## TOWN OF WABUSH ## TRAFFIC REGULATIONS Pursuant to the powers vested in it by virtue of the Municipalities Act, Chapter M-24 S.N. 1999, Section 414(2)(oo), and all other powers it enabling, the Town Council of the 'Town of Wabush in regular session convened on the 18m day of August, 2015 hereby passes and enacts the following regulations for the control of traffic. The following regulations have been made the Town Council of the Town of Wabush undes the provisions of Section 188 and 189 of the Highway Traffic Act and under Section 181 of the Municipalities Act, 1999, as amended. Amended and adopted by the Town Council of the Town of Wahush on the 18 day of August, 2015. ## 1. Interpretations: In these regulations unless the context otherwise requires: - a) "Ambulance" means a Vehicle designed or used for carrying ill or injured persons for compensation; - b) "Bus" means a motor Vehicle designed or used for the transportation of passengers with a seating capacity of 10 or more in addition to the driver, but excluding those motor Vehicles when used for personal transportation by the owner or with the owner's permission; - c) "Commercial Motor Vehicle", means a Vehicle designed to carry goods, or to carry more than six passengers in addition to the driver, and includes a truck, delivery wagon, hearse, fire engine, traction engine, and any other motor Vehicle designed for commercial, agricultural, or industrial use, but does not include buses or camper type Vehicles designed or adapted exclusively for pleasure or recreational purposes; - d) "Council" means the Town Council of the Town of Wabush; - e) "Crosswalk", means part of roadway at an intersection or a designated point on a road which is marked by signs or lines at which some means are employed to assist pedestrians wishing to cross; - f) "Designated impaired mobility parking space" means a parking space designated by a sign bearing the international wheelchair logo set aside for motor Vehicles used by persons with mobility impairment; - g) "Designated impaired mobility parking permit" means a valid permit bearing the international wheelchair logo and issued to a person with mobility impairment in accordance with the Highway Traffic Act; - h) "International wheelchair logo" means the international symbol of access for the handicapped sign which is a white wheelchuit on a blue background with a white border as depicted in the Uniform Traffio Control Devices for Canada Manual published by the Transportation Association of Canada; - i) "Driver" means a person who drives or is in actual physical control of a Vehicle; - i) "Driver's License" means a license which has been issued under the Highway Traffic Act authorizing the person to whom it is issued to drive a motor Vehicle and which has not expired or been suspended or cancelled; - k) "Driveway" means a clearly define private roadway, drive, path or passage or a like opening or space which is wide enough, but not wider than is necessary, for the passage of a motor Vehicle, whereby the owner, occupier or user of the property has vehicular access from a roadway to a point within the property; - 1) "Emergency Vehicles" means a motor Vehicle driven by a Peace Officer or by a member of the police branch of any Her Majesty's Armed Forces where there is an urgent emergency justifying a rate of speed in excess of a maximum rate of speed provided for in this Act and includes a Vehicle so operated by a chief of a volunteer fire department, a motor Vehicle carrying firefighting equipment in responding to an alarm of fire or an ambulance responding to a call or transporting a patient; - m) "Highway" shall include any way to which the public has access, and bridges over which a highway passes, and shall also include every place to which the public has access as a parking place for motor Vehicles; - n) "Highway Traffic Aci" means an Act relating to the use and operation of Vehicles. Chapter H3, Statutes of Newfoundland and Labrador 1990 and Amendments; - o) "Insurer" means a person licensed under the Insurance Companies Act to carry on the business of automobile insurance in the province; - p) "Intersection" means the area enclosed within the prolongation or connection of the lateral curb lines or, if there are no curb lines, boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other; - q) "License" means a license which has been issued under the Highway Traffic Act and these Regulations which has not expired or been suspended or cancelled; - r) "Left" or "left hand" in reference to a highway or the position of traffic on the highway means the left when facing or moving in the direction of travel; - s) "Motor Vehicle" means a Vehicle propelled, driven or controlled otherwise than by muscular power, other than a trailer or a Vehicle running upon fixed rails; - t) "Municipality" means the Town of Wabush; 2. ) "Municipal Enforcement Officer" shall mean for the purposes of these regulations, a person appointed as a Municipal Enforcement Officer under Section 179(1) of the Municipalities Act, - v) "One-way roadway" means a roadway designated and marked by the minister, a traffic authority or a municipality as a roadway