## MUNICIPAL CORPORATION OF THE VILLAGE OF FORT SIMPSON BY-LAW NO. 577
A BY-LAW OF THE MUNICIPAL CORPORATION OF THE VILLAGE OF FORT SIMPSON IN THE NORTHWEST TERRITORIES TO PROVIDE FOR TRAFFIC CONTROL WITHIN THE MUNICIPALITY OF FORT SIMPSON
WHEREAS PURSUANT TO the Motor Vehicles Act, R.S.N.W.T. 1988 c. M-l6, and the Cities, Towns and Villages Act, R.S.N. W.T.. 1988 c. C-&, the Village of Fort Simpson, being a. municipal corporation, may make by-laws in respect of any highways within the municipality.
NOW THEREFORE the Council of the Village of Fort Simpson, in a duly asseinbled meeting: enacts as follows:
## SHORT TITLE
1. This by-law may' be cited as the "Village Of Fort Simpson Traffic By-law".
2. In this By-law;
3. (a) BY-LAW OFFICER. - means any person or their designated depuiy, employed or designated by the Council and authorized to enforce the provisions of this by-law, or a member of the Royal Canadian Molinted Police.
- (0) COUNCIL - means the Council of the Municipal Corporation of the Village of Fort Simpson.
5. (c) CROSSWALK - marked or unmarked, means;
- (1) that part of a roadway at an intersection that is included within the connection of the lateral lizes of the sidewalk on the opposite sides of a nighway, measured from the curbs, or in the atsence of curbs, from the edge of the roadway; or;
7. (ii) any part of a roadway at an intersection or eisewhere as indicaid for pedestrian crossing by signs, or by line, or by other markings on the surface of the highway.
8. (d) DRIVER - means a person who operates or is in actual physical control of a vehicle.
9. (e) HANDICAPPED PERSON'S VEHICLE - means any vehicle which displays a special license plate, card or sticker depicting the international symbol of the handicapped, issued by the Government of the Northwest Territories, the Village of Fort Simpson or any other competent Government body.

- (f) HIGHWAY - means a road, place, bridge or structure, whether publicly or privately owned, that the public is ordinarily entitled or permitted to use for the passage of vehicles and includes;
- (g) a privately owned area, other than the driveway of a private dwelling that is designated and intended and primarily used for the parking of vehicles and the necessary passageways therein.
- (h) INTERSECTION - means the area embraced within the connection of
- (i) JUSTICE - means a Judge of the Territorial Court or a Justice of the Peace.
- (i) LARGE VEHICLE - means a vehicle having a loading capacity in excess of 1,000 kilograms.
- (k) MOTOR VEHICLE - means any vehicle propelled by any power other than macular power, except aircraft and motor vehicles that run only upon rails.
- (1) PARK - in respect of a vehicle, means the stopping of a vehicle whether occupied or not except where;
- (ii) a publicly owned area designated and intended to be used exclusively for the parking of vehicles and the necessary passageways therein.
- (iii) a sidewalk, pathway, ditch or shoulder adjacent to and on either side of the traveled portion of the road or place and the area between the sidewalk, pathway, ditch or shoulder and the traveled portion of the road or place; and
- (iv) a road on a frozen body of waier or water course or a road that can be used for only a portion of a year.
- (i) lateral curb lines, or, if none,
- (ii) exterior edges of the roadway of twe or more highways joining one another at an angle, whether or not one highway crosses the other.
- (i) the vehicle is stopped in accordance with an officer or traffic control device.
- (ii) the flow of traffic requires the vehicle to be stopped; or
- (iii) the vehicle is temporarily stopped for the purpose of and while engaged in, loading and unloading.

