PUBLISHED BY AUTHORITY
Pursuant to the power conferred by Section 254 of the Municipalities Act the Town Council of
Victoria has made the following regulations:
NOISE ABATEMENT REGULATIONS
(1)
INTERPRETATIONS: In these regulations, unless the context otherwise requires:
( a )
AAct@ means the Municipalities Act.
( b )
ACouncil@ means the Town Council of Victoria.
( c )
ATown@ means the Town of Victoria as defined by order-in-Council dated the 1st
day of July 1971, and any amendments thereto, according to the Municipalities
Act.
( d )
APerson@ means any person, firm, partnership, association, corporation or
organization of any kind.
(2)
No person shall, between the hours of 11 p.m. to 7 a.m., use or operate a lawn mower,
chain saw, snowmobile, radio, record player, tape recorder, compact disc. player, musical
instrument, machinery truck or any other equipment, implement or device of any nature
in a manner which is likely to disturb the peace of a neighborhood. Including back
garden barbecues or parties of any sort.
(2-1) No person shall use Town streets for street sports at any time in the Town. Sport
activities such as street-hockey, basketball and any other sport activity that may be
obstructive and/or disruptive to the public in any way.
(2-2) Notwithstanding the provisions of sub-paragraph (1) hereof Council may grant
permission to operate, conduct and/or carry out any activity which makes or allows to be
made in connection with such activity any noise which disturbs or tends to disturb the
place and tranquility of the Town or any portion thereof upon such terms and conditions
and for such period of time as the Council may deem appropriate.
(3)
No person shall permit a dog owned by him/her or under his/her care or control to bark
when it is likely to disturb the peace and quiet of a neighborhood.
(4)
Nothing in these bylaws shall be deemed to prohibit the following:
( a )
The sounding of any bell, horn, siren or other signal device on any motor vehicle,
motorcycle, bicycle, or other vehicle of what-so-ever kind, when the sounding of
such signal device is required by law.
( b )
The sounding of the siren or horn or any vehicle of the Police or Fire Department
or any Ambulance or any Public service or Emergency vehicle while answering a
call.
( c )
The ringing of any church bell.
( d )
It stall be the duty of a police officer or any person assigned by the Council to
enforce these Regulations.
( e )
To report in writing the name and address of any person observed or reliably
reported to have violated any of the provisions of these regulations.
( f )
To report in writing the time and nature of the violations of the Regulations, and
any circumstances being relevant to the violation.
( g )
To serve upon the person violating any provision of these Regulations a serially
numbered notice that the person concerned has violated a provision of the
Regulations, and instructing such person to carry out any other in regard to such a
violation.
( h )
To furnish the Town Clerk a duplicate of each serially numbered notice of
violation.
( i)
Any person who contravenes any of the provisions of these regulations is guilty of
an offense and shall be liable on summary conviction to a penalty not exceeding
Ninety (90) days or to both such fine and imprisonment.
( j )
These regulations were passed and adopted by Council on the 28th day of October
1996, and will come into effect on the 28th day of October 1996, and may be cited
as the Town of Victoria (Noise Abatement) Regulations, 1996.
( k )
The Noise Regulations were amended at meeting, November 4th, 1997 and (2-1)
was included by Council.