upon which Vehicles shall be operated in I direction only; - W) "Owner" means, 5. the person who hoks the legal tille to a Vehicle, - il. in the case of a Vehicle that is registered, the person in whose name it is registered, ili. in the case of a Vehicle that is the subject of a mortgage, die mortgagor if the mortgagor is entitled to possession of the Vehicle, iv. in the case of a Vehicle that is the subject of a hire-purchase agreement, the person in possession of the Vehicle under the agreement, or - v. in the case of a Vehicle that is the subject of a conditional sale contract, the buyer under the conditional sale contract if the buyer is entitled to possession of the Vehicle; - x) "Park" means to allow a motor Vehicle to remain on a highway in a stationary position whether or not the operator remains in control, provided that a Vehicle shall not be deemed to be so parked if it is stopped for the immediate taking up or discharging of passengers of for such time as may be actually necessary for the loading or unloading of goods or for repairing such Vehicle when repairs thereto on a highway are necessary; - y) "Peace Officer" includes a member of the Royal Newfoundland Constabulary, the Royal Canadian Mounted Police Force stationed in the province and a park warden appointed under the Public Service Employment Act (Canada); - z) "Pedestrian" means a person on foot, a handicapped person in a wheelchair or a child in a carriage or a sleigh; 5. (aa) "Permit" means a permit which has been issued under the Highway Traffic Act and these Regulations which has not expired or been suspended or cancelled; 6. bb) "Recreation Vehicle" means a camper, fifth wheel or trailer that is used for camping purposes; 7. cc) "Regulations" means Town of Wabush Traffic Regulations made under the authority of the Highway Traffic Act and amendments and the Municipalities Act, 1999 and amendments; - dd) "Registration" means the registration of a motor Vehicle or trailer under this Act; - ee) "Residential Zone" means any area designated as such under the Town of Wabush Municipal Plan Zoning 2004 - 2014; - ff) "Right" or "right handed" in reference to a highway or the position of traffic on highway means the right when facing or moving in the direction of traffic; - gg) "Right-of-way" means the privilege of the immediate use of the roadway; - hb) "Roadway" means the portion of a highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder unless the shoulder is paved, and where a highway includes 2 or more separate roadways the term "roadway" refers to any 1 roadway separately and not to all of the roadways collectively; - il) "School Bus" means a motor Vehicle designed or used to carry 7 or more passengers in addition to the driver, owned, operated by or contracted to a school board or an agent of a school board, and used to transport children to or from school or to and from places other than school for the purposc of school related activities; - jj) "Sidewalk" means that portion of a highway lying between the curb lines or the lateral lines of a roadway and the adjacent property lines set apart for the use of pedestrians and, includes a part of a highway set apart or marked as being for the exclusive use of pedestrians and is considered to include an area of a highway lying between the curb lines or the lateral lines of a roadway and that portion of a highway set apart for the use of pedestrians; - kk) "Stop" means when required, the complete cessation of movement, and when prohibited, any stopping or standing of a Vehicle whether occupied or not except when necessary to avoid conflict with other traffic or in compliance with the directions of a traffic officer or traffic-control device or signal; - II) "Taxi" means a motor Vehicle other than a bus used to transport passengers for gain or reward; - mm) "Town" means Town of Wabush as defined by Paragraph 2 of Order-In-Council, dated the 11"' day of April, A.D., 1967 and existing under the Municipalities Act, 1999. - nn) "Traffic" includes Vehicles, pedestrians and animals while using a highway for the purpose of travel; - 00) "Traffic Authority" means the Town Council of Wabush; - pp) "Traffic-Control Device" means a traffic sign, traffic-control signal, marking, symbol or device consistent with the Highway Traffic Act placed or erected by authority of the Council; for - the purpose of regulating, warning or guiding traffic and includes those contained in the Manual of Uniform Traffic Control Devices for Canada; - 49) "Traffic Control Signal" means a traffic control device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and to proceed; - "Traffic Officer" neans any person appointed by Council to enforce these Regulations, including a Municipal Enforcement Officer; - ss) "Traffic Sign" Includes all traffic control signals, warning sign-posts, direction posts, signs, lines, marks or ollier devices for the guidance of persons using highways; - [t) "Vehicle" means a device in, upon or by which a person or thing may be transported or drawn upon a highway, but does not include devices used exclusively upon fixed rails; and - 111) "Vehicle license" means a license that has been issued under the Highway Traffic Act in respect of a Vehicle and which has not expired or been suspended or cancelled. ## 2. Council Authority - (a) The Council may cause or permit traffic signs to be placed on or near any higliway within the limits of the Town of Wabush. - (b) Traffic signs erected or authorized under subsection (1) of the regulations may be signs for any of the following purposes 1. To regulate the movement of traffic. 