BYLAW
1
THIS BY-LAW SHALL REPEAL AND SUPERCEDE ANY AND ALL PREVIOUS REGULATIONS
AND/OR BY-LAWS HELD BY THE TOWN OF SHELBURNE REGARDING EXOTIC PETS.
Short Title
1. This By-Law shall be cited as "Exotic Pet By-Law".
Interpretation
2. In this By-Law unless the context otherwise indicates:
(a) "Exotic Animal" means any species of animal that is not currently considered
native to Nova Scotia;
(b) "Owner" means, and includes, a company or person who possess, has the
care of, has the control of, or harbours an exotic pet and where said person is
a minor, includes the person with custody, care or control of the minor;
(c) "Owner of Premises" includes a tenant, occupier, a part owner, joint owner,
tenant in common or joint tenant of the whole or any part of land or building,
and in the case of the absence or incapacity of the person having title to the
land or building, a trustee, personal representative, an agent, a mortgagee in
possession, an attorney under a valid Power of Attorney or a person having
care or control of the land or building;
(d) "Prohibited Animal(s)" means all exotic venomous (including those with toxin
removed) snakes, arachnids, and reptiles; and, it includes non-poisonous
snakes whose expected adult length is three (3) metres or more and lizard
species whose expected adult length is two (2) metres or more;
(e) "Town Staff" means the CAO, By-Law Enforcement Officer, Special Constable
or any person appointed by the CAO to act on behalf of the Town for the
purposes of this By-Law;
(f) "Town" means the Town of Shelburne, Nova Scotia.
Regulations
3. It will be an offence against this By-Law to:

a) bring into the Town, possess, have the care or control of, or harbour a
prohibited animal unless duly licensed to carry on an exhibition or other
itinerant amusement performance or educational
display/workshop/session;
b) dispose of any prohibited animal except by releasing said animal to an
Animal Control Officer, or individual contracted by the Town to act in this
capacity, or licensed organization that specialized in animals exotic in
nature;
c) sell or offer for sale any prohibited animal.
Should an owner(s) be in possession of a exotic animal(s) they shall ensure that
the animal(s) is kept in a secured enclosure(s).
Town Staff may without notice to or complaint against the owner, seize an exotic
animal and turn it over to an approved agency that will provide for its care,
should it:
a) pose an immediate threat; or,
b) be not in proper care or control of the owner.
4. By-Law Enforcement and Penalties
Any person found to be in violation of the provisions of this By-Law may be found
guilty of an office and be liable on summary conviction to a penalty and may
be liable for the corresponding fines laid in the Information. Each day that a
person violates any provision of this By-law is considered a separate offence.
By-Law Enforcement
5. It shall be the duty of any By-Law Enforcement Officer and of any Special
Constable appointed for the Town of Shelburne under the Nova Scotia Police
Act, to report all violations of this
By-Law and to enforce them under the Municipal Government Act, Section 505.
