Town of Portugal Cove-St. Philip's
Smoking Ban By-Law
Pursuant to the authority conferred in section 8 of the Towns and Local Service Districts Act,
2025, the Town Council of Portugal Cove-St. Philip's has adopted the following regulations on
March 4, 2025.
1.0
TITLE
1.1 This document shall be known and cited as the Smoking Ban By-Law.
2.0
DEFINITIONS
2.1
"Council" shall mean the Town Council of Portugal Cove - St. Philip's.
2.2
"Town" shall mean the Town of Portugal Cove - St. Philip's.
2.3
"Smoke" shall include nicotine, tobacco and cannabis products including
cigarettes, chewing tobacco, cigarillos, cigars, pipe, snuff and vapor cigarettes, e-
cigarettes and other lighted smoking equipment that burns nicotine, tobacco or
cannabis.
3.0
BY-LAW STATEMENT
3.1
The purpose of this by - law is to promote a healthy environment for all
individuals to work and/or recreate by banning smoking on any Town owned and/or
maintained property, including playgrounds, open green spaces, parking lots, and town
vehicles.
4.0
APPLICATION
4.1
This By - Law shall apply to any person(s) on Town owned property, including
Town vehicles, and during Town events.
5.0
BY-LAW PROCEDURE
5.1
The Town of Portugal Cove-St. Philip's bans/prohibits smoking at all Town
facilities, vehicles, and events.
6.0
PENALITIES
6.1
Repeated offences will result in offenders being barred from future use of Town's
Facilities or asked to leave an event site.
7.0 REPEALS
7.1
This by-law shall repeal the Town of Portugal Cove-St. Philip's Smoking Ban
Policy enacted on September 29, 2020.
8.0

8.1
Date effective: March 4, 2025, Motion #2025-068.
