The following regulations have been made by the Town Council of
the Town of Victoria under the provisions of Section 189 of the
Highway Traffic Act and under section 414 of the Municipalities
Act, 1999, as amended.
Adopted by the Town Council of the Town of Victoria on the day
of July, 2013.

TRAFFIC REGULATIONS
1. These Traffic regulations may be cited as the Town of
VICTORIA Traffic Regulations;
2. In these regulations:
(a) "Act" means Municipalities Act, 1999, as amended;
(b) "Council" means the Town Council of Victoria;
(c) "Commercial Vehicle" means any vehicle that is used or
designed for business use or is used in conjunction with
a business, trade, or profession and includes a bus,
truck, delivery van or wagon, tractor, truck tractor,
and trailer whether attached to a truck or not, heavy
equipment, construction equipment, but does not include
a passenger car, light truck, or van rated to carry
less than 1.5 tonnes or recreational vehicle;
(d) "Highway" includes a place, street, road, or way
including a structure forming part of the place, road,
or way, designed and intended for, or used by, the public
for the passage of traffic or the parking
of vehicles and includes the highway reservation and all
the space between the boundary lines of the place, road,
or way including the shoulder of such highway;
"motor vehicle" means a vehicle propelled, driven or
controlled otherwise than by muscular power
(e) "owner" means the person who holds legal title, or in the
case of a registered vehicle, the person or other
entity to whom such vehicle is registered
(f) "Park" means to permit a vehicle, whether occupied
or not, to stand otherwise than temporarily for
the immediate purpose of and while actually
engaged in loading or unloading goods or taking
up or setting down passengers or in obedience to
traffic regulations or traffic signs or the
directions of a traffic tower;
(g) "Person" means any person(s,) firm, partnership, association,
corporation or any organization of any kind
(h) "sign" includes all traffic control signals, warning sign
posts, direction posts, lines, marks or other devices for
guidance of persons using highways
(i) "Town" means the geographical area of the Town of
Victoria as defined in the Town of Victoria Order
O.C.96-170;
(j) "trailer" means a vehicle which has no motive power of
its own and which is attached to a truck, or truck
tractor or other motor vehicle
(k) "vehicle" means a device in, upon or by which a person or
thing may be transported or drawn upon a highway and
includes trailer
(l) "motor vehicle" means a vehicle propelled, driven or
controlled otherwise than by muscular power
3. No person shall park a motor vehicle, or trailer either
attended or unattended, in any area designated as a fire
lane;
4. No person shall park a motor vehicle or trailer so as to
obstruct the free passage of traffic on a highway;
5. Regulations 3 and 4 shall not apply to ambulances or
firefighting apparatus or to motor vehicles operated by
medical doctors, nurses, clergy, police or members of
the fire department, when at the scene of an emergency;
6(a) No person shall park a commercial motor vehicle on
any highway in any residential zone in the town,
unless a permit for the parking has been issued by
the Council;
(b) An application for a permit to park a commercial
motor vehicle in a residential zone shall be made to
the Council in such form as prescribed by the Council
and every applicant for a permit shall furnish with the
application such information as Council may determine;
(c) The Council may attach to the permit such conditions as
it deems fit for the parking of any such commercial motor
vehicle in a residential zone and may permit parking for
such limited time as it deems fit;
(d) The Council may prescribe different classifications of
commercial motor vehicles and may attach different
conditions to different classifications as it may deem
appropriate
(e) Any such permit may be cancelled and or the
conditions thereof be amended by Council at any time
as in its sole discretion Council deems fit
7. Regulation 6 shall not apply to:
(a) Motor vehicles of the Town;
(b) Motor vehicles of the Royal Canadian
Mounted Police responding to a call;
(c) Motor vehicles of the Newfoundland Hydro
Corporation, Newfoundland Power, a utility company,
or the Victoria Volunteer Fire Department,
responding to a call;
(d) Ambulances responding to a call;
8. The driver of a commercial motor vehicle, loading or
unloading freight within the town shall, if possible,
pull the motor vehicle off the highway onto some private
parking space. Where this is not possible, the driver
shall when loading and unloading freight pull in as near
