No. D-400 DOGBY-LAW ofthe CapeBretonRegionalMunicipality Thisbylawismadepursuant totheNova Scotia Municipal Government Act. 1Definitions InthisBy-lawthefollowing definitions shallapply: Atlarge" meansofftheproperty occupied, orowned, bytheownerofthedogand: 1. notinthephysical restraint ofaleashnomorethan6feetinlength controlled bytheowner orthepersonincharge; or 2. whilewithin100 yardsoftheshoreline ofabodyofwater accessed bythegeneral public for purposes ofrecreation orswimming fromMay1uptoandincluding October 31, andinthe presence oftheownerorsomepersonincharge thereof, thedogisnotundertheeffective physical restraint ofaleashnomore than6feetinlength controlled bytheowner orthe personincharge; or 3. while onorwithin anytrail, park, sports field, street, sidewalk, parking areaorother recreational spacewithin theMunicipality intheCape Breton Regional Municipality andin thepresence oftheowner orsomepersonincharge thereof, thedogisnotundertheeffective physical restraint ofaleashnomorethan6feetinlength controlled bytheownerorthe personincharge. Forthepurposes ofclarification, adogshallbeconsidered atlargeif, whiletiedorchained toa structure orobjectonthedogowner'sproperty, ittrespasses ontoanyadjacent property sharing Attack Dog means anydogtrainedtorespond inafierceordangerous waytothecommands ofitsownerortrainer. Certified Show Dog meansadogeligible forregistration withtheCanadian Kennel Club C.K.C.) thathascompeted inmorethanoneofficial C.K.C. event, without disqualification, withinthepast12months. Citizen Service Centres meanthepayment centres undertheClerk'sDepartment oftheCape Breton Regional Municipality. Council means theCounciloftheCapeBreton Regional Municipality. CBRM DogBy-Law 2 Controlled meanstorestrain ordirectly influence thecontrol ofadogwiththeuseofaleash whileofftheowner'sproperty. Dog includes anydogofanyage, male, femaleorneutered, oranyanimal thatistheresultof thebreeding ofadogandanyotheranimal. DogControl Officer isanyofficial delegated bytheCouncil oftheCapeBreton Regional Municipality underSection 121oftheCapeBreton Regional Municipality Acttoadminister and enforce thisBy-law. Enclosure meansabuilding, house, oranenclosed penofsufficient strength toprevent adog fromcoming incontact withpersons otherthantheowner ofthedog. FierceorDangerous means anyindividual dog: whichinflicts bitesorattacks ahuman beingordomestic animal; or withademonstrated propensity, tendency ordisposition toattack, tocause injurytoor otherwise endanger thesafetyofhuman beingsordomestic animals; or whichwheneitherunmuzzled, unleashed, orunattended byitsowner, orapersoninwhose carethedogwasplacedbyitsowner, inavicious orterrorizing manner, approaches any personinanapparent attitude ofattackuponstreets, sidewalks, anypublicgrounds, orplaces oronprivate property; or owned, harboured ortrained primarily orinpartforthepurposes offighting; unless thecircumstances described inthePartofthisBy-lawtitled "Provoked Attacks" aremet. Guide Dog means anydogformally trained inaschool recognized bytheCanadian National Institute fortheBlind toguideablindperson. C.N.I.B.) Judge means thejudgeoftheProvincial CourtoftheProvince ofNovaScotia. Justice ofthePeace" meansajudicial officer whocanperform anumber ofspecified judicial dutieswithintheProvince ofNovaScotia. Breeding Kennel" means anybuilding, structure, compound, groupofpensorcagesor property inwhich or where morethantwo (2) dogsarekeptorraisedforthepurpose of breeding andselling anydogordogssokeptandraised. Thebreeding kennel doesnot necessarily havetoberegistered withtheCanadian Kennel Club; however, isrequired togeta kennel licence fromtheMunicipality. Boarding Kennel" means anybuilding, structure, compound, groupofpensorcagesor property inwhich orwhereadogordogsarekeptfromtimetotime. Theboarding kennel does notnecessarily havetoberegistered withtheCanadian Kennel Club; however, isrequired toget akennellicence fromtheMunicipality." General Kennel" meansalocation where adogownerkeepsmore thantwodogsthatare registered totheowner butarenotusedforbreeding orselling purposes." CBRM DogBy-Law 