HAMLET OF ENTERPRISE BYLAW # 2023-145 "FEES, CHARGES, AND FINES BYLAW" Approved: June 14, 2023 Motion: #2023-205 HAMLET OF ENTERPRISE FEES, CHARGES, AND FINES BYLAW #2023-145 A bylaw of the Municipal Corporation of the Hamlet of Enterprise in the Northwest Territories to consolidate and otherwise establish the fees, charges and fines payable for the Hamlet's products, programs, services, public utilities, infrastructure, and facilities. WHEREAS pursuant to Section 74(e) of the Hamlets Act, S.N W.T. 2003, c. 22, as amended, whereby the Hamlet may, by bylaw, establish fees or other charges for products, programs, services, public utilities, infrastructure, and facilities provided or done by the hamlet or for the use of property under the ownership, direction, management, or control of the Hamlet; WHEREAS pursuant to Section 74(t) of the Hamlets Act, whereby the Hamlet may, by bylaw, provide for a system of licenses, permits, or approvals including establishing fees that may be in the nature of a reasonable tax for the activity authorized or for the purpose of raising revenue and establishing higher fees for non-residents; and WHEREAS Council deems it expedient and wishes to both consolidate and update the various fees and charges to be collected by the Hamlet of Enterprise; NOW THEREFORE, the Council of the Hamlet of Enterprise, at a duly assembled meeting, hereby enacts as follows: 1. TITLE This Bylaw shall be cited as the "Fees, Charges, and Fines Bylaw". 2. DEFINITIONS "Hamlet" means the Hamlet of Enterprise. "SAO" means the Senior Administrative Officer of the Hamlet of Enterprise. 3. APPLICATION a. The Hamlet hereby establishes and imposes fees for the provision of services, programs, and the use of its property as specified in Schedule "A" to this Bylaw. b. The Hamlet may impose the fees, charges, and fines set out in Schedule "A": Fees, Charges, and Fines Bylaw #2023-145 Page II i. At the time the transaction is initiated; ii. When the service captured by the fee or charge is received; or m. Upon the date specified on any invoice issued by the Hamlet in accordance with this Bylaw. c. Where applicable, federal, territorial, or other taxes will be added to the fees, charges, and fines set out in Schedule "A" to this Bylaw. 4. COLLECTION a. The fees, charges, and fines imposed on a person pursuant to this Bylaw constitute a debt owing to the Hamlet. The Hamlet may actively pursue the collection of outstanding monies in accordance with Hamlet bylaws and policies. b. No request by any person for a program or service as described in Schedule "A" will be processed or provided unless and until the person requesting the program or service has paid the applicable fee, charge, or fine in the prescribed amount set out in Schedule "A", or the SAO has granted permission for the service, program or use of Hamlet property to be provided in advance of an invoice being issued, or has waived the fee in whole or in part. c. Section 4.a. does not apply to public utilities, including but not limited to water and sewage services, or solid waste removal, for which invoicing will be done on a monthly basis for the previous month's services in accordance with the applicable bylaw. d. The SAO may prescribe terms and conditions for billing customers and payment plans that do not otherwise contradict the provisions of the Hamlets Act, this Bylaw, or the Hamlet's policies. 5. SEVERABILITY The provisions of this Bylaw are severable and the invalidity of any part of this Bylaw shall not affect the validity of the remainder of this Bylaw. 6. REPEAL The bylaws set out in Schedule "B" are hereby amended as described in that Schedule. 7. EFFECTIVE DATE This bylaw shall come into force and take effect upon receiving third reading. The Business Licence Bylaw 2012-07 is amended as follows: a. Article 5.1 is deleted, and the following is substituted: 5.1 Except as herein provided, before the Hamlet issues any Business Licence, the applicant shall pay to the Hamlet the fees set forth or calculated in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. b. Article 5.3 is deleted, and the following is substituted: 5.3 Where any Business License becomes defaced, obliterated, or otherwise illegible, or is lost or mislaid, the licensee shall forthwith apply to the SAO for a replacement license, produce the license unless it is lost, and pay a fee in accordance with the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 for a replacement license. c. Article 9.1 is deleted, and the following is substituted: 9.1 Except herein provided, any person who contravenes or disobeys, or refuses or neglects to obey any provision of this Bylaw is guilty of an offence and liable, on summary conviction, to a fine as specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 and in the case of an individual, of imprisonment of a term not exceeding three months. d. Article 9.2 is deleted, and the following is substituted: 9.2 An Officer who has reasonable and probable grounds to believe that a person is violating any provisions of this Bylaw may lay an information and issue a summons by means of a ticket as defined in the Summary Convictions Procedures Act, setting forth the date, time, and place of the offence, briefly stating that payment may be made in accordance with the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. e. Article 9.3 is deleted, and the following is substituted: 9.3 A person, who has received a ticket pursuant to article 9.2 in respect of an alleged offence under this Bylaw, may, within seven days ofreceipt of such ticket, in lieu of appearing in court in answer to the summons, pay the Hamlet such penalty as set forth in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. f. Schedule 'A' is deleted in its entirety. Fees, Charges, and Fines Bylaw #2023-145 Puge 18 g. Schedule 'C' is deleted in its entirety. Fire Protection Bvlaw #2011-24 2. The Fire Protection Bylaw #2011-24 is amended as follows: a. Section 54 is deleted, and the following is substituted: 54. Every person who contravenes any of the provisions of this Bylaw is guilty of an offence and liable on summary conviction to a fine as specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 or to imprisonment not exceeding one month, in default of payment of the fine. Animal Control Bvlaw #2013-41 3. The Animal Control Bylaw #2013-41 is amended as follows: a. Article 7.5 is deleted, and the following is substituted: 7.5 Where any animal is impounded under the provisions of this bylaw, such animal may be recovered by the owner within 48 hours of being impounded on payment of the fees prescribed in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 for the impoundment and for feed and care for each day or portion thereof that the animal was impounded. b. Article 7 .8 is deleted, and the following is substituted: 7.8 In addition to the impoundment fees required to be paid pursuant to this bylaw and the Hamlet's Fees, Charges, and Fines Bylaw #2023-145, prior to the release of an animal from impoundment, the owner shall pay all outstanding fines relating to any infraction against this or any other bylaw. c. Article 7.12 is deleted, and the following is substituted: 7.12 Any animal, other than a dog impounded under the provisions of this bylaw listed in Article 8, may be recovered by the owner on payment of the actual costs of seizure and impoundment together with the fees prescribed in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 for the impoundment, feed, and care for each day or portion thereof that the animal was impounded. If such animal is seized after 6:00 p.m. on the last working day of the week, the fees shall be charged over the course of the weekend. d. Article 8.2 is deleted, and the following is substituted: Fees, Charges, and Fines Bylaw #2023-145 Page 19 8.2 The owner of any animal quarantined pursuant to the rabies control provisions of this bylaw shall be required to pay the prevailing fees as specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 for the entire duration the animal remains in the animal shelter. All fees must be paid in full prior to the animal being released to the owner. e. Article 14.2(a) is deleted, and the following is substituted: 14.2 Any person who commits an offence under this bylaw is, in addition to any other punishment, liable on summary conviction to: (a) A voluntary fine under section 11(8) of the Summary Convictions Procedures Act, issued in respect of an offence specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145; or f. Schedule "A" is deleted in its entirety. Water/Sewer Operating Bylaw #2021-87 4. The Water/Sewer Operating Bylaw #2021-87 is amended as follows: a. Section 9.4(b) is deleted, and the following is substituted: 9.4 The SAO may discontinue service for any of the following reasons: (a) failure to obey an order issued under subsection (3); (b) non-payment of charges or fees levied pursuant to the Hamlet's Fees, Charges, and Fines Bylaw #2023-145; b. Section 14.3 is deleted, and the following is substituted: 14.3 The application for service shall include the application for service fees specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 and any other appropriate fees, charges or deposits provided for in this bylaw. c. Section 17 .1 (b) is deleted, and the following is substituted: 17 .1 In order to establish temporary service for construction or any purpose, the owner shall: (a) submit an application for service to the SAO stating the expected duration service is required; (b) pay the application for service fee specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 and any other appropriate fees; and d. Section 19.4 is deleted, and the following is substituted: Fees, Charges, and Fines Bylaw #2023-145 Page I JO 19.4 No water shall be resold or conveyed beyond property served without written permission from the SAO. The Hamlet may charge a surcharge for resold water at a rate established in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 . e. Section 26.1 ( d) is deleted, and the following is substituted: 26.1 The SAO shall establish scheduled times for the provision of services to each customer or area of the Hamlet. The frequency of water delivery & sewage collection service, if applicable, shall be as follows: ( d) Every customer requiring service at a time other than scheduled time for such customer shall be levied a callout fee specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 in addition to the normal service charge. f. Section 32.3 is deleted, and the following is substituted: 32.3 Failure to allow or maintain sufficient access for the services to connect to the buildings shall be levied a callout fee specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. g. Section 35.1 is deleted, and the following is substituted: 35.1 Service charges shall be levied in accordance with the rates specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. h. Section 36.1 is deleted, and the following is substituted: 36.1 Bills for service charges, fees and all other penalties and charges levied pursuant to the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 are due and payable no later than 30 days after the date of billing. i. Section 36.3 is deleted, and the following is substituted: 36.3 Overdue bills shall be subject to the late payment charge specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. J. Section 3 7 .1 is deleted, and the following is substituted: 37.1 The owner of a premises receiving water and/or sewer services shall be liable for all service charges, fees and all other penalties and charges levied pursuant to the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 and the Hamlet may make the balance of any account in arrears over sixty (60) days a charge against the owner. k. Section 38.1 is deleted, and the following is substituted: Fees, Charges, and Fines Bylaw #2023-145 Page Ill 38.1 Enforcement of payment of service charges, fees and all other penalties and charges levied pursuant to the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 may be by: (a) discontinuance of water and sewer services after ninety (90) days from the date of mailing of the bill, in respect of which payment is in default plus the imposition of a late payment charge as specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145; or (b) action