Page 1 of 2 TOWN OF TRENTON BY-LAW NO. 25 REMOVAL OF ASHES AND OUTDOOR WOOD FURNACE __________________________________________________________________ PURPOSE To provide consistent guidelines and regulations concerning the use, location and nuisances associated with the operation of outdoor wood furnaces, and the clean-up and maintenance of properties with respect to ashes or other flammable materials that may be a hazard or nuisance to nearby properties. This by-law is adopted under the power granted under Section 172(1) of the Municipal Government Act of Nova Scotia, RSNS, which states: 172(1) - A council may make by-laws, for municipal purposes, respecting (d) nuisances, activities and things that, in the opinion of the council, may be or may cause nuisances, including noise, weeds, burning, odours, fumes and vibrations. DEFINITION Outdoor wood furnace means an accessory building or structure which operates as a heat source for an adjacent main structure or dwelling. Rear yard shall have the same definition as that outlined in the Land Use By-law; Town shall mean the Town of Trenton, Nova Scotia, a body corporate as incorporated under the Municipal Government of Nova Scotia, RSNS REQUIREMENTS 1. An outdoor wood furnace or structure containing an outdoor wood furnace shall: (a) Be only located in a rear yard, and at least 122 metres (400 feet) from the nearest lot line; and (b) Have a chimney stack or exhaust at least 1.8 metres (6 feet) above the peak of the roof of the structure that the furnace is intended to heat. 2. Any person who owns or occupies lands within the limits of the Town shall within ten (10) days from the notice to do so remove all ashes, filth, rubbish and any inflammable materials that might become hazardous to nearby properties, as a result of the use of an outdoor wood furnace, or any other source of fire, ashes, filth, rubbish or any inflammable materials. Page 2 of 2 PERMITS and FINES 3. A development permit or the installation of an outdoor wood furnace shall be required to be obtained from the development officer for the Town of Trenton, and subject to the process and requirements of the Land Use By-law. Installing a wood furnace without first acquiring a permit may result in fines and penalties applicable under the Land Use By-law and/or the Municipal Government Act. REPEAL As a result of the adoption of this by-law, the by-law "No 25 - Removal of Ashes" is hereby repealed.
