Town of Bridgewater Chapter 193 PARKING METER BY-LAW Be it enacted by the Council of the Town of Bridgewater, pursuant to Section 153 of the Motor Vehicle Act, as follows: 1. (1) This By-law shall be known as the "Parking Meter By-law". (2) It shall apply to the public streets and highways, and Town owned or operated parking lots in the Town of Bridgewater and parts thereof in which a metered zone has been established by resolution of Council. DEFINITIONS 2. (1) "metered space" means, in the case of a parking meter stand with a single or double parking meter head, that portion of land with painted markings delineating the boundaries of a parking space. In the case of a pay and display parking station, notwithstanding any marking on the street or parking lot delineating the boundaries of a parking space, any space on a street or parking lot where parking is lawful and the sign that regulates parking in such space indicates that the parking fee may be paid at a pay and display parking station; (2) "metered zone" means any parking lot, street, or portion of a street allotted by resolution of Council for purposes of parking vehicles in respect of which a parking meter system or a pay and display parking station system may be established and maintained to collect a fee for the use or occupation of a metered space established in such a zone; (3) "parking meter" means a parking meter stand and the single or double parking meter head that it supports; (4) "parking meter head" means a mechanical or electronic appliance designed for the purpose of gauging and indicating a time within which a vehicle is, or may be, parked in a metered space; (5) "parking meter stand" means that pole or stand supporting a single or double parking meter head; (6) "pay and display parking station" means a multi-meter device operated and maintained by or on behalf of the Town for collecting parking fees for and controlling the use of parking spaces within a metered zone; (7) "Traffic Authority" means the Traffic Authority for the Town of Bridgewater or their designate; (8) "Town" means the Town of Bridgewater; (9) "town-approved mobile payment application" means a mobile payment application approved by the Traffic Authority for making a payment required for the use of a parking space for a pre- determined period of time for the vehicle occupying such a space as identified by the vehicle's license plate; (10) "town mobile enforcement system" means the Town's mobile system for determining whether the payment required for the use of a parking space has been made based on the license plate of the parked vehicle and for determining whether a vehicle is parked in a metered space for a period longer than that for which payment has been made. PLACING PARKING METERS AND PAY STATIONS 3. Each parking meter and pay and display parking station installed in the Town shall designate the parking space or spaces associated with it. OPERATION OF A METERED SPACE 4. (1) In this By-law, where payment is required for the use of parking space, such payment shall only be made as follows: (a) in the case of an individual parking meter by: (i) depositing coin or coins into the parking meter controlling such parking space; or (ii) making a payment through a Town-approved mobile payment application for the vehicle occupying such space as identified by the vehicle's license plate; (b) in the case of a pay and display parking station by: (i) depositing money or inserting a payment card into the pay and display parking station controlling such space and immediately placing the paper receipt dispensed by the pay and display parking station face up on the interior of the front windshield of the vehicle so as to be clearly visible; or (ii) making a payment through a Town-approved mobile payment application for the vehicle occupying such a space as identified by the vehicle's license plate. (2) Where a vehicle by reason of its size necessarily occupies more than one parking space or portion thereof, payment must be made for each parking space or part thereof occupied. (3) The Traffic Authority is authorized to designate mobile payment applications as Town- approved mobile payment applications under this By-law. WHEN IN EFFECT 5. (1) Each parking meter shall bear thereon: (a) information indicating the days and hours when the requirement to deposit coins therein shall apply, the value of the coins to be deposited, and the limited period of time for which parking is lawfully permitted in the parking space to which such meter relates; and (b) information to direct persons to the instructions to pay by a Town-approved mobile payment application. (2) Each pay and display parking station shall bear thereon: (a) directions indicating the days and hours when the requirement to make payment for the use of a metered space, the parking rate required and the limited period of time for which parking is lawfully permitted for parking in the metered space within the metered zone to which the pay station applies; and (b) information to direct persons to the instructions to pay by cash, credit, debit, and a Town- approved mobile payment application. AUTHORIZED COINAGE 6. (1) No person shall deposit, cause to be deposited or attempt to deposit in any parking meter any coin or coins other than those of the Government of Canada or the United States of America. (2) No person shall deposit, cause to be deposited or attempt to deposit therein any slug, device, token, substance, object or any bent, punched, damaged or