## (m) PEACE OFFICER - means:
- a member of the Royal Canadian Mounted Police; (i)
- (ii) a By-law Officer in respect of an offence under a municipal by-law;
- (iii) a person prescribed as a Peace Officer, or one of a class of persons prescribed as a Peace Officer.
- (n) PEDESTRIAN - means a person on foot or in a wheelchair and includes a child in a carriage or carried by a person on foot.
- (0) PLAYGROUND AREA - means a zone on a highway identified by a traffic control device as an area wherein children may be expected to be on the highway or are permitted to cross the highway at a designated point along the highway.
- (p) ROADWAY - means the part of highway that is improved, designated or ordinarily used for vehicle traffic but does not include the shoulder.
- (9) SCHOOL BUS - means a motor vehicle used to convey students to or from school or any other place approved by the authority in charge of the school that the students attend where;
- (1) the vehicle is owned or operated by the authority in charge of the school;
- (ii) the vehicle is operated pursuant to a contract with tine authority in charge of the school.
- (1) SCHOOL PATROL - means a person delegated by a school or community education council to assist pedestrians crossing highways in a school zone.
- (s) SCHOOL ZONE - means a zone on a highway identified by a tratic control device as an area wherein children may be expected to be on the highway, or are permitted to cross the highway at a designated point along the highway in the vicinity of an educational institution.
- (t) SENIOR ADMINISTRATIVE OFFICER - means the senior administrative officer of the Village of Fort Simpson and includes any person duly appointed as Acting Senior Administrative Officer pursuant to the Cities, Iowns and Villages Act, R.S.N. W.T. 1988, c.C-8.
- (4) SIDEWALK - means the part of a highway especially adapted to the use of, or ordinarily used by, pedestrians, and includes that part of a highway between a curb line (or the edge of the roadway where there is no curb line) and the adjacent property line, whether or not paved or improved.

- (v) STOP - means;
- (i) when required, a complete cessation of vehicle movement;
- (ii) when prohibited, any halting, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the direction of a Peace Officer or traffic
- (w) THROUGH HIGHWAY - means a highway, or part of a highway, for which traffic is not required to yield or stop at intersections.
- (x) TRAFFIC CONTROL DEVICE - means a sign, signal, marking, notice or device placed, posted or erected by authority of a public body or official having jurisdiction for the purpose of regulating, warning or guiding traffic or pedestrians.
- (y) TRAFFIC CONTROL DEVICE REGISTER - means a record maintained by the Bylaw Officer of the Village, identifying the nature and approximate location of all traffic control devices in the Village placed pursuant to a motion of Council.
- (2) VEHICLE - means a device in, upon or by which a person or thing may be transported or drawn upon a highway, whether or not propelled or driven by any kind of power, including human power. All terrain vehicies are excluded from this definition.
- (ZZ) VILLAGE - mears the Municipal Corporation of the Village of Fort Simpson.
- Except where expressly provided for herein, terms used in this by-law shall have the same meaning as defined in the Interpretation Act, R.S.N. W.T. 1988, c. 1-8, the Motor Vehicles Act, R.S.N.T. 1988, c, M-16 and the Cities, Towns and Villages Act. R.S.N.W.T. 1988, c. C-8.
- All schedules to this by-law form a part of this by-law.
## TRAFFIC CONTROL DEVICES
- (a) Council, by motion, may direct the placement of tratie control devices at such locations. and of such nature, as Council may deem necessary.
- (b) The By-law Officer shall maintain a Traffic Control Device Register which shall be open to public inspection during normal business hours.

- (c) Upon receiving direction from Council to erect, move or remove a traffic control device, the By-law Officer shall cause an advertisement to be placed in 2 consecutive issues of a local newspaper.
- (d) It is an offence for any person to park or operate a vehicle in a manner contrary to instructions or prohibitions contained on, or indicated by, any traffic control device.
- All traffic control devices shall be directed by council for placement and installation and shall conform to the requirements of the Uniform Traffic Control Device For Canada, as distributed by the Transportation Association of Canada.
- No person shall tear down, deface, destroy or in any way, change a traffic control device, either permanent or temporary that has been erected or posted under this by-law.
## RULES FOR STOPPING AND PARKING
- Unless necessary, to avoid conflict with other traffic or to comply with the law; or with the directions of a Peace Officer or traffic control device, no person shall, within the Village;
- (a) operate a motor vehicle on any school property, playground, park, or beach area, as designated by a resolution of Council, or by an Act, Regulation or Order in Council of the Northwest Territories or Canada, except for that area that has been established as a parking area for such vehicles;
- (b) stop, stand or park a vehicle;
- (1) in front of a public or private driveway;
- (ii) within an intersection;
- (iii) on a sidewalk:
- (iv) within 3 (three) metres from a fire hydrant;
- (v) within a crosswaik or within 5 (five) metres of a crosswalk;
- (vi) within 5 (five) metres in front of a stop or yield sign or traffic light located at the side of the roadway;
- (vil) within 3 (three) metres of a driveway to a fire station on the side of a street on which the fire station is located;