2. To indicate the route to be followed by traffic. 3. To restrict or prohibit the use of any part of any highway other than a main highway designated as such by the Minister of Transportation within the limits of the Town of Wabush. 4. To indicate maximum speed limits in any area or on any part of any highway within the limits of the Town of Wabush, so that Vehicles driven in excess of such speed shall be taken to have failed to conform to the indication given by the sign. 5. To restrict or prohibit the parking of Vehicles in any area or on any part of any highway within the limits of the Town of Wabush. 6. To restrict or prohibit temporarily the use of any highway other than a main highway designated as such by the Minister of Transportation, or any part of any highway within the limits of the Town of Wabush, whenever owing to the likelihood of danger to the public or serious damage to the highway, it appears to the Council to be necessary; and to limit the loads of Vehicles owing to condition of any highway; if the Council deen a pees provided tha cheni shake to gly any case of emergency. 7. To war users of the highway of the need for special caution. 8. To convey information to users of the highway within the limits of the Town of Wabush. 3. y). To restrict or reserve specific parking spaces for the sole use of disabled persons. 4. (r) Any person who fails to comply with the direction or prohibitions given hy any traffic signs shall be guilty of an offence against these Regulations. 3. (a) No person shall drive a motor Vehicle that - i. Exceeds the posted speed limit by between 1 and 10 kilometers per hour; - ii. Exceeds the posted speed limit by between I1 and 20 kilometers per hour; - ili. Exceeds the posted speed limit by between 21 and 30 kilometers per hour; - iv. Exceeds the speed limit by 31 kilometers and over; - b) Where a person who has been convicted of an offence under 3(i), (ii), (iii), or (iv) is convicted within a period of 2 years of an offence under 3(i), (ii), (iii), or (iv), the new offence shall be considered as a 2n° or subsequent offence for the purpose of the imposition of a penalty. - c) A driver shall not drive a Vehicle at such a slow rate of speed as to impede or block the normal and reasonable movement of traffic than existing on a highway, except where it is necessary to do so for safe operation or to comply with this part. - i. A traffic officer may order a driver referred to in Subsection c to increase his or her rate of speed, pull into the curb to allow other Vehicles to pass or remove the Vehicle from the highway. - ii. A person who fails to comply with an order given under Suhsection (i) is guilty of an offence. 14. (a) No person shall park a motor Vehicle, either attended or unattended, in any area designated as a fire lane; 15. (b) No person shall park a commercial Vehicle or trailer with the carrying capacity of greater than ten thousand (10,000) kilograms, in any residential area within the boundaries of the Town. - 5(a) No person shall stop, stand or park a Vehicle on a highway so that the Vehicle or any part of it is: - On a sidewalk or an area generally used by or intended for use by pedestrians; - (c) Within an intersection; - In front of a public or private dilveway or in font of an authorized loading door designated as such; - (d) Within 1 meter from any fire bydrant; - (e) Within a crosswalk; - (f) Within 6 meters of the approach side of a crosswalk; - (g) Within 10 meters upon the approach to any flushing beacon, stop sign, or traffic control sign or signal located at any side of a roadway; - (i) Within 7 meters of a driveway entrance to a fire station or on the side of a street opposite the entrance to a fire station; - (h) Within a distance of 8 meters from a bus stop erected under these Regulations, except where otherwise provided by a sign erected under these Regulations; - (i) Within 15 meters of the nearest rail of a railway - (1) Parked on the left side of the street in the direction it is heading; - (k) Alongside or opposite a street excavation or obstruction, when such stopping, standing or parking obstructs traffic; - (m) Within 150 meters of any site where a fire is in progress unless permission has been obtained from a police constable, excepting a fire engine, ambulance, clergy car, police car, medical doctor's car or nurse's car; - (0) Upon any property classified as an easement, or upon any parks, play areas, open space, playgrounds or recreation grounds owned by the Town or within the boundaries of the Town of Wabush - (n) Parked in an area designated as a parking space for disabled persons only; - (b) Where a sign which has the words "NO PARKING" or a symbol for "NO PARKING" inscribed on it is erected