## FIREWORKS REGULATION POLICY

The St. Lawrence Town Council is pleased to issue a Fireworks Regulation Policy to outline dates throughout the year that fireworks are permitted to be discharged within the municipal boundaries, as well as regulations when discharging fireworks.
No person shall discharge fireworks within the municipal boundaries of the Town, except if carried out further to and in accordance with these regulations.
No person shall discharge or cause/allow the discharge of fireworks in such a manner as might create danger to any person, animal, or property, or do or cause or allow any unsafe act or omission in the discharging of any fireworks.
For the purpose of these Regulations, a noise will be considered to be unreasonably loud or excessive if it unreasonably disturbs, injures or endangers the comfort, response, health, peace or safety of reasonable persons of ordinary sensitivity in the vicinity.
Factors for determining whether a sound is unreasonably loud or excessive include but are limited to, the following:
- (i) the proximity of the sound to sleeping facilities, whether residential or commercial
- (ii) the land use, nature and zoning of the area from which the sound emanates and the area where it is received or perceived
- (iii) the time of day or night the sound occurs
- (iv) the duration of the sounds
- (iv) the volume of the sound
- (v) the nature of the sound; and whether the sound is recurrent.
The Town may, in its sole discretion and upon application, issue fireworks permit to an individual over the age of 18 allowing for the use of fireworks between dusk and 11:00 pm. Any such permit shall include the conditions that Council consider appropriate but shall, at a minimum, prescribe the place and time where the fireworks are permitted.
Nothing in these regulations shall or shall be deemed to alter, amend, or abrogate in any way the requirements and responsibilities set out in the Fire Protection Services Act, SNL 2008, c F-11.01, as amended, and its Regulations, or the Explosives Act, RSC 1985, c E-17, as amended, and its Regulations.
## FAMILY FIREWORKS:
No person shall discharge fireworks within the municipal boundaries of the Town without a permit approved by Council.
Fireworks are permitted within the Town, without permit:
- a) between dusk and 11:00 pm of the following days Victoria Day, Canada Day, St. Lawrence Day (1st Saturday of August) and Guy Fawkes Night
2. between dusk on December 31 (New Year's Eve) and 1:00AM of the following day; and
3. any other day and time as designated by Council.
The Town may, for weather-related or any other reason, declare that family fireworks shall not proceed Canada Day, St. Lawrence Day (1s" Saturday of August) or December 31 (New Year's Eve), and may announce an alternate day and time when the discharge of family fireworks is permitted.
Notice of the alternate day and time as referenced in section above shall be given by posting on the Town's website and by notice of social media.
A person (18 years or older) may discharge family fireworks outside of Victoria Day, Canada Day, St. Lawrence Day, New Years Eve/New Years Day & Guy Fawkes Night for a special event, by way of an approved permit request to the Town.
Approval of a Special Event may be subject to any terms and conditions Council approves, and no person shall discharge fireworks except in accordance with those terms and conditions.
Approval of Special Event may, by oral or written notice, be cancelled or suspended at any time by Council or designate. Upon receiving notice of a cancellation or suspension, the discharging of any fireworks must immediately cease.
Approval of a Special Event does not relieve the approval holder from responsibility for damage resulting from the discharge of fireworks.
No person shall discharge family fireworks in, into, or on:
- a) any building, structure, doorway, or vehicle;
- b) any highway, street, lane, square, road, or other public place; and
3. any land that they do not own unless the owner thereof has given written permission.
- d) Any property without a minimum distance of 25 ft. from the nearest property, household, or other structure
No person under the age of eighteen (18) shall discharge family fireworks.
Every person who discharges family fireworks shall have access to a fire extinguisher and bucket of water ready for immediate use at the site where the family fireworks are discharged.
Every person who discharges family fireworks shall do so in accordance with the instructions printed on each item or package.
## AERIAL FIREWORKS AND PYROTECHNICS:
No person shall discharge aerial fireworks or pyrotechnics within the municipal boundaries of the Town without first obtaining approval.
## FIRE BAN
Notwithstanding the above sections, where a prohibition on the setting of fires in relation to forest lands within or adjacent to the boundary of the Town of St. Lawrence has been proclaimed under the Forestry Act, RSNL 1990 c F-23, as amended, and remains in effect, no person shall discharge fireworks within the boundaries of the Town.
## PENALTY
Any person who contravenes the provisions of this By-Law shall be guilty of an offence and liable upon summary conviction to a penalty as provided for in Section 419 of the Municipalities Act, 1999.
In the event of any person failing to do anything listed under these regulations they ought to have done, the Town may do that act and recover the expenses thereof from the person in default as a civil debt.