- (vili) adjacent to or opposite a street excavation or obstruction, where parking obstructs the flow of traffic;
- (ix) on the highway side of a vehicle parked at the curb or edge of a roadway;
- (x) on a bridge or other elevated structure; or
- (xi) in front of a ramp designated for use by a physically disabled person.
9. No person shall park a vehicle upon any part of a highway other than an alley;
- (a) where the roadway is 6 (six) metres or less in width; or
- (b) in such a manner, or under such conditions, as to leave available, less than 3 (three) metres of the width of roadway for free movement of vehicle traffic.
10. No person shall park a vehicle on a highway unless the vehicle is parked;
- (a) headed in the direction of traffic for the side of the highway on which the vehicle is parked; and
- (b) at least 1 (one) metre from any other vehicle on the highway to the front or the rear of the vehicle or, where the vehicle is parked at an angle to the curb, at least 1 (one) metre from any other vehicle to the left or right of the vehicle, unless
- (c) the vehicle is a commercial vehicle engaged in loading or unloading merchandise where it is impractical to comply with this section, or
- (d) a traffic control device permits parking.
11. (a) Subject to sub-section 11(b), no person shall allow a vehicle to be abandoned or parked for more than 24 (twenty four) hours for any reason on any highway.
- (b) A person who is the owner, lessor or occupant of private residential property, may park not more than one motor vehicle of 1,000 kilograms or less immediately adjacent to the property owned, leased or occupied by them, provided that the motor vehicle is at least 1 (one) metre away from the edge of the roadway and complies with all of the other provisions of this by-law.
12. No person shall move a vehicle into any prohibited area or such distance away from a curb as to make the vehicle illegally parked.

13. No person shall, in respect of any large vehicles, run its engine for more than a total period of 10 (ten) minutes between sunset and sunrise on any day while the large vehicle is parked within 50 (fifty) metres of a residential dwelling.
14. No person shall park any vehicle, including but not limited to, a trailer or other appurtenance thereto, is used for the conveyance of flammable, combustibię, explosive or other dangerous material, whether loaded or unloaded, except while the vehicle. trailer or appurtenance thereto, is loading or unloading in an expeditious manner in the ordinary course of business.
15. (a) No person shall park or leave a motor vehicle on private property without authority from the owner, tenant, occupant or person in charge or control of the private property.
4. (b) The owner of a vehicle which is parked or allowed to remain parked in violation of this by-law is liable for the violation unless it is shown that at the time of the violation, the vehicle was not being operated by the owner or by any other person with consent of the owner, expressed or implied.
15. No person shall use any street for vehicle repair or vehicle maintenance, except for making emergency repairs.
## *RULES FOR DRIVING AND OPERATION
17. (a) No person shall operate a vehicle on any higliway at a speed greater than that shown on a traffic control device which indicates the maximum speed for the highway or any portion thereaf.
2. (b) Unless a lawfully installed traffic device provides otherwise, no person shail operate a vehicle in the Village at a speed greaier than 40 (forty) kilometers per hours.
18. (a) No person shall ride and no driver shall permit a person to ride on the outside of a motor vehicle or in the box of a truck.
4. (b) Subsection 18 (a) does not apply in respect of a person riding;
5. (i) on the seat of a motorcycle.
6. (c) on a construction vehicle or a motor vehicle engaged in the maintenance of a highway.