on a highway and the part of the highway to which the sign is applicable is clearly indicated by painted red or white lines or words or markers on the highway or by additional words inscribed on the signs describing the area to which the prohibition of the sign is applicable by name or other description or by reference to another sign erected on or near the same highway, the driver of a Vehicle shall not park the Vehicle in the area to which the sign applies, or between the hours or during the time specified on the sign. - (c) Where a sign which has the words "NO PARKING EXCEPT UNDER PERMIT" or a symbol for "NO PARKING EXCEPT UNDER PERMIT" inscribed on it is erected on a highway and the part of the highway to which the sign is applicable is indicated by painted red or white lines or words or markers on the highway or by additional words or symbols inscribed on the sign describing the area to which the prohibition of the sign is applicable by name or other description or by reference to another sign erected on or near the same highway, a person other than - the person to whom the permit was issued shall not park a Vehicle in the area to which the sign applies. - (a) When a motor Vehicle is left unattended or apparently abandoned upon a highway vithin the Town for a continuous perlod in excess of three days, the Council may orally or in writing, give notice to the owner of the motor Vehicle, if known to de Council, « remove it within the period of time given in the notice. If the owner is unknown or cannot be contacted, then the motor Vehicle may be removed by Council; - (b) The owner of a motor Vehicle removed under sub section (a) of Regulations 6 (n) or 15 (b) shall pay Council all costs and expenses incurred in connection with the removal, and in addition pay a storage lee of $10 per day or part of a day during which the motor Vehicle remains in place to which it was removed. This fee will not exceed $5000. The motor Vehicle so removed shall not be delivered to the owner until all fees for its removal and storage have been paid to the Council. - (c) If the owner of' a motor Vehicle under sub-section (a) of Regulations 5, 6 (a) or 15 (b) does not, within three (3) months after the date of removal, pay the cost and expenses and the additional amount of storage, the Council may sell the motor Vehicle by public auction of which ten (10) days notice shall be given in a newspaper circulated in the area in which the motor Vehicle was found and the proceeds of the sale, if any, of and incidental to the auction and the amount of storage prescribed in sub-section (b) shall be returned to the owner, if known to the Council, and if not known shall be paid into the coffers of the Council; and - (d) No action or legal proceedings may be brought against any Municipal Enforcement Otticer, or an employee, servant, agent, or representative of the Council, or against the Mayor, and Councilors, or any person authorized by them under Regulation 5, 6 or 15 (a) in respect of anything done in good faith under these regulations where the action of proceedings is not based on malfeasance or misfeasance. 7. No person shall park any Vehicle used as a taxi on the highway for the purpose of Solicing business, except in a place or places designated by the Council for that 8. No person shall park any motor Vehicle on the highway at any time in such a way as to interfere with, hinder or obstruct the normal flow of traffic. 9. No public service Vehicle operating within the Town for hire or reward shall stop anywhere on any highway to solicit business except at designate stops and passengers may enter or leave such public service Vehicle at the aforementioned stops only. 10. (a) No person shall place, maintain or display upon or in the view of any highway any unauthorized sign, signal, marking or device which purposes to be or is an imitation of or resembles an official traffic control device or sign, or whichattempts to direct the movement of traffic or which hides from view or interferes with the effectiveness of any official tralfic control device or sign. - (b) No person shall, without lawful authority, attempt to or in fact alter, deface, injure, knock down or remove any official traffic control device or sign. - Il. The driver of a commercial motor Vehicle loading or unloading freight within the Town of Wabush shall, if possible, pull such motor Vehicle off the highway into some private parking space; where this is not possible, the driver shall, when loading or unloading freight, pull in as near as possible to the curb and load or unload as quickly as possible, hut in no case shall a driver place a commercial motor Vehicle in such a position as to hinder or obstruct the normal flow of traffic. 12. When a commercial motor Vehicle has to cross the sidewalk or highway to load or unload freight, the driver of such Vehicle shall, before crossing, stop and give fair warning to pedestrians whether by hand or sounding the hor that he or she is going to cross, and after such sign is given he or she shall proceed to cross such sidewalk slowly and with due care 13. No person shall sound the horn of a motor Vehicle except for the purpose of giving a warning of the Vehicle's approach and every driver of a motor Vehicle shall refrain from excessive or unnecessary sounding of horn. ## 14. Recreational Vehicle Parking 1. A Recreational Vehicle shall not be parked on a highway unless it is parked in a location completely adjoining the Recreational Vehicle owner's residence as shown on the License for the Recreational Vehicle. 