The following regulations have been made by the Town Council of the Town of Stephenville Crossing under the provisions of Section 414, subsection (2) (j) (IV) of the Municipalities Act, 1999, and Section 11 of the Motorized Snow Vehicles and All-Terrain Vehicles Act, 1973, as amended

## MOTORIZED SNOW AND ALL-TERRAIN VEHICLE REGULATIONS
- These regulations may be cited as the Town of Stephenville Crossing Motorized Snow and All-Terrain Vehicle Regulations.
2. In these regulations unless the context otherwise requires:
- (a) "Constable" means a member of the Royal Canadian Mounted Police, a municipal enforcement officer, appointed by the Council under Section 194 of the municipalities act.
- (b) "Council" means the Town Council of Stephenville Crossing
- (c) "Motor Vehicle" means a motor vehicle registered under the Highway Traffic Act.
- (d) "Vehicle" means all motorized vehicles designed and constructed for travel on or immediately over land, water, snow, ice, marsh, swampland, or other natural terrain, including but not restricting the generality of the foregoing, four-wheel drive or low pressure tire powered vehicles, low pressure tire motorcycles, and related two-wheel vehicles, snowmobiles, amphibious machines, ground-effect or air-cushioned vehicles, but does not include a motor vehicle.
3. (1) No person shall drive, operate or otherwise move a vehicle upon a highway except in accordance with the provisions of these regulations.
- (2) No person shall drive or permit to be driven a vehicle within the municipal boundary of the Town of Stephenville Crossing or within Stewardship area boundary other than on a designated trail as per schedule A
## 4. PURPOSE
The purpose of these regulations is to prohibit the use of all vehicles except motor vehicles unpowered bicycles, tricycles, and toy carts within the municipality except such tides or under conditions as may be designated by council for ihe use of
## 5. DESIGNATED AREAS
Not withstanding Regulation 3 (2), the Council may designate areas within the municipality where vehicles may be driven, railroad crossings, and such areas shall be listed and defined on Schedule "A" of these regulations.
## 6. EXEMPTION
Not withstanding Regulation 3 (2), a constable may use or cause to be used a vehicle in a prohibited area where such intended use is to:
- (A) enforce these regulations, or
- (B) perform an emergency service
## OFFENCES AND PENALTIES
A person who contravenes a provision of Section 3 of these regulations is guilty of an offence and liable on summary conviction:
- (A) for the first offence, to a fine of not less than one hundred dollars ($100.00) or more than five hundred ($500.00) dollars, and the vehicle impounded until the fine imposed by the court is paid in full.
- (B) for a second offence, to a fine of not less than two hundred dollars ($200.00) or more than eight hundred ($800.00) and the vehicle impounded until the fine imposed by the
- (C) for a third or subsequent offense, a fine of five hundred ($500.00) and loss of vehicle.
8. When a sign which has the word "Stop" inscribed thereon is erected at or near the intersection of a highway and the designated trail, the driver of the vehicle on the designated trail shall stop his vehicle before crossing the highway, shall then proceed with special care and give way to traffic on the highway.
9. A person may drive, operate or move a vehicle across a highway only at such points where the designated trail intersects with the highway.
10. No person shall drive any motor vehicle at a speed in excess of 25 km per hour on the designated trail within the limits of the town, unless otherwise posted
11. Not withstanding any other provisions of these regulations a person shall not drive a vehicle on the designated trail or in any other place within the limits of the town:
- (A) at a speed which is greater than is reasonable and prudent under the conditions having regard to actual and potential hazards.
- (B) without reasonable consideration for other persons;
- (C) in a manner that is dangerous to the public;
12. Every vehicle shall be equipped with a noise muffler or other noise-reducing equipment which shall be in good working condition and which shall prevent excessive or unusual noise, and no person shall equip a vehicle with a muffler cut-off, straight exhaust, gutter muffler, hollywood muffler, by-pass or other device which has the effect of by-passing or reducing the efficiency of such noise-reducing equipment.
13. The council may cause to have erected warning, cautionary, directional, limiting or prohibiting signs respecting the operation of vehicles and the operator of any vehicle who fails to obey such signs is guilty of an offence under these regulations.
14. Council may, for designated purposes, issue a permit for the use of a ATV on a highway within the municipality, with which they have control.
15. (A) Subjects to Section 18, the following must apply:
- (i) the individual/organization must apply in writing to council for a permit.
- (iii) all conditions of the permit must be met.
16. (1) (a) no person under the age of 16 years shall operate a vehicle
- (b) no one shall cause or permit a person under the age of 16 years to operate a vehicle unless such a person is accompanied and supervised by another person who is 19 years or older.
- (2) (a) no person under the age of 13 years shall drive a motorized snow vehicle and
- (b) no one shall cause or permit a person under the age of 13 years to drive a snow vehicle, unless such a person is accompanied by another person who is 19 years of or older.
- (3) For the purpose of subsection (1) and (2) an operator is accompanied and supervised when the older person is riding on the same vehicle and has visual and voice communication with the operator.
These regulations shall come into effect on the 01\_ day of July, 2000.

## CONDITIONS OF PERMIT
1. The ATV must be registered
2. The operator must be 16 years of age or older and have a valid Drivers Licence.
3. The ATV can only be used on the Parade Route designated by council.
4. The operator of the ATV must wear a helmet and protective glasses.
5. The ATV must comply with all equipment Regulations as prescribed under the Town of Town of Stephenville Crossing ATV Regulations.
6. No person other than the operator shall ride on a ATV unless the vehicle is designed and equipped by the manufacturer to carry more than one person.
7. The ATV cannot be driven to or from Parade Site.
8. The operator of the ATV must produce a valid Drivers Licence, Registration & insurance
9. The operator must produce, upon request, the permit to operate the ATV in the Parade.
10. Any violations of this permit shall render the permit null and void.
