4130-9698-6727 TOWN OF PASADENA FIREWORKS CONTROL BY-LAW 1. SHORT TITLE This By-law may be cited as the "Fireworks Control By-law." 2. AUTHORITY This By-law is enacted pursuant to the authority granted under the Towns and Local Service Districts Act, SNL 2023, c. T-6.2, and specifically: - section 7(1)(e), which requires a town council to adopt a by-law, subject to the Fire Protection Services Act, for the prevention of fire within a town; - section 8(1)(a), which permits a town to make by-laws concerning health and safety; - section 8(d), which permits a town to make by-laws addressing nuisances and hazards; - section 8(f), which permits a town to make by-laws governing the use of property; and - section 290, which permits a town to impose penalties for non-compliance with by-laws. 3. PURPOSE The purpose of this By-law is to reduce nuisance complaints, protect public safety and property, support resident well-being, and establish clear rules respecting use of Fireworks. 4. APPLICATION This By-law applies to all lands within the municipal boundaries of the Town. 5. DEFINITIONS "Consumer Fireworks" means low hazard fireworks designed for outdoor recreational use by members of the public as described in the Explosives Regulations under the Explosives Act, RSC 1985, c E-17, as amended. "Discharge" means to ignite or set off Fireworks. "Display Fireworks" means high hazard fireworks designed for use by professionals as described in the Explosives Regulations under the Explosives Act, RSC 1985, c E-17, as amended. 4130-9698-6727 "Fireworks" means and includes Consumer Fireworks, Display Fireworks, Pyrotechnics, and for greater certainty, any device or composition designed to produce a visual or auditory effect through combustion, deflagration, or detonation, including but not limited to firecrackers, sparklers, aerial shells, roman candles, and other pyrotechnic articles intended for entertainment or celebratory use. "Permit" means written authorization issued by the Town for the Discharge of Fireworks. "Pyrotechnics" means high-hazard pyrotechnic theatrical explosives designed for use by professionals as described in Class 7, Division 2, Subdivision 5 of the Explosives Regulations under the Explosives Act, RSC 1985, c E-17, as amended. "Town" means the Town of Pasadena. 6. GENERAL PROHIBITION No person shall discharge Fireworks except as permitted under this By-law. 7. PERMITTED DATES AND TIMES (NO PERMIT REQUIRED) Consumer Fireworks may be Discharged during the following times without a Permit: - Canada Day: 9:30 p.m. (July 1) to 12:30 a.m. (July 2) - New Year's Eve: o 7:00 p.m. to 9:00 p.m. (December 31); and o 11:00 p.m. (December 31) to 12:30 a.m. (January 1) 8. PERMITS REQUIRED No person shall Discharge Fireworks without a Permit except in accordance with section 7 of this By-law. Permits are issued by the Town upon request, may include safety conditions and are issued solely at the Town's discretion. Applications must be submitted at least 14 business days in advance and will be assessed based on current fire risk and public safety considerations. The Town reserves the right to request additional information in support of any application. Permits shall not be issued during an active fire ban or when the Provincial Forest Fire Hazard Index is rated as "Very High" or "Extreme". The Town reserves the right to deny or revoke a permit if public safety is at risk. 4130-9698-6727 9. FIRE BANS AND SAFETY CONDITIONS Fireworks are not permitted during any municipal or provincial fire ban. Users shall ensure supervision, safe conditions, and proper safety equipment as per manufactures suggestion. 10. PROHIBITED LOCATIONS AND CONDUCT Fireworks are prohibited on Town property without authorization and must not endanger persons or property. 11. OFFENCES AND PENALTIES A person who commits an offence contrary to this By-law is liable for: - for a first offence, to a fine of not less than $100 and not more than $1,000 or to a term of imprisonment of not more than one month or to both the fine and imprisonment; or - for a subsequent offence, to a fine of not less than $1,000 and not more than $2,000 or to a term of imprisonment of not more than 3 months or to both the fine and imprisonment. 12. SEVERABILITY If any provision of this By-law is determined by a court of competent jurisdiction to be invalid or unenforceable, in whole or in part, then such provision shall be deemed to be severed from this By- law and the remaining provisions of this By-law shall continue in full force and effect. 13. REPEAL Any provisions of any previous by-laws enacted by the Town which are inconsistent with this By-law are hereby repealed. 14. EFFECTIVE DATE These By-laws were adopted by Council at a meeting held on April 20, 2026 and are effective as of that date.
