<!-- image --> ANIMAL CONTROL REGULATIONS ## PUBLISHED BY AUTHORITY The following Regulations have been made by the Town of Steady Brook under Section 414(2) of the Municipalities, Act, 1999, SNL 1999, c M-24. Bill lousn , Mayor <!-- image --> ## Short Title - Brook. These Regulations may be cited as the Animal Control Regulations of the Town of Steady ## Definitions 2. In these Regulations: 2. (a) "Animal" means any and all types of animals, both domesticated and wild, including (but not limited to), dogs, cats, and other pets, fowl, livestock, and wild animals which customarily live independently of people in natural conditions. 3. (b) "Clerk" means the Town Clerk or Town Manager of the Town of Steady Brook. 4. (c) "Council" means the Town Council of Steady Brook. 5. (d) "Dog" means a dog of any age and includes an animal which is a cross between a wolf or coyote and a dog. 6. (e) "Cat" means a male or female cat of any age and includes those that are domesticated and those that breed and/or live in the wild. 7. (f) "Impounder" means any person appointed as such by the Town for the purpose of these Regulations. 8. (g) "License" means a license for a Dog issued by the Town or a Licensing Officer. 9. (h) "Licensing Officer" means any person appointed as such by the Town for the purpose of these Regulations. 10. (i) "Owner" means a Person who has custody, charge, possession, or control of an Animal, including the owner, tenant, or person in charge of the premises where an Animal is kept, permitted to live, or remain. 11. (i) "Person" means a natural person or any other legal entity. 12. (k) "Property" means any private or public real property within the Town, including land, together with all improvements which have been so affixed to the land as to make them, in fact and in law, a part thereof. 13. "Regulations" means these Animal Control Regulations. - (m) "Town" means the Town of Steady Brook. ## Licensing and Restrictions - No Person shall keep any Dog which is at least three (3) months old within the limits of the Town unless a License has been issued for such Dog. 4. The Council may appoint Licensing Officers who shall maintain a registry of licensed Dogs. - The Owner of every licensed Dog shall, immediately on receiving the License, attach to a collar, which shall be kept on the Dog's neck at all times when it is outside the enclosed premises of the Owner. The License tag is to be furnished by the Town or a Licensing Officer. - No Person shall keep more than four (4) Dogs unless that Person has a property constructed kennel which has been approved by the Town. ## Impounding and Euthanizing - The Impounder may seize and impound any Animal found at large and may enter any Property for the purpose of recapturing any Animal that may escape from their control. - Any Animal found damaging persons or damaging Property may be seized by the injuriously affected Person or Persons and held for collection by the Impounder. 9. When an Animal has been impounded, the Impounder shall make a record of such impounding in a book kept for that purpose and shall take all reasonable steps to contact the owner of the Animal. 10. An Owner may recover any impounded Animal upon: - (a) such proof of his ownership of the Animal as the Council may require and upon payment of all fees in connection with the impounding; and - (b) if the Animal is a Dog or a Cat for which a License has not been issued, upon issuance of a License for said Dog or Cat. 11. The following seizing and impounding fees shall be paid by the Owner of Animals seized or impounded, or deducted from the proceeds of any sales of such Animals: | Seizing and Impounding 1st Offence. | $50.00 | |---------------------------------------|----------| | Seizing and Impounding 2ndOffence. | $100.00 | | Seizing and Impounding 3d Offence | $200.00 | | Seizing and Impounding 4* Offence.. | $400.00 | | Daily Fee for each dog held in Pound | $50.00 | 12. Where an Animal's Owner is unknown or the Animal remains unclaimed after 10 days of being impounded, the Impounder may sell, give away, place for adoption, or arrange for the Animal to be euthanized by humane means. ## Excrement 13. No Owner shall permit their Animal to discharge excreta or to defecate on any Property other than Property rented or owned by the Owner unless the Owner immediately thereafter removes and cleans up such excreta or defecation from the Property. ## Control of Animals 14. No owner shall permit or allow an animal to stray, roam, or run at large in the Town of Steady Brook. ## Penalties 15. A Person who contravenes or fails to comply with these Regulations is upon summary conviction guilty of an offence and is liable to a fine of not less than $100 and not more than $1,000, or to a term of imprisonment of not more than six months, or to both the fine and the imprisonment. 2. Prosecution under these Regulations may be taken summarily by any member of the Council, or by any police authority, or by any Person authorized by the Council. 17. Notwithstanding Section 5 of the Provincial Offences Act, SNL 1995 c P-31.1, any Person who violates these Regulations is upon summary conviction guilty of an offence and is liable to a fine of not more than the maximum and not less than the minimum amount prescribed for such offence in Schedule "A" attached hereto. ## Obstruction - No Person shall interfere or obstruct an Impounder in the execution of their duties under these Regulations. ## Miscellaneous 19. In any proceedings under these Regulations, the onus proof that a Dog was under the age of three (3) months old shall be upon the Owner of the Dog or the Person having possession thereof. 20. Any Person who has custody, charge, or possession of any Animal, or who is the Owner of any Property where an Animal is kept or permitted to live or remain shall be deemed to be the Owner of the Animal for the purposes of these Regulations unless they prove that they are not the owner of the Animal. 21. Any Person authorized to euthanize an Animal under these Regulations shall do so as humanely as reasonably possible. 22. Any Animal euthanized under these Regulations shall be disposed of through burial or cremation. ## Coming Into Force 23. These Regulations were adopted and passed by Council at a meeting held on the /4 day of pul. 2023 and are effective as of that date.
