## TOWN OF ANTIGONISH
## Ice and Snow Removal Bylawy
1. This bylaw shall be known as and may be cited as the "Ice and Snow Removal Bylaw".
## 2. Definitions
In this bylaw
- 2.1 "Core" includes any building, place, dwelling, room or rooms, apartment, hotel motel, restaurant, shop, store, office, parking lot, and the lands connected therewith and also lands under separate occupation and control that are adjacent or abut sidewalks as designated in Appendix A.
- 22 " Inaccesible Areas" includes those sidewalks areas designated in Appendix "A" that are considered too narrow in width or obstructed by features such as residentialy parked vehicles, embankments, traffic signage, trees and/or power poles to permit snow and ice control by Public Works snow removal equipment.
- 23 "Council" means the Council of the Town of Antigonish.
- 2.4 "Occupant" includes owner, agent of owner, tenant, householder, proprietor and person in possession and shall be held equally responsible to comply with this by-
- 2.5 "Premises" includes any building, place, dwelling, room or rooms, apartment, hotel, motel, restaurant, shop, store, office, parking lot, and vacant lands.
- 2.6 "Sidewalk" includes sidewalks constructed of either concrete or asphaltic concrete, within street right of ways and accepted as Town responsibility for related work activity.
- 2.7 "Snow" means snow, ice and water.
- 2.8 "Town" means the Town of Antigonish, or any person, firm or corporation acting on its behalf.
## Removal
- 3.1 Occupants of premises in the Core areas shall remove any snow, water or other debris from the sidewalk. Occupants of commercial properties shall remove any snow or other debris from the roof of said premises which might fall onto the sidewalk or street. Occupants shall not allow any water to flow or otherwis accumulate on the sidewalk by means of a water spout or any other part of an
- 3.2 Occupants of premises in the Core areas shall at all times keep the section(s) of sidewalk clear of snow and/or other debris across their respective property lines, and shall within four (4) hours of the cessation of every fall of snow remove and clear away snow and/or other debris, which adjoins or abuts the premises. When snow ceases falling during the night, the occupant shall have cleared and removed the snow and/or other debris, within four (4) hours after daylight.
## 4. Damage to Sidewalks
- 4.1 No person shall by chopping, scraping or in any other manner damage, deface or destroy any portion of a sidewalk.
## 5. Piling of Snow
5.1
Vo person shall pile, or in any other manner, place snow or other debris on an
normal snow removal operations, may pile or place snow or other debris on any

- 5.3 (a) The Town may at any time by written notice order and require the occupant of remises to remove and clear away therefrom snow, water or other debris a instructed by the Town, and every such occupant who fails or neglects to clean up and remove such snow and/or other debris within twenty-four (24) hours of the service upon himself of such notice shall be guilty of an offence against this bylaw
- (b) In the event of non-compliance with Section 5.3 (a), the Town Engineer or assigned designate may direct to have the snow and/or ice cleared and may take any necessary measures to abate potentailly dangerous conditions.
- (c) Any costs incurred under Section 5.3 (b) may be recovered by the Town and sai costs shall attach as a lien on the affected property.
- When costs are to be recovered under section 5.3 © interest shall also be assessed and charged on the outstanding principal until said amount is paid in full. The interest shall mirror the annual interest rate calculation for outstanding property
## 6. Penalty
- Every person or company who violates or fails to comply with any provision of this by-law shall be liable upon summary conviction to the penalty prescribed by the Summary Proceedings Act. The out of court settlement shall amount to $78.75 for failing to clear away snow from sidewalks or gutters adjoining premises and $165.00 for obstructing a street or sidewalk.
## 7. Service by Town
- 7.1 The Town reserves the right to not provide snow and debris removal services to any section of sidewalk if it is deemed unsafe under the safety policy of the Town or other relevant regulatory body, or is otherwise impractical to provide such service.
All By-Laws dealing with ice and snow removal heretofore passed by the Council, and all amendments to are hereby repealed.

## Appendix 'A'
## 1.Sidewalks defined as "Core" in the By-Law and designated as the following areas:
Main Street (both sides between the cross walks @ Hawthorne St. and Court St.) College Street (west side from the bridge @ civic # 43 to Main Street) College Street (east side @ civic #26 to Main St.) College Street (east side between Main St. and Pleasant St.) Church Street (west sides from Main Street to driveway entrance @ civic # 42)) Sydney Street (both sides) Court Street (east side from Main St. to civic # 81 along Court St.)
## 2. Sidewalks defined as "Inaccessible Areas" in the ByLaw and designated as the following areas;
St. Ninain's Street (southern side from Bishop's Road to Hillcrest St.) Acadia Street (eastern side) Hillcrest Street (eastern side) East Main Street Bridge (both sides)
3. Above designated areas are identifed on the attached map indicating " Town of Antigonish - Plan Identifying Areas Not Receiving Ice & Snow removal from Sidewalks."
