BE IT RESOLVED THAT the policy of the Town of Bridgewater with respect to the provision
of sanitary sewer services outside the Town boundaries shall be as follows:
1.
The provision of sanitary sewer services outside the Town boundaries shall not be
permitted save for the exceptions/circumstances outlined in this policy.
2.
The provision of sanitary sewer services to properties outside the Town boundaries
for which connections already exist shall continue. The properties are those outlined
in Schedule "A" of this policy.
3.
The provision of sanitary sewer services to properties, which straddle the Town
boundaries, shall be dealt with on a case-by-case basis. If the Town decides to
provide sanitary sewer services to a given property same shall be provided by way
of an Agreement, as outlined in Schedule "B", which shall include permission for the
connection, a rate for payment of the service and terms for the coverage of costs
related to the connection of the property to the sanitary sewer system.
4.
In the event a property located within the Town boundaries receiving sanitary sewer
services is consolidated to property outside the Town boundaries, the Town will
consider whether or not to provide sanitary sewer services to the new property on
a case by case basis under an Agreement, as outlined in Schedule "B", which shall
include permission for the connection, a rate for payment of the service and terms
for the coverage of costs related to the connection of the property to the sanitary
sewer system.

(hereinafter called the "Owner")

TOWN OF BRIDGEWATER, a municipal body corporate under the
provisions of the Municipal Government Act, S.N.S. 1998, c.18, as
amended
(hereinafter called the "Town")
WHEREAS the Owner has requested the Town to provide a sanitary sewer connection to
property known as

AND WHEREAS by motion
, Town Council approved the connection of the
above property to the Town's sewer system upon the terms hereafter set out;
WITNESSTH that the Owner and the Town, in consideration of the covenants and provisos
herein contained and the sum of $1.00, the payment of which is hereby acknowledged,
undertake and agree as follows:
1.
The Town undertakes and agrees to permit a permanent sanitary sewer connection
from
the
Owner's
property
to
the
Town's
sewer
services
on
.
2.
The Owner undertakes and agrees to pay to the Town an annual sewer charge in
an amount representing the applicable sewer rate and wastewater betterment
charge, as established by Town Council at the date of the agreement.
3.
The Owner undertakes and agrees to pay to the Town the sum of
$
, representing the cost incurred by the Town to extend the
sanitary sewer lateral and water lateral to the street line to service the Owner's
property, said sum to be paid within 30 days after the Town renders a bill for said
work. Interest will be charged at a rate of 12% per annum on any amount not paid
within 30 days of the completion of the work.
4.
This Agreement shall bind the parties, their heirs, executors, administrators,
successors, and assigns.
5.
The laws of Nova Scotia shall apply.
