BYLAW 1 BEING ENACTED by the Town Council of the Town of Shelburne under the authority of Section 7(2) of the Theatres and Amusements Act, R.S.N.S., 1989, Chapter 466, as follows: 1. This By-Law shall be known as the "Circus Animal Prohibition By-Law". 2. Subject to Subsection 3 herein, no person shall operate or carry on in the Town of Shelburne a circus in which animals perform tricks or participate in performances of any kind for the amusement of an audience. 3. Nothing contained in this By-Law shall prohibit or restrict the following: (a) exhibitions or performances in which individuals ride horses or ponies; (b) exhibitions or performances involving dogs; (c) displays or showings of animals in agricultural fairs, exhibitions, or pet shows; (d) horse races, ox hauls, horse hauls or dog races. 4. For the purposes of this By-Law, the term "animal" includes all mammals, birds, reptiles and arachnids, but excludes humans. 5. Any person violating this By-Law shall be liable upon summary conviction to a maximum penalty not exceeding $1,000.00 and in default of payment to imprisonment for a period not exceeding thirty (30) days. TOWN OF SHELBURNE CIRCUS ANIMAL PROHIBITION BYLAW 2 THIS IS TO CERTIFY that the By-Law of which the foregoing is a true copy and was duly passed at a duly called meeting of the Council of the Town of Shelburne, held on the 6th day of May, A.D., 1998.
