the 28 of May and shall come into effect on the 28 of Maand may be cited as the Community Government of Nain Recreation Vehicle Regulations, 2013. <!-- image --> <!-- image -->
