FENCE REGULATIONS 1. INTERPRETATIONS: In these regulations unless the context otherwise requires. ( a ) "ACT" means the Municipalities Act, 1972. ( b ) "COUNCIL" means the Town Council of Victoria. ( c ) "TOWN" means the Town of Victoria as defined by paragraph 2 of Order of Council dated 21st., day of June, A.D., 1971 and made under the provisions of the said "ACT." 2. All fences erected on lots abutting on any local street or road or as a boundary between properties within the limits of the Town shall be constructed only of material which meets with the approval of the Council in accordance with the Town Plan. 3. All fences referred to in Regulations 2 of these regulations shall be erected only after a permit in writing has been issued by Council. 4. (a) Except with the approval of the Council in writing no person shall erect any fence, shrubs, or hedging or any other boundary marks as referred to in Regulations 2 and 3 of these regulations at a distance of less than 7 meters from the center of any road or street within the limits of the Town. (b) The Council may, subject to such conditions as it deems fit to impose, permit the erections of fences at distances less than that prescribed in paragraph (a) of this regulations 5. All shores and posts supporting any fence described in Regulations 2 of these regulations shall be placed on the side of the fence remote from the road or street along which the fence is erected. 6. Every person who owns or occupies a lot abutting on any road, street or lane or highway within the Town "MAY" be required to fence such lot and keep as well as maintain the fence in repair to the satisfaction of the Council. 7. All repairs to fences or walls of concrete, rock or stone shall require a permit in writing form Council, and if any such fences are considered by the Council to constitute a danger to the public, the owner shall on order from the Council repair or remove same at the owners expense. 8. The Council may cause the removal at the expense of the owner of any fence, shrubs, hedging, and house, step, erection or projection whatsoever or any part thereof which now or at any time hereafter protrudes into or over any land reserved for a road, street, lane, sidewalk or other public way within the limits of the Town. 9. Any Business which operates in, or is involved in storage of materials in the Town of Victoria, shall be required to apply for a permit from Council to erect a fence and the fence shall be of materials as specified by the Council and shall meet all requirements of the Town Plan. 10. Any person who violates any of the provisions of these regulations shall be guilty of an offense and shall be liable on summary conviction to a fine not exceeding One Thousand Dollars or in default of payment, to imprisonment for a period not exceeding ninety days or to both such fine and imprisonment. 11. These regulations shall come into effect on the __________________ day of __________ A.D., 1987 and may be cited as the Town of Victoria (FENCE) Regulations.
