The following regulations have been made by the Municipality of Trinity Bay North pursuant to the provisions of Section 8, Chapter T-6.2. SNL 2023 of the Towns and Local Service Districts Act.

- This By-Law may be cited as the Municipality of Trinity Bay North Motorized Recreational Vehicle by-law.
2. Interpretation
- (i) "Act" means the Municipalities Act, Chapter M-24 of the R.S.N., 1999, as amended.
- (ii) "Council" means the Town Council of Trinity Bay North.
- (iii) "Enforcement Officer" means a member of the Royal Canadian Mounted Police stationed in the Province of Newfoundland & Labrador or any person appointed by the Town Council of Trinity Bay North to enforce these Regulations pursuant to Section 179(1)(2).
- (iv) "Highway" means the entire width between the boundary lines of a highway, road, street, avenue, crescent, lane, alley, place, bridge or causeway whether it is publicly or privately owned.
- (v) "Motor Vehicle" means a motor vehicle required to be registered under the provisions of the Highway Traffic Act.
- (vi) "Recreational Vehicle" means all motorized vehicles designed and intended for travel on or immediately over land, water, snow, ice, marsh, swampland or other natural terrain, including but not restricting the generality of the foregoing, four wheel drive or low pressure tire powered vehicles, low pressure tire motorcycles and related two, three and four wheel vehicles, snowmobiles, amphibious machines, groundeffect or air cushioned vehicles, but does not include a motor vehicle.
- (vii) "Pedestrian" means a person walking, jogging, skiing, sliding, hiking or engaged, without restricting the generalities of the foregoing, in any other recreational activity
- (vili) "Town" means the Municipality of Trinity Bay North as defined in and any amendments made thereto or contained under the Towns and Local Service Act.
- (ix) "Traffic" means the flow or movement of recreational vehicles and the presence of pedestrians.
- (x) "Designated Street" means Municipal Roads or Provincial Roads or Highways within the Town timits of the Municipality of Trinity Bay North designated by Council for use by recreational vehicles.
3. No person shall operate a recreational vehicle within the Town limits unless the area has been designated by Council to allow the operation of a recreational vehicle with such conditions
- applicable as Council may designate; or are subject to Subsection 5. Operation within Town Parks, Community Garden and Playgrounds is strictly Prohibited.
4. Subject to subsections (3) and (5), a person may operate a recreational vehicle in a designated area subject to the following conditions:
- (1)::. No person shall operate or being the owner, allow another person to operate a recreational vehicle on a designated area unless there is in force a policy of insurance respecting the recreational vehicle being operated with an insurance company licensed to do business in the Province of Newfoundland, with such insurance coverage for public liability and property damage being a minimum of Two hundred thousand dollars ($200,000.00).
- (ii) No person shall operate a recreational vehicle on a designated area at a speed greater than 20 kilometers per hour unless otherwise posted.
- (iii) The operator of a recreational vehicle in a designated area shall at all times yield the right-of-way to drivers of all classes of motor vehicle and pedestrians.
- (iv) The operator of a recreational vehicle shall drive the recreational vehicle to the right side of the designated area as close to the shoulder or sidewalk as possible.
- (v) No person shall operate or ride as a passenger on a recreational vehicle unless wearing a helmet that complies with the standards of the Highway Traffic Act. and any regulations made thereunder and further, that such helmet must be properly fastened to the operator or rider.
- (vi) No person under the age of 16 years shall be permitted to operate a recreational vehicle in a designated area unless that person is accompanied by or under the immediate supervision of an adult 19 years of age or older.
- (vii) No person operating a recreational vehicle shall cross a highway unless the operator has first brought the recreational vehicle to a complete stop and has yielded the right-or-way to all motor vehicles and pedestrians.
- (vili) No person shall operate a recreational vehicle in any designated area with disregard to the circumstances or in a manner that is imprudent and unsafe or operation causing damage to public and or private property.
5. Where there is no trail available and or to gain access to a trail, Recreational vehicles (other than motorized snowmobiles) are permitted on all Highways, Municipal Roads, streets, avenues, and bridges within the boundaries of Trinity Bay North and must follow all Provincial Regulations. Motorized Snowmobiles are permitted to cross Highways.

- Operators and or passengers must wear a helmet and travel at a speed of no more than 20km/hr.
- Operators must yield the right-of-way to any vehicles on the roads or highway at all times.
- Off-road vehicles must have a plate & be registered. The registration does not expire and is valid for as long as you own your vehicle.

- You must have insurance if you cross or travel along a road, street, bridge, and or highway. Proof of insurance may be requested by law enforcement.
- Operators are permitted to cross a provincial highway where the operator has up to 150 meters of visibility in both directions.
- Operators are also permitted to travel along the shoulder of a provincial highway to access a trail, for a maximum distance of 1 km at a speed of no more than 20 km/hr.
6. Use of recreational vehicles with modified exhaust systems, creating excessive noise, is not permitted inside town boundaries. Excessive vehicle noise caused by modified exhaust systems creates disruptions and disturbances to residents and causes distress to pets and wildlife.
## Off-Road Vehicles safety Training.
- (i) Training must be completed as per Newfoundland Provincial regulations.
8. Every person who fails to comply with or otherwise contravenes this By-Law is guilty of an offence & is liable on summary conviction as per the Highway Traffic Act of Newfoundland & Labrador.