mutilated coin. LAWFUL USE OF SPACE 7. (1) Upon placing the parking meter into operation, the parking space designated to the parking meter may be lawfully occupied by such vehicle for the period of parking time equivalent to the coins deposited or for the time period equivalent to the payment made through a Town- approved mobile payment application. (2) In the case of metered zones in which parking is timed by pay and display parking stations, upon the display of the paper dispensed by such meter, in a vehicle and in accordance with the requirements of this By-law, one parking space in the metered zone for which said meter is applicable may be lawfully occupied by such vehicle for the time period equivalent to the payment deposited, or for the time period equivalent to the payment made through a Town- approved mobile payment application. EXTENSION OF PARKING TIME 8. (1) No person shall deposit or cause to be deposited in any parking meter or pay and display parking station any money for the purpose of obtaining an extension of parking time beyond the maximum period as indicated on the parking meter or pay and display parking station. PARKING TIME EXPIRED 9. (1) No person shall park a vehicle in any metered space or part thereof for a period longer than that for which payment has been made. (2) For the purpose of subsection (1) a vehicle is deemed to have been parked for a period longer than that for which payment has been made: a) in the case where a vehicle is parked in a metered space: (i) if the parking meter indicates no time remaining; or (ii) if payment for a pre-determined period of time has been made through a Town- approved mobile payment application for the vehicle occupying such space as identified by the vehicle's license plate and the town mobile enforcement system indicates no time remaining or unpaid. b) in the case where the metered space is timed by a pay and display parking station: (i) if the paper receipt dispensed by the pay and display parking station is not displayed face up on the dashboard of the driver's side of the vehicle so as to be clearly visible; (ii) if the paper receipt dispensed by the pay and display parking station indicates a time or date that has expired; or (iii) if payment for a pre-determined period of time has been made through a Town- approved mobile payment application for the vehicle occupying such space as identified by the vehicle's license plate and the town mobile enforcement system indicates no time remaining or unpaid. CONTINUATION OF OFFENCE 10. A person commits a separate offence for each additional period of one hour that an offence pursuant to sections 8 and 9 of this By-law continues. LIABILITY OF VEHICLE OWNER 11. (a) The registered owner of a motor vehicle shall be liable for any offence pursuant to this By- law. (b) The registered owner of a motor vehicle shall not be liable for any offence or fine levied pursuant to this By-law if the owner can establish that, at the time of the alleged offence, the motor vehicle in question was in the possession of a person who did not have the permission or consent of the owner, expressed, or implied to be in possession of said motor vehicle. AUTHORITY TO BE IN CHARGE OF PARKING METERS 12. The operation, maintenance, regulation, and use of all parking meters and pay and display parking stations installed in the Town of Bridgewater on Town-owned or leased land, including the setting of parking rates, shall be under the management, supervision, and direction of the Traffic Authority for the Town of Bridgewater. ENFORCEMENT 13. It shall be the duty of any police officer of the Town of Bridgewater, or Special Constable appointed for the purpose, to inspect and examine all parking meters installed, and all parking spaces in the Town of Bridgewater, and to report all violations of this By-law. PENALTY 14. (a) Any person who violates any section of this By-law , and is given notice of the alleged violation, is liable upon summary conviction and may pay a penalty in the amount of fifteen dollars ($15.00) to the Town of Bridgewater provided that said payment is made within a period of seven (7) days following the day on which the alleged violation was committed, and twenty- five dollars ($25.00) if not paid within seven (7) days following the day on which the alleged violation was committed. Such payment shall be in full satisfaction, releasing and discharging all penalties and imprisonments incurred by the person for the violation. EXEMPTIONS 15. This By-law provides that no parking ticket shall be issued to or any other fine levied against the registered owner of a vehicle lawfully displaying a veteran's number plate issued pursuant to the "Veterans Number Plates Regulations" of Nova Scotia. 16. This By-law provides that no parking ticket shall be issued to or any fine levied against the registered owner of a vehicle operating as a Vending Vehicle provided: (i) the person holds a valid Vending License issued by the Town; (ii) the Vending Vehicle is parked in a space that has been designated by the License. 17. This By-law does not apply to stopping, parking or leaving vehicles in respect of which identification permits have been issued pursuant to Section 152(4) of the Motor Vehicle Act. 18. All Regulations heretofore made by the Traffic Authority of the Town of Bridgewater respecting parking meters are hereby wholly repealed on and not before the date when this By-law came into force pursuant to Section 153(2) (a) of the Motor Vehicle Act.