- (d) on an enforcement or emergency vehicla.
- (e) on a motor vehicle forming part of a parade that has been approved by the proper authority; or
- (f) on a motor vehicle that is part of a garbage disposal service and the vehicle is being used to collect garbage.
19. When water, mud or slush is lying on a highway, no driver shall drive on a highway in a manner so as to splash any pedestrian using the sidewalk or crosswalk.
20. No person shall tow a vehicle on a highway in an unsafe manner, or with an unsafe tow rope, tow chain or other connecting device.
21. No person shall drive or park or leave any vehicle on a sidewalk:
22. A driver, on meeting a school bus that,
- (a) is headed in the same or opposite direction as the driver, and
- (b) has its flashing lights in use, shall;
- (i) stop his or her vehicle before it reaches the bus, and
- (ii) not proceed until the flashing lights are no longer in lise.
## DAMAGE TO HIGHWAY
23. (a) No person shall operate a vehicle on a highway if the vehicle could cause damage to the street surface, unless the person has obtained a permit for the operation of such a vehicle from the Village.
2. (b) The issue of a permit pursuant to this section shall be at the discretion of the Senior Administrative Officer and shall be issued under such terms and conditions as the Senior Administrative Officer deems necessary in the circumstances.
## RULES FOR CROSSWALKS
24. No driver of a vebicle shall enter an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accommodate the vehicle operated without obstructing the passage of other vehicles or pedestrians.

## MOTOR VEHICLES ACT TO APPLY
25. Unless otherwise designated herein, all traffic control devices shall be interpreted mutates mutandis, pursuant to the Motor Vehicles Aci, R.S.N.W.T. 1988 c. M-16.
## RULES FOR DISABLED PERSONS PARKING AREAS
26. No person, except the person operating a disabled person's vehicle, shall park in a lesignated disabled person's parking area, as designated by a traffic control devic or other marking, identifying an area for the exclusive parking of disabled persons vehicles.
## PARADES AND PROCESSIONS
27. (a) No person shall hold or take any parade or procession without first obtaining a permit from the Village and then only subject to any such terms and conditions as the Village may designate.
2. (b) Every member of a parade or procession, and the organization and leaders therefore, shall be guilty of an offence for a parade or procession held in violation of this section.
3. (c) No person shall drive a motor vehicle between the vehicles or persons comprising an authorized parade or procession while it is in motion, except at intersections where traffic is controlled by traffic controi devices or a Peace Officer.
## SCHOOL ZONES AND PLAYGROUND ZONES
28. (a) Council may, by motion, direct that an area be designated a school zone or playground area.
2. (b) No person shall operate a vehicle within a school zone in excess of 30 (thirty) kilometres per hour between the hours of 8:00 a.mn. and 5:00 p.m. or as otherwise posted.
3. (C) No person shall operate a vehicle within a playground area zone in excess of 30 (thirty) kilometres per hour.
4. (d) Any person operating a vehicle on a highway within a school zone shall yield the right of way to pedestrians crossing the highway under the direction, protection or control of a school patrol.
5. (e) Any person operating a vehicle on a highway within a school zone shall obey the instructions of a school patrol in the exercise of their functions.

## ILLEGAL PASSING
29. (a) A driver shall not pass, or attempt to pass, another vehicle travelling in the same direction when in that portion of a highway which has been marked as a school zone-or a playground area zone, or
2. (b) A school zone or playground area zone,
3. (i) begins where there is a traffic control device indicating the school zone or playground area zone, and
4. (ii) ends where there is a traffic control device indicating a greater rate of speed, or at the end of the zone.
## RULES FOR PEDESTRIANS
30. Every pedestrian crossing a highway shall cross as quickly as reasonably possible without stopping or loitering: or otherwise impeding the free movement of vehicles thereon.
31. A pedestrian crossing a roadway at a crosswalk shall have the right of way over any vehicle for the purpose of crossing the roadway within the crosswalk, unless otherwise directed by a Peace Officer or traffic control device, but nothing in this section relieves a pedestrian from exercising due care for his own safety.