2. A Recreational Vehicle parked pursuant to Regulation 14 (1); 3. (a) shall not be parked for more than 72 consecutive hours on a highway; and 4. (b) shall be removed to an off-highway location for at least 48 consecutive hours before it may be parked again on a highway. 3. A Recreational Vehicle parked on a highway shall not be occupied. 15. (a) During the period from October 15, each year to April 30, in the succeeding year, both days inclusive, no person shall park an unattended Vehicle on any street within the limits of the Town so as to interfere with or obstruct snow clearing operations. 7. (b) Any Vehicle parked in violation of paragraph (1) of this Regulation shall be removed by the C'ouncil at the owner's expense and risk. 8. (c) No person shall throw or shovel snow on any municipal street, parking lot, or area that is normally plowed by municipal snow clearing equipment so as to ohstruct or interfere with the normal flow of trailic. 9. (d) No person or snow removal contractor shall pile, push or plow snow or ice on or against or within 3 meters of any fire hydrant or other similar device used for fire protection which is located in any public or private way so as to conceal such hydrant or device or cover any outlet thereof. 16. Whenever a Traffic Officer, Municipal Enforcement Officer or a Peace ()fficer engaged in control of traffic gives direction as to parking and movement of traffic, the directions shall be followed irrespective of any traffic sign or signal or any parking signs that may be so placed in that area. 17. (a) Where traffic control signals are not in place or in operation when a pedestrian is crossing the roadway within a crosswalk, a driver shall yield the right of way to the pedestrian; 12. (b) A pedestrian shall not leave the curb or other place of safety and walk or run into the path of a Motor Vehicle that is close that it is impracticable for the driver of the Motor Vehicle to yield; and 13. (c) Where a Motor Vehicle is stopped at a crosswalk to permit pedestrians to cross the roadway, the driver of a Motor Vehicle approaching from the rear shall not over take and pass the stopped Motor Vehicle; and 14. (d) Whenever a Traffic Officer, a Municipal Enforcement Officer or a Peace Officer engaged in control of traffic at a crosswalk to ensure the safe passage of pedestrians and a stop signal is displayed or a signal to stop is given by such an officer, drivers of all Motor Vehicles traveling in either direction upon the highway shall bring their Motor Vehicle to a complete stop and shall not proceed through the crosswalk until the pedestrians and officer concerned have reached the safety of the curb roadside or sidewalk. 18. Except where a Traffic Officer, a Municipal Enforcement Officer or a Peace Officer directs otherwise, where there is a yield sign at an intersection, the driver of a Motor Vehicle approaching the sign shall slow down at a reasonable speed, or if necessary for the safety, stop at a clearly marked line or, if none, then immediately before entering the crosswalk on the near side of the intersection and shall yield right of way to pedestrians crossing the roadway on which he/she is driving and to traffic approaching or in the intersecting highway, and having yielded, may proceed with caution. 19. (a) A driver shall not drive a Vehicle to or upon the left side of the centre line of a roadway in overtaking and passing another Vehicle unless the left side is clearly visible and is free l oncoung and overtaking traffic for a sufficient distance to permit overtaking an ussing lo be completely made without interfering with the safe operation of anothe Vehicle. 2. (b) The driver of a Motor Vehicle shall not overtake and pass other traffic when approaching the crest of a grade or upon a level railway crossing, curve or where highways intersect or fork, or in any other circumstances where the driver cannot see sufficiently far ahead to overtake and pass with safety. 3. (c) The driver of a Vehicle shall not overtake and pass other traffic in circumstances where the driver cannot see sufficiently far ahead to overtake and pass with safety. 20. Except where a Traffic Officer, a Municipal Enforcement Officer or a Peace Officer directs otherwise, drivers and pedestrians shall obey the instructions of a traffic control signal or device in accordance with these regulations. 