as possible to the curb and load and unload as quickly
as possible, but in no case shall a driver place a motor
vehicle in such a position as to obstruct the normal
flow of traffic;
9. No person shall park a motor vehicle or trailer on any
highway in such manner so as to hinder, impede,
inconvenience or prevent the plowing and/or removal of
snow and or ice from the highway;
10. No person, whether occupant or owner, agent or employee,
when keeping a pathway, driveway, or any other portion of
land free of snow or ice, shall throw, scoop, dump, or
place any snow or ice onto a highway such that it
interferes with, hinders, impedes or obstructs in anyway,
pedestrian or vehicular traffic
11(a) The Council may cause or permit traffic lights or signs
to be placed on or near any highway within the limits of
the Town;
(b) Traffic lights or signs erected or authorized under
subsection(1) may be signs for any of the following
purposes:
1. To regulate the movement of traffic;
2. To indicate the route to be followed by traffic;
3. To restrict or prohibit the use of any part of any highway,
other than a main highway designed as such by the Minister
of Transportation and Works, within the limits of the Town;
4. To indicate maximum speed limits in any area or on any part of
any highway within the limits of the Town, so that
vehicles driven in excess of such speed shall be taken to
have failed to conform to the indication given by the
sign;
5. To restrict or prohibit the parking of vehicles in any area
or on any part of any highway within the limits of the Town;
6. To restrict or prohibit temporarily the use of any highway,
other than a main highway designated as such by the
Minister of Transportation and Works, or any part of any
highway within the limits of the Town, whenever, owing to
the likelihood of danger to the public or serious damage to
the highway, it appears to the Council to be necessary; and
to limit the loads of vehicles owing to the condition of
the highway if the Council deems it necessary, provided
that the traffic lights or signs shall not apply to any person
granted a permit in writing by the Council to use the
highway in case of an emergency:
7. To warn users of the highway of the need for special
caution;
8. To convey information to users of the highway within the
limits of the Town;
9. To set out proper pedestrian crossing on any highway within
the limits of the town; and
10. To restrict or reserve specific parking spaces for the
sole use of disabled person;
12(a) No person shall stop, stand, or park a vehicle on a
highway so that the vehicle or any part of it is:
1. On the sidewalk or an area generally used by or
intended for use by pedestrians;
2. In a place in contravention of a traffic control
device or sign that gives notice that stopping,
standing, or parking is there prohibited or
restricted
3. Parked in such a manner as to interfere with, hinder
or obstruct the normal flow of traffic;
13. No person shall allow or cause a vehicle to stand, stop or
park upon a highway or bridge within the town limits in
such a position that it may:
1. Interfere with the pedestrian or vehicular traffic;
2. Constitute a hindrance to the maintenance repair or
improvement thereof;
3. Hinder or impede the carrying out of any undertaking
of the Council;
14. In the event of any person failing to do anything which
under these regulations he ought to have done, the Council
may do that act and recover the expenses thereof from the
person so in default as a civil debt, and without limiting
the generality of the foregoing, where a motor vehicle or
trailer is parked or left on a highway in contravention of
these regulations, the Council, through its employees,
servants, or agents, may cause the motor vehicle or
trailer to be removed from the street and impounded at a
suitable location and the owner thereof may reclaim the
vehicle upon payment of the towing and impounding expenses
as may be determined by Council
15(a) The Council may dispose of any vehicle removed and
stored under these regulations, if the vehicle is not
claimed by the owner in accordance with s.15(b) herein
within ninety (90) days of removal and storage
(b) Prior to the return of the vehicle to its owner the
owner shall pay the costs of its removal and storage as
determined by the Council and where such costs are not
paid by the owner, the Council may sell the vehicle by
public sale or public auction to satisfy such costs
including the costs of and incidental to the public sale
or auction.
16. Neither Council nor its authorized agents shall be
responsible for damages caused to any vehicle in the
enforcement of these regulations;
These Regulations shall come into effect on day of July,
2013.
