Hamlet of Cambridge Bay By-Laws By-Law - No. 82 Animal Control Page 1 By-Law Name: Animal Control By-Law Number: 82 Description Being a bylaw to prevent cruelty to animals, to regulate exotic animals, and to control the location and handling of animals, particularly dogs, within the Hamlet. By-Law Whereas the Council of the Hamlet of Cambridge Bay finds it necessary and expedient to issue regulations concerning cruelty to animals, the type of animal that can located within the community, and the location and control of dogs within the community; Therefore, the Council of the Hamlet of Cambridge Bay, at a duly assembled meeting, enacts as follows: 1. Short Title This Bylaw may be known as the Animal Control Bylaw. 2. Interpretation a) "Adult" means any animal three months of age or older. b) "Animal" means any domesticated animal and includes, but is not limited to dogs and cats. c) "Collar" means a band attached about the neck of an animal with a metal ring attached to it. d) "Council" means the Council of the Hamlet of Cambridge Bay. e) "Dog" means a male or female dog, of any age, or a cross between a dog and a wolf. f) "Dog Tag" means a metal numbered tag issued by the Hamlet which identifies ownership of a dog and for which a prescribed fee has been paid. Hamlet of Cambridge Bay By-Laws By-Law - No. 82 Animal Control Page 2 g) "Dog Team" means any group of three or more adult dogs used primarily for recreation or for subsistence living. h) "Hamlet" means the Hamlet of Cambridge Bay. i) "Leash" means a line of chain, leather or other ??? within a one (1) meter area. j) "License" means a license issued by the Hamlet to an owner of a dog who has met all qualifications. k) "Muzzle" means a device used to cover the mouth of an animal so as to prevent the animal from biting. l) "Neutered" means an animal certified by a licensed veterinarian or other competent official to be sexually sterile. m) "Owner" means that person who owns, harbors, possesses or otherwise has care or custody of an animal whether temporary or permanent. n) "Officer" means a person appointed by the Hamlet to enforce bylaws and other regulations. o) "Running at Large" means any dog or groups of dog roaming at will off the premises of the owner, either permanently or temporarily, not under the physical control of a person, not securely confined within a structure or not securely tethered so that it cannot roam at will. p) "SAO" means the senior administrative officer for the Hamlet. q) "Schedule" means a schedule attached to and forming part of this bylaw. r) "Vaccination" means inoculation of an animal against a specific disease(s) and the certificate attesting to the inoculation issued by a qualified person including, but limited to a member of the RCMP, a veterinarian, an enforcement officer. s) "Working Dog" means an animal used primarily for transportation in the gathering of food for subsistence living. 3. Prevention of Cruelty to Animals 3.1 No person shall leave an animal without nutritious food and palatable water for a period of longer than 48 hours. Hamlet of Cambridge Bay By-Laws By-Law - No. 82 Animal Control Page 3 3.2 No person shall abuse an animal or punish an animal to an extent that is cruel or unnecessary. 3.3 No person shall tether an animal by a chain or other material which is less than two (2) meters in length. 3.4 No person shall confine a puppy in pen less than two (2) meters on either side and one and a half (1.5) meters in height; or confine an adult dog in a pen less than three (3) meters on either side or two (2) meters in height, or with an enclosed ceiling not, less than twice the height of the dog. 4. Health and Welfare of Humans 4.1 No person shall allow outside a permanent pen any dog which is known or likely to bite a person without provocation unless the animal is wearing a proper muzzle. 4.2 An owner shall secure any dog to the confines of the owner's property, unless otherwise allowed or required to do so by terms of this bylaw. 4.3 No person shall walk a dog within the Hamlet unless the dog is controlled by a leash. 4.4 No person shall secure a dog in such a manner that the dog prevents passage in an area where passage has generally been free, or so as to inhibit the, delivery of municipal or other services. 4.5 All owners shall maintain their property or the designated area in which their animals are maintained in such a way that there is no unsightliness, health hazard, or danger to the general public or other animals. 4.6 All owners shall ensure that dogs over the age of four (4) months are inoculated for rabies and that inoculations are given regularly in accordance with a schedule of immunization. 5. Licensing 5.1 All owners shall acquire the Hamlet's prescribed dog license for any adult dog. 5.2 No license shall be issued unless: a) there is a valid vaccination certificate for ??? b) the owner completes the required application form as shown in Schedule 1, Form A. c) the owner pays the prescribed fee as shown in Schedule 3. