## BY-LAW NO. 15
## REFUSE BY-LAW
1. This By-law shall be known and may be cited as the "Refuse By-law" of the Town of New Glasgow.
2. No person shall throw or otherwise deposit any dirt, filth, rubbish, litter, refuse or garbage upon any street, road, lane, highway, sidewalk, or other public place within the Town.
3. The occupant of every house or premises on a street where garbage is collected shall provide sufficient and adequate containers for garbage which may accumulate from time to time in or from such house or premises.
4. All containers for garbage shall be:
5. (a) made of metal or plastic; or
6. (c) be made of water tight construction; and
7. (b) plastic garbage bags; or
8. (d) be provided with a tight fitting cover or seal; and
9. (e) be maintained in a clean state.
10. No person shall place in any container, garbage or a highly combustible, flammable or explosive nature.
6. The containers provided for the purposes of this By-law shall, at all times, be maintained in good condition by the owner thereof.
12. No person shall place in any container, garbage of any kind which together with the weight of the container exceeds in weight seventy-five pounds.
13. No container shall be filled to a greater height than two inches below the top of the same.
9. All cardboard boxes or cartons shall be flattened out and they and newspapers shall be securely tied into neat packages and bundles, and need not be placed in a container.
10. No more than five containers shall be collected from any one dwelling, provided however that the collector may use discretion as to the number of containers to be picked up over the maximum number permitted
11. (1) A package of papers or a container containing garbage to be collected shall be placed readily accessible to the collector, at the curb or side of the street where the garbage is to be collected, and if upon a sidewalk then in such a position as to interfere as little as reasonably possible with pedestrian traffic.
- (2) No person shall place any garbage for collection earlier than six o'clock in the morning of the day on which such garbage is scheduled to be collected.
12. If for any reason, garbage is not removed on the day provided for collection, it shall be removed from the sidewalk or curb area by the householder not later than midnight of the day on which the garbage was scheduled to have been collected. Emptied containers shall be removed by the householder not later than midnight of the day they are emptied
13. (1) Every occupant of property in the Town shall have all garbage removed from his premises at least once every week. If there is no occupant then the owner shall do so.
- (1) No garbage shall be deposited in any area or areas within the Town other than those specifically authorized by resolution of the Council.
- (2) Disposal of garbage by private citizens will be permitted at an approved Municipal Dump site if in compliance with the official in charge and during the hours of operation, provided however the person employed for the removal of garbage in the Town shall, at all times, have unloading priority at the disposal site.
15. Every vehicle used in the collection of garbage shall be covered so as to prevent any of the contents of the vehicle from falling out of, or otherwise being spilled, or scattered from the vehicle while the vehicle is in motion.
16. The "Refuse By-law" passed by Town Council on February 25, 1980 and approved by the Minister of Municipal Affairs on April 1, 1980 and any amendments thereof, are hereby repealed.
8. I, J. K. Langille, Clerk of the Town of New Glasgow, do hereby certify that the foregoing is a true copy of a by-law duly passed at a duly called meeting of the Town Council duly convened and held on the 24th day of October, 1994 A.D.