## REMOVAL AND DISPOSAL OF INOPERABLE VEHICLES
34. Pursuant to the Cities, Towns and Villages Act, R.S.N.W.T. 1988, Sections 178 to 180;
2. (a) Any Peace Officer may remove, or cause to be removed, any vehicle fiem a highway at the risk and expense of the owner of such vehicle to the nearest service garage, Village Public Works compound or other place of safety where such motor vehicle is parked in contravention of the by-law.
3. (b) Any Peace Cfficer may remove, or cause to be removed, any vehicle that is;
4. (i) inoperable, wrecked or dismantled and;
5. (ii) not located in a building, and

- (il) does not form part of a business lawfully operated on the premises;
at the risk and expense of the owner, occupant or person in charge or care of the vehicle and without liability to the owner of the premises from which the vehicle was removed.
- (c) A motor vehicle parked on private property without the consent of the owner, occupier or person in charge of such property may be removed and impounded upon the written request of the owner, occupier, or person in charge of the property, to a Peace Officer.
- (d) Any vehicle removed as provided for in sub-section 34 (b) and 34 (c) may be disposed after every reasonable effort has been made to contact the affected person and after the council allows any affected persen, or representative of that person,an opportunity to be heard.
- (e) A Notice must be served on any person affected at least 3 (three) days before the date of the hearing.
- (f) The notice must set out the time and place of the hearing and advise the person of the purpose of the hearing and the right of the person to attend and make representation.
- (g) The notice must be served personally or, where personal service cannot be effected because the address of the person is not known, the notice may be published in a newspaper having general circulation in the municipality. or the Territories.
- (h) The hearing must be conducted by the council.
35. Where the council, or a person who may be authorized to take the action referred to in section 34, is of the opinion that there is immanent danger to public health and safety;
- (a) the action may be taker: without the notice and hearing required in Section 34.
36. An appeal may be taken from a decision made under Section 34, to a Judge or the Supreme Court by way of originating notice under the Rules of the Supreme Court.
- (a) The appeal must be made not later than 30 days after the decision.
- (b) Subject to Section 35, no person shall take any action referred to in Section 34 (d);
- (i) the period for taking an appeal has expired and no appeal has been taken; or

- (ii): any appeal taken has been dismissed by a Judge of the Supreme Court.
## TRAFFIC TICKET
37. (a) A Peace Officer who finds a person violating, or who has reasonable grounds to believe that a person has, or may have, violated any provisions of this by-law, may give the person written notice of intention to prosecute by mears of a ticket in accordance with the Summary Conviction Procedures Act R.S.N.W.T. c. S-15.
2. (b): The notice in the form of a ticket shall be deemed to be sufficiently served;
3. (i) if served personally on the accused; or
4. (ii) if mailed to the address of the registered owner of the vehicle concerned or to the person concerned; or
5. (iti) if attached to, or left upon, the vehicle in respect of which the offence is alleged to hava been committed.
6. (c) The ticket shall state the sum of a voluntary payment, if any, which may be in respect of any contravention of this hy-law as may be provided in Scheonle "A" attached to atd forming part of this by-law.
7. (d) The voluntary payments as provided for in Schedule "A" of this by-law, do not consuitute a specified penaliy pursuant to the Cities, Towns and Villages Act R.S.N. W.T. 1988,c. C-8 and a Justice may, upon conviction for an offence pursuant to this hy-law, impose a fine as permitted by law, as the Justice deers
8. ". 38. Any person who has received notice in the form of a tcket, may pay to the Senicr Administrative Officer within 7 (seven) days after receipt of such notice, the voluntary payment specified therein, if any, in lieu ofiprosecution for any contravention of this by-law.
## PENALTY
39. Except as may otherwise be specifically provided for in this by-law, every person convicied of an offence contrary to any section of tilis by-law, shall be hiable to a fine not exceeding $1,000.00 (one thousand dollars) or, in defauit, imprisonsent for a period not exceeding 3 (three) months.

## EXEMPTIONS
40. Nothing in this by-law applies to persons, or to vehicles and other equipment, walle engaged upon any work or construction, maintenance or clearance of a highway while at the site of the work where it is reasonably necessary to disregard the provisions of this by-law and the work has been authorized by the Senior Administrative Officer.
41. All traffic control devices identified in Schedules "B" to "Z" of this by-law, shall upon final reading, be deemed to be duly authorized by Council and shall be, from time to. time, amended and, as soon as practical, be recorded in the traffic control device
42. By-law No. 6 is hereby repealed.
