## BYLAW NO. 10
## A BYLAW RESPECTING THE OPERATION OF THE PUBLIC MARKET
BE IT ENACTED by the Council of the Region of Queens Municipality, under the authority of the Queens Regional Municipality Act, S.N.S. 1995, Chapter 9, as follows:
- This Bylaw shall be known as Bylaw Number 10 and may be cited as "The Public Marker Bylaw".
## DEFINITIONS
- Words in this bylaw shall take their meanings from their context and from dictionaries of the Canadian language, except as follows:
"Public Market" means the land and structure owned by the Region and bound on the North by Henry Hensey Drive, West by Legion Street, South by property identification #70028337, assessment #04610709 and to the East by the Public Parking area and located in the area of the Region know as Liverpool;
"Region" means the Region of Queens Municipality;
"vending stall" means that area, measuring approximately 96.3 square feet (8.95 square metres) and being located between four painted lines at a 90 degree angle from the support posts to either side of the number associated with vending stalls in question one through six; and four painted lines only for vending stalls seven through eleven so numbered;
"vendor" means both the person indicated as payee on the receipt for fee payment in relation to any particular vending stall - and the person in charge of such vending stall.
## GENERAL REGULATIONS
- 3. All vendors wishing to conduct business within Liverpool shall be required to locate within the hereinabove defined Public Market and shall not be permitted to conduct their business in any other location within Liverpool.
4. The fee for use of a vending stall shall be as set out below and shall be payable to the Regional Clerk's office:
- Daily use hours shall be from 8:00 a.m. to 8:00 p.m. each day of every week.
- Weekly use shall consist of seven (7) consecutive days running Monday through to the following Sunday, or any part thereof.

## PROHIBITIONS
- No person shall permit the offering for sale of, sell, or offer for sale, goods of any kind or sort whatsoever at, on, or in the structure or lands comprising the Public Market without first having:
- (a) paid the fee as set out in this bylaw; and
- (b) obtained, therefore, a receipt; and
- (c) displayed such receipt at the applicable vending stall.
- . 8. No vendor shall breach, nor shall any vendor permit the breach of, the following regulations which apply to the vending stall, goods, associated materials and belongings, employees, assistants and agents of each vendor:

- (a) no goods, tables, associated materials, belongings or any other part of a vending operation is / are to be located or placed outside of the applicable vending stall area as defined in this bylaw; and
- (b) no pet belonging to, or associated with, the vendor - or belonging to, or associated with, any person assisting in the operation of the vending stall - shall be on or within any portion of the vending stall area; and
- (c) vendors, and those assisting at any vending stall, are to use only those garbage receptacles provided by the Region; and
- (d) all garbage, refuse or unwanted material or liquid is to be disposed of in the receptacles provided by the Region; and
- (e) vendors, and those assisting at any vending stall, are to leave the vending stall, at the end of each day, in a clean condition and free of debris.
9. No person shall park a motor vehicle on the Public Market site other than in a parking spot designated as such by means of painted markings on the pavement.
10. No person shall drive, park, operate or place a motor vehicle under the structure portion of the Public Market other than for loading and unloading purposes and even then for a period of time not to exceed 20 minutes.
## PENALTIES
11. Any person found to be in violation of this bylaw shall be liable, upon conviction, to a fine of not less than Fifty Dollars ($50.00) and not more than Two Hundred Dollars ($200.00) and, in default of payment, to a term of imprisonment not to exceed Ten (10) days.:" ·
## REPEAL
12. Any Public Market Bylaw, including any amendments hereto, adopted by the former Town of Liverpool are hereby repealed.
