## BYLAW NO. 9
## A BYLAW RESPECTING PARKING METERS
BE IT ENACTED by the Council of the Region of Queens Municipality, under the authority of the Municipal Government Act, S.N.S. 1998, Chapter 18, and under the authority of the Motor Vehicle Act, R.S.N.S. 1989, Chapter 293, as amended, as follows:
- This Bylaw shall be known as Bylaw Number 9 and may be cited as "The Parking Meter Bylaw".
## DEFINITIONS
- Words in this Bylaw shall take their meanings from their context and from dictionaries of the Canadian language, except as follows:
"commercial motor vehicle" shall have the meaning assigned to that phrase by definition in the Motor Vehicle Act, R.S.N.S., 1989, ch.293
"motor vehicle" shall have the meaning assigned to that phrase by the definitions in the Motor Vehicle Act, R.S.N.S., 1989, ch.293
"veteran" shall have the meaning assigned to that phrase by definition in the Motor Vehicle Act, RSNS, Section 38
## GENERAL REGULATIONS
- The following regulations apply to parking meters and any parking spaces associated with them:
- (a) no more than one motor vehicle shall be parked in a parking space;
- (b) in the case of a parking space parallel to the curb or edge of the roadway, the front of the motor vehicle shall not be more than one foot past the meter nor shall it fail to be within three feet of the meter;
- (c) in the case of angled parking spaces, one of the front tires of the motor vehicle shall be within 30.48 centimeters (one foot) of the curb or edge of the roadway immediately to the right of the associated parking meter;
- (d) in the event that two (2) meters are supported by one standard or post, any motor vehicle using an associated parking space shall be parked entirely within the markings of that parking space;
- (e) in the event that a motor vehicle is too large to fit within the markings of a single parking space, the operator of the motor vehicle shall be responsible for appropriate coin deposit in all meters associated with any parking space or portion of parking space utilized by such motor vehicle;
- (f) Arabic numerals used in parking meter directions have the following meanings: " 05" means 5 cents, "10" means 10 cents, ".25" means 25 cents, "1.00" means one dollar, and "2.00" means two dollars, all in Canadian currency.
- (g) 25 cents for every 15 minutes, or any part thereof, is the standard rate for use of any metered parking space.
## PROHIBITIONS
- No person shall park a motor vehicle except in accordance with the requirements of the preceding section unless otherwise authorized in this bylaw or the Motor Vehicle Act, R.S.N.S. 1989, Chapter 293.
- No person shall, between the hours ot 8:00 a.m. and 5:00 p.m., except on a Saturday, Sunday or Statutory Holiday, park a motor vehicle in any parking space associated with a parking meter without depositing in such parking meter a . coin or coins of lawful money of Canada of sufficient value to comply with the requirements of this bylaw and shall do so in accordance with the directions on the parking meter.
- No person shall park, or permit the parking of, a motor vehicle in any parking space associated with a parking meter while the Arabic numbers "00" are flashing or appear in the window of the meter's digital display of such parking meter.
- No person shall allow a motor vehicle to remain parked in a parking space associated with a parking meter for a period longer than the maximum time that can be purchased at any one time from such parking meter.
- No person shall deposit, or cause to be deposited, in any parking meter any item other than such coins as are permitted to be deposited pursuant to this bylaw.
## EXCEPTION FOR END OF EACH YEAR
- Notwithstanding the foregoing, Sections 5, 6 and 7 of this bylaw shall not be enforced during that period of time starting 28 days prior to December 25th of each year and the term "days", for the purpose of this Section, includes weekdays, Saturdays, Sundays and any Statutory Holiday.
## EXCEPTION FOR THOSE WITH VETERAN LICENSE PLATES
10. A vehicle that is identifiable by a Veteran's License Plate, issued pursuant to the Nova Scotia Veterans Number Plate Regulations, will have free parking at any Region of Queens Municipality parking meter on Region of Queens Municipality property all year round.
## COMMERCIAL MOTOR VEHICLE
11. The driver of any commercial motor vehicle, when using same for the transportation of goods and expeditiously loading or unloading such goods may park such motor vehicle in any parking space associated with a parking meter for a period of time not to exceed 30 minutes without depositing any coins in such parking meter.
## PENALTIES
12. Any person found to be in violation of this bylaw shall be liable, upon conviction, to a fine of not less than One Hundred Dollars ($100.00) and not more than One Thousand Dollars ($1,000.00) and, in default of payment, to a term of imprisonment not to exceed Sixty (60) days.
13. (1) In the case of a parking meter and associated space with a maximum allowable parking time of thirty (30) minutes, each additional period of violation time equal to such maximum allowable parking time shall constitute a separate offence.
- (2) In the case of a parking meter and associated space with a maximum allowable parking time of two (2) hours, each additional period of violation time equal to such maximum allowable parking time shall constitute a separate offence.
14. The owner of any motor vehicle found to have been in violation of this bylaw shall incur any fine levied unless the owner an prove that at the time of such violation the motor vehicle was in the possession of some other person without the owner's consent, either express or implied.
## VOLUNTARY PAYMENT
15. Any person who is given Notice of an alleged violation of this bylaw may elect to pay, in the manner as directed in the Notice, a penalty of fifteen dollars ($15.00) for each hour of violation provided also that if payment is made within seven (7) days following the date of the alleged violation, the said voluntary payment shall be reduced to ten dollars ($10.00) for each hour of violation and in either case the said voluntary payment shall be in full satisfaction and shall discharge all penalties incurred by the person for such violation.
## REPEAL
16. The Bylaw Respecting Parking Meters, adopted by the Council of the Region of Queens Municipality on the 2'° day of December, 2004, is hereby repealed.
17. The Bylaw Respecting Parking Meters, adopted by the Council of the Region of Queens Municipality on the 17" day of March, 2009 is hereby repealed.
