POLICY NUMBER - 53 Page 1 of 2 Policy Subject / Title - PRIVATE COLLECTION & DISPOSAL OF ORGANICS ON PRIVATE ROADS SERVICED BY MUNICIPAL SOLID WASTE BOXES _____________________________________________________________________ GENERAL STATEMENT OF POLICY 53.01 The Region of Queens Municipality wishes to establish a policy for the distribution of organic carts and the collection of disposal of organic materials to be placed in these organic carts on private roads serviced by municipal solid waste boxes throughout the Region of Queens Municipality that are collected and disposed of by private contractors. DEFINITIONS 53.02 Words in this policy shall take their meanings from context and from dictionaries of the Canadian language, except as follows: "Owner" means any persons who possesses, has the care of, has the control of, and includes a person who is a part owner, joint owner, tenant in common or joint tenant of the whole or part of a private road. "Agent" means a person legally acting on behalf of an owner for the purpose of this policy and includes a person acting on behalf of an association or group of owners. "Private Collection & Disposal" means not collected or disposed of by the Region of Queens Municipality to carry out such work noted in this policy. POLICY PROCEDURE: 53.03 Any owner of a private road in the Region of Queens Municipality serviced by municipal solid waste box may apply by written letter to the Region to be supplied with one full size organic collection cart for each resident on that private road and an appropriate number of carts for commercial businesses based on the expected usage, excluding those commercial businesses deemed by the Region not to qualify for organic carts except in limited numbers, if the owner or agent agrees to provide collection and disposal of the organic material from the organic carts at the Queens landfill at the owner's expense. POLICY NUMBER - 53 Page 2 of 2 Policy Subject / Title - PRIVATE COLLECTION & DISPOSAL OF ORGANICS ON PRIVATE ROADS SERVICED BY MUNICIPAL SOLID WASTE BOXES 53.04 Any such collection of organic material must be collected once every two weeks or more often and must be transported to the Queens Landfill and deposited in a location designated by Queens Landfill personnel during landfill operation hours within a reasonable time and not placed in any holding area or artificial transfer station outside of the Queens Landfill facility. This collection must be done in a vehicle that prevents contamination from non-organic materials and disposal of such material will only be allowed at the Queens Landfill if land personnel are satisfied that the disposal contains only organic material. 53.05 If at any time after the owner or agent is supplied with the organic carts, the owner or agent fails to comply with the requirements of 53.04, the Region may require the return of some or all of the organic carts provided as a result of application under this policy and require organic waste generators or property owners to use the organic carts located at the municipal solid waste box servicing the private road that existed prior to approval under this policy. 53.06 The Region Of Queens Municipality reserves the right to remove any number of the organic collection carts located at the municipal solid waste box servicing any private road approved under this policy for private collection and disposal. 53.07 Nothing in this policy shall allow any owner, agent or person operating under the jurisdiction or direction of any of these approved users to do anything contrary to the Regions Solid waste Bylaw other than what is authorized in this policy or ant other Municipal, Provincial or Federal Laws.