3 Municipality means theCapeBreton Regional Municipality. Muzzled meansacovering deviceofsufficient overthemouthofadogtopreventitfrom biting. Owner means anyperson whoowns, possesses orharbours adogordogs, andshallincludea registered owner underthisBy-law. Wherethepersonisaminor, owner includes aperson with custody oftheminor. Tranquilize" means injection ofanon-lethalamount ofdrugsapproved bytheNovaScotia Veterinary Association intothebodyofadogthatimmobilizes thedogenough toenableaDog Control Officertoseizeandimpound it." 2Registration a. OnorbeforethefirstdayofJanuaryin eachcalendar yeartheownerofanydogshallregister thedogwiththeDogControl Officer oranyoftheCitizen Service Centres oftheCape Breton Regional Municipality. b. Registration shallinclude thename anddescription ofthedogandname, address and telephone number oftheowner andmayinclude anyotherformsofidentification, whichthe owner mayrequest. Theregistered ownerofadogwillbe19yearsofageorolder. c. Theowneroftheregistered dogshallreceive atagwiththeregistration number andtheyear forwhichitwasissuedstamped thereon whichshallbewornbythedogatalltimesexcept whenthedogisbeinglawfully usedforhunting purposes orparticipating incertified dog shows. d. Theownerofanydogshallpayalicence feetotheMunicipality foreachdogintheamount setinthisBy-Lawandasamended fromtimetotimebyCommittee ofCouncil. e. Nolicence feeischargeable withrespect toastraydogthatisharboured forlessthansix () 6 weeks. f. Nolicence feeischargeable withrespect toadogthatistrainedtoassistandassistsaperson withadisability. g. Iftheowner declares thatthetaghasbeenlost, theDogControl Officer ortheCitizen Service Centres oftheCapeBreton Regional Municipality mayreplace thetaguponpayment bytheownerofafeetotheMunicipality intheamount setbytheCouncil inarecorded resolution. h. Onorbefore thefirstdayofJanuary ineachcalendar yeareveryowner ofakennel shallpay alicence feetotheMunicipality intheamount setbytheCouncil inarecorded resolution. CBRM DogBy-Law 4 Nolicence feeforakennel inalocation forwhich suchalicence hasnotbeenissued shallbe accepted byaDogControl Officer ortheCitizen Service Centres oftheMunicipality unless: theapplicant provides adevelopment permit fromtheDevelopment Officer ofthe Municipality verifying theoperation ofakennelis/willbeincompliance withthe zoning provisions oftheLandUseBy-lawineffect; or theapplicant provides anaffidavit stating thattheirkennelisnotakennel asdefined intheLandUseBy-lawineffectfortheirproperty onwhichthekennelislocated. Upon issuance ofsuchalicence, ifitisforacommercial kennel asdefined intheLand UseBy-lawineffectwhich requires adevelopment permit fromtheDevelopment Officer oftheMunicipality, theDogControl Officer ortheCitizen Service Centre employee shall notifytheregional officeoftheAssessment Division oftheDepartment ofMunicipal Affairs thataprofessional dogkennel business is/willbeinoperation atthesiteidentified bytheapplicant. KennelGuidelines" 3. " a. Nopersonshallownoroperate akennel within theMunicipality without having registered thekennelwiththeMunicipality andobtained akennel licence. b. Noperson shallkeepormaintain akennel without having complied withthezoning regulations undertheLandUseBy-Lawforthatzone. c. Priortotheissuance ofakennel licence, theDogControl Officer shallsatisfy himself orherself byinspection thatthekennelissoconstructed andisbeingsooperated that, inhisorheropinion, itadequately provides forthehealth, hygiene andcomfort ofthe dogs. d. Anykennel mustberegularly cleaned andsanitized andallexcreta removed atleast onceaday. e. Anyperson possessing akennel licence mustkeepaccurate records ofthebreeding, sellingorboarding ofthedogsinthekennel, andwhere suchdogsaresold. The owner mustbeabletoproduce theserecords atanytimeuponrequest oftheDog Control Officer. f. These kennel guidelines shallpertaintoallkennels. Where required, agrace period ofthreemonths (90) daysshallbegranted inordertomeetcompliance requirements. g. Everyownerwhofailstocomply withthekennel regulations isguiltyofanoffence. CBRM DogBy-Law 5 4. Records a. TheDogControl Officer