THE MUNICIPALITY OF THE DISTRICT OF GUYSBOROUGH
COLLECTION OF SOLID WASTE & RECYCLABLES BY-LAW
BY-LAW #4
ADOPTED: April 14, 1998
AMENDED: April 20th, 2022
1.
DEFINITIONS:
a. SOLID WASTE - shall mean all refuse which can be disposed of at an approved Landfill
Site and which is NOT compostable or recyclable.
b. CONSTRUCTION DEBRIS - shall mean, but is not limited to, plastic, wood, metals,
mortar, concrete, brick, asphalt, asphalt shingles, soil, cellulose, fiberglass fibers, gyproc
or vinyl; from excavations, building construction, repair, alterations, maintenance and
demolition.
c. MUNICIPALITY - shall mean the Municipality of the District of Guysborough.
d. BULK ITEMS - shall mean, but is not limited to, weighty articles such as household
furniture and appliances, stoves, furnaces, fridges, washers, dryers, bed springs, fuel tanks
less than 200 gallons and Christmas trees. Bulk items do not include automobile parts and
accessories or tires more than 20 inch in diameter.
e. COMPOSTING - shall mean the storage and controlled biological aerobic decomposition
of organic matter such as vegetables, fruit, garden and yard waste and any materials deemed
compostable.
f. COMPOSTABLES - shall mean, but is not limited to, organic matter such as vegetables,
fruit, garden and yard waste, coffee grounds and filters, tea bags and leaves, hay or straw,
sawdust, egg shells, crushed nutshells and seafood shells, manure, ashes, damp paper
towels and serviettes, paper towel and toilet paper tubes, cereal boxes, soups and sauces,
baked goods and soil.
g. RECYCLING - shall mean the collection, storage and reuse of materials such as
redeemable beverage containers, newsprint, corrugated cardboard, milk containers, or any
items banned for disposal at the Landfill Site by the Nova Scotia Department of
Environment or the Municipality of the District of Guysborough.
h. RECYCLABLES - shall mean, but is not limited to, redeemable beverage containers,
corrugated cardboard, newsprint, milk containers, or any items banned for disposal at the
landfill site by the Nova Scotia Department of Environment or the Municipality of the
District of Guysborough.
2. Every household and every operator of a business establishment or institution shall, at their
own expense, make adequate arrangements for the storage of solid waste and recyclables
which is to be picked up by the Municipal Collection Program in such a manner that is
impervious to animals.
3. Homeowners, business establishments and institutions shall ensure that any material placed
at roadside for pickup by the Municipal Collection Program is placed in a container
weighing not more than 23 kg. (50 lbs.) with a volume capacity of not more than 78 liters
(bags) and containers shall be of adequate strength to allow the container to be removed
from the roadside or storage box and placed in the collection truck.
Homeowners should provide a storage box at roadside for Solid Waste and Recyclables,
however, fridges and freezers shall not be used for this purpose.
Recyclables shall be placed in plastic semi-transparent disposable bags BLUE or
CLEAR in color having a volume capacity of not more than seventy-eight liters (78 L.)
and being strong enough to hold twenty-three kilograms (23 kg) (50 lbs.).
4. Cardboard, newspaper, magazines and wastepaper for recycling MUST be tightly
compressed and flattened and securely tied with strong twine or rope in convenient bundles
not to exceed twenty-three kilograms (23 kg) (50 lbs.) in weight and shall not be more than
two feet (2') in diameter and four feet (4') in length.
5. No solid waste of a hazardous nature shall be placed at roadside for Hazardous waste
includes, but is not limited to, explosives or combustible materials, radio active corrosive
or toxic materials and biological waste.
6. A maximum of eight (8) bags, containers or bundles and a total weight not exceeding
seventy kilograms (70 kg) (150 lb.) shall be collected each dwelling unit, business
establishment or institution. In the case of the Recyclable Collection Service a maximum
of eight (8) bags, containers or bundles and a total weight not exceeding seventy kilograms
(70 kg) (150 lb.) shall be collected in accordance with this bylaw for each dwelling unit,
business establishment or institution.
7. All solid waste and recyclables shall be adequately drained of liquid and put in a proper
container/bag before being placed for collection.
8. Solid waste and recyclable containers and bundles shall be placed for collection by the side
of the road in front of the premises where it was accumulated, and as close as practicable
to the driving surface of the designed route unless specified elsewhere by the Municipality.
Containers shall be provided to ensure the solid waste is contained and impervious to
animals. Solid waste or recyclables will not be collected from roadside ditches.
9. Solid waste or recyclable containers or bundles shall not be placed for collection before
5:00 a.m. of the day on which such collection is to be made.
10. All solid waste or recyclables placed for collection in a manner not provided for by this by-
law shall not be collected. All such solid waste or recyclables not collected MUST be
removed from the front of the premises not later than 8:30 p.m. of the day on which it was
placed for collection.
11. Except for the purpose of composting or recycling, no householder shall permit solid waste
to remain on his/her premises for more than fourteen (14) days.
12. All solid waste placed in containers or bundles which is designated to be collected by the
hauler of solid waste, and which contains materials which are deemed recyclable or
BANNED by the Nova Scotia Department of Environment or the Municipality of the
District of Guysborough, shall be left at roadside. An appropriate sticker will be placed on
the container or bundle indicating the reason it was not collected and the Homeowner will
be responsible for separating the material and placing it for collection in the manner
required under this By-Law for Collection of Solid Waste and Recyclables.
All containers or bundles placed at roadside for collection by the designated hauler of
recyclables which contain solid waste will be left at roadside with the appropriate sticker
placed on the container or bundle indicating why it was not collected and the Homeowner
will be responsible for sorting the material and placing it for collection in the manner
required under this By-Law for Collection of Solid Waste and Recyclables.
13. It shall be an offense against this By-Law for any person to place any solid waste or
recyclables for collection in any type of container or in any manner not provided for by
this By-Law.
14. Wrecked or derelict motor vehicles, motor vehicle bodies or parts shall NOT be included
with solid waste or recyclables for collection and are not considered to be "Bulk Items"
which can be picked up by the Collection Program.
15. It shall be the responsibility of every householder to make adequate arrangements for the
disposal of bulk items such as notifying the collection hauler at least one day in advance
of the size, weight and quantity of bulk items to be picked up on that particular route.
16. No person(s) shall dump, place, leave, or deposit any solid waste, recyclables,
compostables or bulk items in any public place within the Municipality or on any public
beach or shore within the said Municipality except in any place as has been designated by
the Municipality for that purpose.
17. No person(s) shall place or cause to be placed any material of whatever nature or kind for
collection under the Municipal Collection program except in accordance with this by-law.
18. No person(s), other than employees or a Contractor of the Municipality of the District of
Guysborough authorized to do so, shall pick over, remove, disturb, or otherwise interfere
with any materials, whether solid waste, recyclables, bulk items, compostables or
construction debris placed for removal by the Municipality, whether or not it is contained
in containers or bundles.
19. Any person(s) who violates or fails to comply with any of the provisions of this By-Law
shall be liable, upon conviction, to a penalty not exceeding one thousand dollars
($1,000.00) and in default of payment to imprisonment for a period not exceeding thirty
(30) days.
20. All other By-Laws respecting the collection and handling of Solid Waste (garbage) and
Recyclables heretofore passed by the Municipal Council of the Municipality of the
District of Guysborough are hereby REPEALED as of the effective date of this By-Law.