in any court of competent jurisdiction. I. Section 41.1 is deleted, and the following is substituted: 41.1 The customer shall notify the SAO in writing of any change in the use, occupancy, site served, or any other matter which may affect the service charges or fees payable under the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. m. Section 43.1 is deleted, and the following is substituted: 43.1 Any customer or person who contravenes any provision or requirement of this bylaw is guilty of an offence and upon summary conviction is liable to a fine and/or imprisonment as detailed in the Hamlet's Fees, Charges, and Fines Bylaw #2023- 145. Solid Waste Bvlaw #2021-88 5. The Solid Waste Bylaw #2021-88 is amended as follows: a. Section 5.2(b) is deleted, and the following is substituted: 5.2 The SAO is authorized and directed to: (b) deny the use of a Solid Waste site and/or collection Services, on either a temporary or permanent basis, to any Person who violates any of the terms of this Bylaw, including failing to pay the prescribed fees set in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145; b. Section 9.3 (b) is deleted, and the following is substituted: 9.3 The SAO may discontinue service for any of the following reasons: (b) non-payment of charges or fees levied pursuant to the Hamlet's Fees, Charges, and Fines Bylaw #2023-145; c. Section 16.1 ( c) is deleted, and the following is substituted: Fees, Charges, and Fines Bylaw #2023-145 Page I 12 16.1 The SAO shall establish Scheduled times for the provision of Services to each Customer or area of the Hamlet. The Hamlet collects Residential and Commercial Solid Waste once per week on Wednesdays. ( c) Every customer requiring service at a time other than Scheduled time for such customer shall be levied a callout fee specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 in addition to the normal service charge. d. Section 21. l is deleted, and the following is substituted: 21.1 Service charges shall be levied in accordance with the Rates specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. e. Section 21.2 is deleted, and the following is substituted: 21.2 Unless otherwise provided for in this bylaw or the Hamlet's Fees, Charges, and Fines Bylaw #2023-145, service charges shall be due and payable monthly. f. Section 22.1 is deleted, and the following is substituted: 22.1 Bills for service charges, fees and all other penalties and charges levied pursuant to the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 are due and payable no later than 30 days after the date of billing. g. Section 22.3 is deleted, and the following is substituted: 22.3 Overdue bills shall be subject to the late payment charge specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. h. Section 23. l is deleted, and the following is substituted: 23. l The Owner of a Premise receiving Solid Waste Services shall be liable for all service charges, fees and all other penalties and charges levied pursuant to the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 and the Hamlet may make the balance of any account in arrears over sixty (60) days a charge against the Owner. 1. Section 24.1 is deleted, and the following is substituted: 24.1 Enforcement of payment of service charges, fees and all other penalties and charges levied pursuant to the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 may be by: (a) discontinuance of Solid Waste Services after ninety (90) days from the date of mailing of the bill, in respect of which payment is in default plus the imposition of a late payment charge as specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145; or Fees, Charges, and Fines Bylaw #2023-145 Page 113 (b) action in any court of competent jurisdiction. J. Section 25.1 is deleted, and the following is substituted: 25.1 The customer shall notify the SAO in writing of any change in the use, occupancy, site served, or any other matter which may affect the service charges or fees payable under the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. Zoning Bylaw #2023-146 6. The Zoning Bylaw #2023-146 is amended as follows: a. Section 4.6(1) is deleted, and the following is substituted: 4.6 ( 1) Each application for a Development Permit shall be accompanied by a fee, as stipulated in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145. No application will be accepted unless said fee is paid in full. a. if a requested amendment to an existing development permit is deemed minor in nature by the Development authority, the requirement for a new development permit application may be waived by the Development Officer. b. Section 4.14(2) is deleted, and the following is substituted: 4.14 (2) All applications to amend any part of this Bylaw, except those initiated by Council or the Development Officer, shall be made in writing and accompanied by the following: a. an application fee as specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145 plus the requisite development permit application costs; b. a current certificate of land title indicating ownership and other interests; c. the applicant's name, address and interest in the property; d. a security deposit to be determined on a case by case basis for all costs incurred by the Hamlet in processing the proposed amendment, whether it be enacted or not, including, but not limited to, all mapping, printing, reproduction, surveys, planning consultants, reports and advertising costs; and e. all drawings required to be submitted shall be drawn on standard drafting material to the satisfaction of the Development Officer and shall be fully dimensioned, accurately figured, explicit and complete. c. Section 4.16(2) is deleted, and the following is substituted: 4.16 (2) A person who commences a development and fails to obtain a Development Permit, or who fails to comply with a condition of a Development Permit granted under this Bylaw, is guilty of an offence under Section 77 of the Act, is liable on Fees, Charges, and Fines Bylaw #2023-145 Page 114 summary conviction to punishments set out in Section 78 of the Act and subject to the fines specified in the Hamlet's Fees, Charges, and Fines Bylaw #2023-145.
