## HAMLET OF TUKTOYAKTUK BY-LAW # 412-23 ************************************************ A by-law of the Municipal Corporation of the Hamlet of Tuktoyaktuk in the Northwest Territories to establish and levy charges for services provided by the Municipal Corporation, pursuant to the provisions of the Hamlets Act, S.N.W.T., 2003, c. 22, s.72 and ************************************************************************************************************* WHEREAS the Hamlet of Tuktoyaktuk desires to establish rates to be charged for various services provided by the Municipal Corporation; NOW, THEREFORE, THE COUNCIL OF THE HAMLET OF TUKTOYAKTUK, at a duly assembled meeting enacts as follows: ## SHORT TITLE - This by-law may be cited as the "Municipal Service Rates By-Law". ## INTERPRETATION - In this by-law, | a) "Compassionate Use" | to be determined by SAO; | |--------------------------|------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | b) "Council" | means the Council of the Hamlet; | | c) "Hamlet" | means the Hamlet of Tuktoyaktuk; | | d) "Local" | means a person who resides in the community of Tuktoyaktuk | | e) "Industry" | non-commercial, non-government, non-resident of Tuktoyaktuk who requests services for themselves and is not performing or obtaining those services for remuneration from a non-local or third party; | | f) "Mayor" | means the Mayor of the Hamlet; | | g) "Non-Local" | means any government, business, or industrial company resident or not who requests services; | | h) "Property" | means real or personal property owned by the Hamlet; | | i) "Rates" | means the charges for services provided; | | j) "Schedule" | means the schedule attached to and forming part of this by-law; | | k) "Services" | means municipal services provided; | | 1) "SAO" | means the Senior Administrative Officer of the Hamlet; | | m) "Staff" | Means an employee or employee of the Hamlet; | | n) "User" | means the sole entity that is making the booking. | ## GENERAL PROVISIONS 3. Charges for specified services and rental of municipal property shall be levied in accordance with "Schedule A through C" attached to and forming part of this by-law. 4. The SAO, subject to approval of Council and/or Executive Committee, may make arrangements for long term services, specific projects, non-profit, or special needs cases as required from time to time outside of the rates specified in "Schedule A through C Rates Schedules" 5. All services are offered based on availability of equipment, personnel and materials, with Municipal and Emergency services having first priority over services offered to the public. 6. The SAO, subject to approval of Council and/or Executive Committee, may require deposits, prepayment for estimated services, or rejection of services to any customer who has any outstanding amounts of accounts receivable owing to the Hamlet for a period greater than 90 days. 7. All invoiced amounts for the provision of services listed in Schedule A will be subject to an administration fee of 15% and will also be subject to interest of 2 (two) percent per month for amounts outstanding for more than 30 days. Terms are net 30. 8. Cash payment in advance for services will only be charged a 10% administration fee and will only be accepted at the Hamlet Office. 9. All services provided are subject to the Government of Canada Goods and Services Tax (GST) and will be added onto rates shown. 10. All services offered in this bylaw will be adjusted by 15% over the rates set by private sector businesses. The Hamlet will review rates when changes occur in the private sector rates. 12. All previous bylaws and amendments are now hereby repealed. 11. This by-law supersedes all other rates listed herein effective the date of third reading. 13.