21. When a red light alone or "stop" is shown at an intersection by a traffic control signal; 6. (a) The driver of u Vehicle approaching the intersection and facing the light or signal shall stop the Vehicle at a clearly marked stop line, or, if none, then immediately before entering the crosswalk on the near side of the intersection or, if there is no crosswalk, then immediately to paragraph (b), shall not proceed until a trafficcontrol signal permitting the movement of the Vehicle in the intersection is shown, 7. (b) The driver of a Vehicle approaching the intersection and facing the light or signal and intending to turn right at the intersection may, unless a traffic-control device prohibits a right turn to be made on a red light or "stop" signal, with caution, proceed and turn right at the intersection, but only after stopping in accordance with paragraph (a) and after yielding the right-of-way to any Vehicle or pedestrian proceeding in the intersection. 22. When a sign has the word "stop" inscribed thereon is erected at or near the intersection of two highways and facing the stream of traffic on one highway the driver of a Vehicle on the highway shall stop his/her Vehicle before entering but as neas as practicable to the driving surface of the other highway and shall then proceed with special care and give way to traffic on the other highway, but if there is a crosswalk at or in the vicinity of the sign the driver of the Vehicle shall stop the Vehicle before entering the crosswalk and may then proceed with caution, giving way to pedestrian in the crosswalk. 23. Upon the immediate approach of an emergency Vehicle giving an audible signal by a bell, siren or exhaust whistle and showing a visible flashing red light, except when otherwise directed by a Traffic Officer, a Municipal Enforcement Officer or a Peace Officer the driver - (a) Yield the right-of way; - (b) Drive immediately to a position parallel to and as close as practical to the right hand curb or edge of the roadway, clear of an intersection; - (d) Stop and remain in that position until the emergency Vehicle has passed. - (c) At night turn off the headlights and turn on the parking lights; and 24. Regulations 15 (a) and 6 (a) do not apply to ambulance or firefighting apparatus or to motor Vehicles operated by medical doctors, nurses, clergy, police or members of the fire brigade when at the scene of an emergency. 25. (1) The driver of a Vehicle upon meeting or overtaking from either direction a school bus hace as sere pad on apart of thigh fore badise of reproving or is arging sobbe dace where parking areas are provided for the children, or on which the visual signals signifying that the bus is about to stop have been activated by the driver, - (a) where there is in operation on the school bus a visual signal as specified in the regulations shall stop the Vehicle before reaching the bus; and - (b) shall not proceed until the school bus resumes motion or he or she i signalled by the driver of the school bus to proceed or the visual signal is no longer activated. - (2) The driver of a school bus: - (a) shall stop the Vehicle in the roadway of the highway except where a loading zone has been provided at a school or other place where parking areas are provided for the purpose of receiving or discharging school children; and - (b) shall not unnecessarily delay the passing of other Vehicles on the highway. - (3) Every school bus shall bear upon the front and rear of the bus plainly visible signs containing the words "SCHOOL BUS" in letters not less than 20 centimetres in height. - (4) Every school bus shall be equipped with visual signals as specified in the regulations which shall be activated by the driver of the school bus - (a) 30 metres in advance of coming to a stop on the highway; and - (b) when the school bus is stopped on the highway, for the purpose of receiving or discharging school children. - (5) A person shall not operate a school bus upon a highway for a purpose other than the transportation of children to or from school or school-related activities unless all marks indicating that it is a school bus are concealed. - (6) The driver of a Vehicle upon a highway with separate roadways need not stop upon meeting or overtaking a school bus that is on a different roadway. - (1) The driver of a Vehicle upon a controlled-access highway need not stop upon meeting or overtaking a school bus that is stopped in a loading zone that is a part of or adjacent to that highway and where pedestrians are not permitted to cross the roadway. 26. (a) The holder of a driver's license shall produce a license when Traffic Officer, a Municipal Enforcement Officer us a Peace Officer requests him/her to do so for the purpose of enforcing the regulations. 3. (b) The production of a driver's license within forty-eight (48) hours ufter a request is mude under Sub Section (a) is deemed to be sufficient production of the license for the purpose of that Sub-Section. 27. If a driver refuses to give his/her name and address or gives a false name or address to any person having reasonable grounds for requiring the same or if any other driver refuses to give his/her name or address to a Traffic Officer, Peace Officer or Municipal Enforcement Officer who asks for his/her name or address is guilty of an offence agaiust these regulations. 28. No person shall operate, within the boundaries of the Town, any Vehicle having any object or thing projecting or extending there from in a lateral direction for a distance of more than 300 millimeters; neither shall any Vehicle have any object or thing protruding rearwards for a distance of more than 2 meters without the displaying of a red flag at the extreme rear of the object or thing. 