andtheCitizen Service Centres oftheCapeBreton Regional Municipality shallkeeparecordofalldogsregistered including: thedateandnumber ofregistration; thenameanddescription ofthedog; and name, address andtelephone number oftheowner. b. TheDogControl Officer shallkeeparecord ofeverydogforwhich areport hasbeen received incompliance withthePartofthisBy-lawtitled "Owner'sReport". Therecord shallinclude thenameanddescription ofthedogreported andthename, address and telephone number oftheperson whosubmitted thereport. c. TheDogControl Officer shallkeeparecordofeverydogwhose owner wascharged withan offence underthisBy-law. Therecord shallinclude thenameanddescription ofthedog charged andthename, address andtelephone number oftheowner. 5. Offence a. Itisanoffence ofthisBy- lawwhenanyofthefollowing occur; i. Thedogrunsatlargecontrary tothisBy-law. ii. Thedogisfierceordangerous within themeaning ofthisBy-law; unless such dogisatalltimes keptinanenclosure or, ifoutofanenclosure, the circumstances described intheParttitled "Fierce andDangerous Dogs" are complied with. iii. Thedogpersistently disturbs thequietofaneighbourhood oranyresident thereof byhowling, barking, orinanyothermanner. iv. Ifadog, otherthanaguidedog, defecates onanypublicorprivate property otherthanthe property ofitsowner, theomission bytheowner tocausesuch defecation toberemoved immediately shallbeanoffence. v. Theownerofanydogwhich violates thePartofthisBy-lawtitled "Owner's Report". vi. Aregistration taghasnotbeenobtained orisnotwornbythedogincompliance withthePartofthisBy-lawtitled "Registration". vii. Akennel licence feehasnotbeenobtained incompliance withSection h. ofthe PartofthisBy-lawtitled "Registration". CBRM DogBy-Law 6 viii. Whilethedogisatlargewithin 100yardsoftheshoreline ofabodyofwater regularly accessed bythegeneral publicforpurposes ofrecreation or swimming from May1uptoand includingOctober 31,andinthepresence of theownerorsomepersonincharge thereof, thedogisnotundertheeffective physical restraint ofaleashnomorethan6feetinlength controlled bythe ownerorthepersonincharge. ix. While thedogisatlarge onorwithin anytrail, park, sportsfield, street, sidewalk, parking areaorotherrecreational spacewithin theMunicipality inthe CapeBreton Regional Municipality andinthepresence oftheownerorsome personincharge thereof, thedogisnotunder theeffective physical restraint ofa leashnomorethan6feetinlength controlled bytheownerorthepersonin charge Everyownerofanyunspayed female dogshall, during eachperiod theanimal x. isinheat, keepitconfined inanenclosure except whileundertheeffective physical restraint ofaleashnomorethan6feetinlengthdirectly controlled by theownerorapersonincharge b. Anyindividual orindividuals training adogordogstobeattack dogswithinthemeaning of thisBy-law: outside ofanimpoundment areawhich doesnotprevent thedog() fromexiting the s training area; and/or within500feetofaresidence otherthantheresidence ofthetrainer; shallbedeemed tobeinbreachofthisBy-lawandissubjectonsummary conviction to beliabletoafineofnotlessthan $600.00andnotmorethan $1000.00oneachviolation, andindefault thereof tothirty (30) daysimprisonment oneachviolation, andindefault thereof tothirty (30) daysimprisonment. c. TheOffence section oftheBy-Lawisnotapplicable totheK-9UnitsoftheCapeBreton Regional Municipality. d. ProofatTrial Uponthetrialofanaction brought against theownerorharbourer ofadogforanyinjury caused, ordamage occasioned by, suchdog, itisnotnecessary toproveknowledge by, or noticeto, theownerorharbourer ofanymischievous propensity ofthedog. e. Additional Penalty Atthetrialofacharge laidagainst theowner ofadogthatisfierceordangerous orthat persistently disturbs thequietofaneighborhood bybarking, howling orotherwise orthatrunsat large, inaddition tothepenalty, thejudgeorjusticeofthepeace mayorderthatthe: CBRM DogBy-Law 7 i. dogbedestroyed orotherwise dealtwith; and ii. owner payanycosts incurred bytheMunicipality related tothedog, including costsrelated totheseizure, impounding, ordestruction ofthedog, anditisnot necessary toprovethatthe iii. dogpreviously attacked orinjured adomestic animal, personorproperty; iv. doghadapropensity toinjureortodamage adomestic animal, person or property; or v. defendant knewthatthedoghadsuchpropensity orwas, oris, accustomed to doingactscausing injuryordamage. vi. orderanydogwhich hasviolated anyprovision ofthisbylawforathirdtimeto beseizedbytheDogControl Officer. 6. Penalty a. Theownerofanydogwhichisguiltyofanyoftheoffences against thisBy-lawissubject on summary conviction tobeliabletoafineasfollows: FirstOffence Withinina24month Period) ................................................... $ 165.00 Second Offence Withinina24month Period) ................................................... $ 279.00 ThirdOffence Withinina24month Period) ................................................... $ 425.00 Fourth Offence Withinina24month Period) ................................................... $ 605.00 7. Impounding a. TheDogControl Officer: 1. without noticetoorcomplaint against theowneroranysuchdog, mayimpound dogs: a. foundrunningatlargecontrary tothisBy-law; or b. forwhicharegistration taghasnotbeenobtained and isnotwornbythedogin compliance withthePartofthisBy-lawtitled "Registration". c. Thedogpersistently disturbs thequietofaneighbourhood oranyresident thereof byhowling, barking, orinanyothermanner. 2. uponcomplaint againsttheowner, verified bytheoffended party oranindependent witness willing toswearthattheywitnessed theattack, thedogcontrol officer shall impound afierceordangerous dogwhich hasinflicted bites, orattacked ahuman being, orkillsorinjuresanother domestic animal, unless: CBRM DogBy-Law 8 theotheranimal waskilledonproperty owned; or occupied bytheownerofthefierceordangerous dog. Where anydoghas, without provocation, attacked orinjured apersonoranother animal orisdeemed tobefierceordangerous topersons oranimals: i. anyDogControl Officer shallseizethedogand ifhe/sheisunabletoseizeit safely; maydestroy suchdogand suchdogmay, afterbeingseized, bedestroyed bythePound, without permitting ii. theownertoclaimitandwithout offering itforsale. b. While pursuing anydoginaccordance withthisBy-law, theDogControl Officer maypass overthelandofanyperson, butthisSection isnottobeconstrued soastoprovide immunity against action foractual damage totheproperty ofanyperson. c. TheCouncil shallappoint apound keeper whoshallkeepalldogsimpounded bytheDog Control Officer andprovide themwithshelter, foodandwater. d. Thepound keepershallbeobliged: toprovide shelter, foodandwaterforanydogimpounded foraperiod of72hours beginning atthetimethedogwaspicked upbytheDogControl Officer; and toscanformicrochips andcheckfortattoos e. Thepound keeper shallnotifytheregistered ownerofanimpounded dogbearing atagthat: thedoghasbeenimpounded; and thedogmaybedestroyed ordisposed ofinamanner deemed humane bytheS.P.C.A. after72hoursimpoundment ifitisnotclaimed excluding Sundays orstatutory holidays) bytheownerincompliance withSectionf. ofthisPart. f. Iftheowner appears atthepound andclaims thedogpriortothetimefixedbySection d. of thisPart, thedogshallbedischarged tohim/her: onpayment ofafirstimpoundment feeof $25.00perdayforroomandboard, second impoundment feeof $50.00perday; plus whentheownerofthedogsignsaRelease Formexplaining thegraduated impoundment feeschedule andtheprovision ofsub-sectiong. below stipulating thedogshallnotbe 3rd claimed bytheownerifitisimpounded a timewithin12months; payment ofanylicence feerequired incompliance withthePartofthisBy-lawtitled Registration"; anyveterinary billsincurred bythepound keeper; theperson claiming tobetheownerofthedogisnotunder theageof19years. Provide apictureIDsuchasaNSDriver'sLicence inordertoclaimthedog." CBRM DogBy-Law 9 g. Theownerofanydogthathasbeenimpounded foritsthirdinfraction within12months shall notredeem thedog. h. If, attheexpiration of72hoursfollowing theimpoundment ofanydog excluding Sundays or noclaimofownership forsuchadogismadeincompliance withSection statutory holidays) f. ofthisPart, thepound keeper shalldispose ofthedog, eitherbysellingitforthebestprice obtainable or, ifthedogcannot besold, bydestroying itinamanner deemed humane bythe S.P.C.A. i. Aperson resident within theMunicipality purchasing anunregistered dogfromthepound keeper shallregister thedogbefore takingitfromthepoundkeeper. j. Anydogwhich isinjured, sickorotherwise inneedofmedical carewhenapprehended by theDogControl Officer shallreceive basicfirstaidmedical treatment attheimpoundment facility sothatlifeisnotendangered andthatpainisreduced consistent withpractices deemed humane bytheS.P.C.A. Costsoftreatment provided shallberecovered fromthe owner beforethedogisreleased. 