Town of St. Anthony Policy Manual Section II Subsection VI
SNOWCLEARING POLICY
The co-operation of the general public requested to compliance with the Town of St.
Anthony Snow Clearing Regulations. Residents are reminded that the Snow Clearing
Regulations prohibit overnight parking, not only on the street but also on the street right
of way. Since a number of infractions might be noted, residents are reminded that
arrangements should be made to ensure that they have a parking space clear of the right
of way because the RCMP will be requested to issue tickets to violators which may result
in a fine up to one hundred dollars ($100.00).
Also, it should be noted that it is a violation of the regulations to shove, plough, or blow
snow onto any street, and similar lines may be imposed to violations.

Pursuant to authority delegated by the Minister of Transportation and under the
Highways Traffic Act 1970, sections 210 and 211 and the provisions of the
Municipalities Act 1979, the Town of St. Anthony has made the following regulations:

Interpretations in these regulations unless the context otherwise requires.
(a) "Council": means the Town Council of the Town of St. Anthony.
(b) "Town": means the Town of St. Anthony as defined by paragraph 2 of
Order in Council dated the 18th day of July A.D. 1945 and made under the
provisions of the local Government Act.
(c) "Highway": means the entire width between the boundary lines of a
highway, road, street, avenue or thoroughfare, and for the purpose of these
regulations is intended to be defined in Section 2, subsection (ii) or the
Highway Traffic Act.
(d) 'Driveway": means a clearly defined private road, way, drive, path or
passage or a like opening which is wide enough, but not wider than is
necessary for the passage of a motor vehicle whereby the owner, occupier
or user of a property has vehicular access from a roadway to a point within
the property.
(e) "Parking Lot": means a clearly defined area of land provided by the
owner, occupier or user of a business premises for the use of the general
public for the parking of motor vehicles.

(f) "Vehicle": means a device in or upon which a person or property may be
transported or drawn upon a highway.
(g) "Street reservation": means the land reserved for the public road, street,
lane sidewalk or public way.

During the period from the first (1st) day of December in each year to the
thirtieth (30th) day of April in any succeeding year, both ways inclusive, no
person shall park an unattended vehicle upon any street reservation within the
town between the hours of 12:00 midnight and 8:00 a.m.

At any time during a snowstorm and for twelve (12) hours thereafter no
person shall park an unattended vehicle on any street reservation within the
town.

Any unattended vehicle parked on any street reservation within the town in
contravention of the regulations may be removed and impounded by the
Council and the cost of such removal and impounding may be recovered from
the owner as a civil debt.
5.
During the period from the first (1st) day of December in each year to the
thirtieth (30th) day of April in any succeeding year both days inclusive, no
person shall shovel, plough, cause to be shoveled or ploughed any residue
snow from a driveway or parking lot unto any street within the municipal
boundaries of the Town of St. Anthony controlled by the Town Council of St.
Anthony.
6.
The owner, occupier or tenant of a building shall not permit icicles to
accumulate on the eaves, gutters or window ledges of the building owned,
occupied or leased by him or her, to the extent that such icicles may become
dangerous to persons using the street on which the said building is located.
7.
Any person who violates any of these provisions shall be guilty of an offence
and shall be liable on summary conviction to a penalty not exceeding one
hundred dollars ($100.00) or in default of payment of such penalty to
imprisonment of a term not exceeding ninety (90) days.
8.
Prosecution under these regulations may be taken summarily by Council or
any Council employee, specifically authorized by the Council and by any
member of the RCMP.