29. A person shall not drive a Motor Vehicle on a highway when the windshield, side wings, side or rear windows are so covered, either completely or partially, by snow, ice, mist, dirt or other matter that in the opinion of a Traffic Officer, Municipal Enforcement Officer or a Peace Officer could impede, obscure or obstruct the vision of the driver. 30. No person shall squeal the tires or brakes of a Motor Vehicle by reason of unnecessarily rapid braking, turning or setting in motion of such Motor Vehicle 31. A person shall not throw or deposit, or cause to be thrown, deposited or left on a highway, glass, nails, tacks, scraps of metal or other material which may injure tires of Vehicles, rubbish, refuse or waste. 32. A driver's license is not valid to authorize the holder thereof to drive other than the class of Vehicles specified in the license. 33. Where a Traffic Officer, Municipal Enforcement Officer or a Peace Officer reasonably considers it necessary 11. (b) To prevent injury or damage to persons or property; 12. (a) To ensure orderly movement of traffic; 13. (c) To permit proper action in an emergency: 14. (d) To stop any Motor Vehicle to ensure regulations are complied with, he/she may direct traffic according to his discretion, notwithstanding anything in this part, and every person will obey his/her directions. 34. No person shall do, or permit to be done, anything which damages any improvements upon under No person shall place or permit to be placed, any snow, ice, dirt, debris or other material removed trom private property onto a highway or other public place unless a permit is first obtained authorizing a temporary obstruction for a specified time period. The Town may remove, ur cause to he removed, any such materials and the cost of such temoval shall be charged to the owner of such private property of the person responsible. 35. No person shall drive upon i highway a Vehicle containing waste material unless such load is completely covered by a tarpaulin, or other covering device, secured in such a manner that no portion of the load can escape, blow, drop, spill or fall onto a highway or land adjacent thereto. 36. Where a driver of a Vehicle is approaching a railway crossing at a time when 4. (a) a clearly visible electrical or mechanical signal device gives warning of the approach of a railway train; 5. (b) a crossing gate is lowered or a person holding a flag is giving a signal of the approach or passage of a railway train; or 6. (c) a railway train in dangerous proximity to a crossing is approaching the crossing and emits an audible signal or is visible, the driver shall stop the Vehicle not less than 5 metres from the nearest rail of the railway and shall not proceed until it is safe to do so. - (2) A driver shall not drive a Vehicle through, around or under a crossing gate or barrier at a rallway crossing while the gale or barrier is closed or is being opened or closed. 37. Where a stop sign has been erected at a railway crossing, the driver of a Vehicle shall stop the Vehicle not less than 5 metres from the nearest rail of the railway and shall not proceed until il is safe to do so, driver of a Vehicle is approaching a railway crossing at a time when 38. (1) A driver of 4. (a) a Vehicle carrying passengers for compensation; 5. (b) a school bus carrying a child; or 6. (c) a Vehicle carrying explosive substances or inflammable liquids as cargo before crossing a track of a railway, shall stop the Vehicle not less than 5 metres from the nearest rail and, remaining stopped, shall listen and look in both directions along the track for an approaching train and for signals indicating the approach of a train and shall not proceed until it is safe to do so. - (2) Where a driver has stopped and is proceeding in accordance with subsection (I), the driver shall cross the railway track in a gear that will not need to be changed while crossing the track and the driver shall not shift gears while crossing. - (3) Subsection (1) does not apply where a Traffic Officer, Municipal Enforcement Officer or a Peace Officer or traffic-control device directs traffic to proceed. - (4) Subsections (1) and (2) do not apply to industrial sput railway crossings within an urban district. ## 39. One-Way Roadway - (a) Where designated by a one way sign, no Vehicle shall enter the opposite end and will only travel the direction it is instructed to do so. - (b) Subject to subsection 41 (a) a Traffic Officer, Municipal Enforcement Officer or a Peace Officer may enforce these regulations. 40. Any person who violates any of the provision of these regulations shall be guilty of an offence and shall be liable on summary conviction to the associated penalty set out in Schedule I of these Regulations and where no penalty for an offence is set out in these Regulations the penalty provided for an instance under the Provincial Offences Act. 41. These regulations shall come into effect on the 18th day of August A.D., 2015, and may be cited as the Town of Wabush Traffic Regulations, 2015.