8. Owner'sReport a. Theownerofanydogmayberequired bytheDogControl Officer todelivertotheDog Control Officer, inwriting, astatement: identifying thenumber ofdogsowned orharboured byhim/herorwhich are habitually keptuponthepremises; and adescription ofeachdog. Neglect orrefusaltodoso, andforeveryfalsestatement madeinrespect thereof, the owner shallbeliabletothepenalty described inthePartofthisBy-lawtitled "Offences". b. Theowner requested todeliverareporttotheDogControl Officer pursuant toSection a. of thisPartshallsubmit thereportnolaterthan10daysfromthedatetherequest wasreceived. c. Iftheowner'sreport shows therearedogsthathavenotbeenregistered byobtaining adog tagincompliance withthePartofthisBy-lawtitled "Registration", allsuchdogsshallbe registered within10daysortheownershallbeliabletothepenalty described inthePartof thisBy- lawtitled "Offences". CBRM DogBy-Law 10 9. ProvokedAttacks Nodogmaybedeclared fierceordangerous if: thethreat, injuryordamage wassustained byaperson who, atthetime, wascommitting a a. willful trespass orothertortuponthepremises occupied bytheownerorkeeperofthedog, orwasteasing, tormenting, abusing, threatening orassaulting thedogoritsownerorkeeper, orhas, inthepast, beenobserved orreported tohaveteased, tormented, abused, threatened assaulted thedogoritsownerorkeeper orwascommitting orattempting tocommit acrime; thethreat, injuryordamage wassustained byanother animal which, atthetimewas b. trespassing uponthepremises occupied bytheownerorkeeperofthedog, orwasteasing, tormenting, abusing, threatening orattacking thedogoritsownerorkeeper, orhas, inthe past, beenobserved orreported tohaveteased, tormented abused, threatened orattacked the dogoritsownerorkeeper orwasaccompanying aperson engaged inactivities described in Section "a" above. 10. FierceandDangerous a. Notwithstanding Section 6.a.2., andprovided thedogissecurely muzzled andrestrained with agood, tightlead (leash) toprevent thedogfromcoming incontact withpersons otherthan theowner andnotexceeding 3feetinlength, andunderthedirectcontrol andsupervision of theownerofthedog, afierceordangerous dogmaybeallowed outofanenclosure: ifitisnecessary forthepurposes ofobtaining veterinary careforthedog; tomove thedogfromtheMunicipality. b. Whereapeaceofficerbelieves, onreasonable grounds, thataperson isharbouring, keeping orhasundercare, control ordirection adogthatisfierceordangerous, rabidorappears tobe rabid, thatexhibits symptoms ofcanine madness aJusticeofthePeacemay, bywarrant, authorize andempower theperson namedinthewarrant to: i. enterandsearch theplacewherethedogis, atanytime; ii. openorremove anyobstacle preventing accesstothedog; and iii. seizeanddeliver thedogtothepound andforsuchpurpose, break, remove orundo anyfastening ofthedogtothepremises. c. RabidAnimals Anofficer maykillordestroy arabiddogfound atlargeandmaysecureandconfine adog appearing toberabidorexhibiting symptoms ofcanine madness. CBRM DogBy-Law 11 d. Tranquilizing aDog TheDogControl Officer maytranquilize "anydogwhether ornotitisfierceordangerous", without noticeorimpounding if: thedogisrunning atlarge; and theDogControl Officer isunabletoseizethedoginsafety. 11. Un-spayedFemaleDogs Everyownerofanyunspayed female dogshall, during eachperiodtheanimalisinheat, keepit confined inanenclosure except whileundertheeffective physical restraint ofaleashnomore than6feetinlength directly controlled bytheownerorapersonincharge. 12. DogTrainingandDogParkLeashProvisions 1. Obedience training ofunleashed dogsconducted offtheproperty occupied, orowned, bythe ownerofthedogmaybepermitted bytheDogControl Officer provided thefollowing provisions aremet. a. Theapplicant provides anaffidavit stating thedogisnotfierceordangerous asdefined in thisBy-lawandthedoghasnotreceived aggression orprotection training. b. Theapplicant provides aCompanion DogCertificate issuedbytheCanadian Kennel Clubincompliance withtheCanadian Kennel ClubObedience TrialRuleBookwhich ensures theapplicant hastrainedatleastonedogtotheCompanion DogLevel. c. Thesiteapproved isinasparsely populated areaoftheMunicipality onprivate property andapproved bytheDogControl Officer d. Theapplicant provides aletter fromtheowner oftheproperty granting permission to traindogsandholdtheMunicipality notliableforanyactions whichmayoccur. 2. Unleashed dogsarepermitted bytheDogControl Officer whenwithin theconfines ofa designated offleashdogparkwhich complies with the Guidelines forUnleashed Dogparks foundinAPPENDIX- A ofthisbylaw. 13. RepealofPreviousBy-laws AnyDogBy-lawsoranyprovision thereof passedandadopted byanyoftheeight (8) former municipalities ofCapeBreton County priortoJuly31, 1995whichconflict withoractscontrary totheprovisions By-lawarehereby repealed withthisBy-lawbecoming lawandanyother provisions ofsuchBy-lawsarehereby ratified andconfirmed insofar astheyarenotinconflict withthisBy-law. NovaScotia MunicipalGovernmentAct CHAPTER 18 Dangerous dogs 176 (1) Whereapeaceofficer believes, onreasonable grounds, thatapersonisharbouring, keeping orhasundercare, control ordirection adogthatisfierceordangerous, rabidorappears toberabid, thatexhibits symptoms ofcanine madness orthatpersistently disturbs thequietofa neighborhood bybarking, howling orotherwise contrary toaby-law, ajusticeofthepeacemay, bywarrant, authorize andempower theperson namedinthewarrant to a) enterandsearchtheplacewherethedogis, atanytime; b) openorremove anyobstacle preventing accesstothedog; and c) seizeanddeliver thedogtothepound andforsuchpurpose, break, remove orundoany fastening ofthedogtothepremises. 2) Where theperson named inthewarrant isunabletoseizethedoginsafety, theperson may destroy thedog. CBRM DogBy-Law 15 APPENDIX - A GuidelinesforOffLeashDogParksinCBRM Introduction: Traditionally suburban andruralareasofourcommunity contained mostofthepetpopulation; however therehasbeenanincrease inpetpopulation andurbanization overthepast15years. Asthedogpopulation increases alongwithdevelopment, regulations areneeded forpetowners and facilities needtobeprovided toallowpetowners andtheircanine companions toexercise together. Theprovision ofample spaceforhuman/dogcompanion recreation promotes thewell-beingofboth dogandhuman. Definition: DogPark- Adogparkisafencedinareasetasidefordogsandtheirownerstoexercise andplayoff- leashinacontrolled environment. Mission: Toprovide afun, safeandfriendly environment fordogstoexercise andplaywithotherdogsand provide aplaceforcitizensofCBRMtosocialize withotherdogowners. Goals: Increating anoffleashdogparkitishopedtoaccomplish thesegoals; 1. Toallowregistered, not-for-profit groupsandothers toformandoperate offleashdogparks inourcommunities. 2. Todevelop easilymaintained space, opentoalldogloversandfriends whoarewillingto uphold thegroup'sparkrulesandrestrictions. 3. Toviewthese parksascommunity projects inpartnership withCBRM, designed tosatisfy the needsofdogowners andnon-dogowners. CBRM DogBy-Law 16 ParkRequirements: 1. Anoffleashdogparkshallbeaminimum of20,000squarefeetinareatoallowample space formultiple dogsandtheirownerstoenjoythespace. 2. Theperimeter oftheparkshallbefencedaminimum of4ft. highandprovided withadouble entrygatedsystem. Theonlyexception tothisruleshallapplytotheoff-leashtrailareaof Rotary Parkwhichisapproximately 3.5hectares insize. 3. Parks shallbeprovided withsignage indicating rulesoftheparkasestablished bythe organization responsible foritsoperation. 4. Provisions shallbemadeforthedisposal ofgarbage anddogwasteattheentrance tothegate entry. 5. Hoursofoperation shallbeposted whichshallrequire offleashdogparkstobeclosedatdusk andnottoopenanyearlier than8:00AM. 6. Parks shallnotbelocated within500feetofaresidence.
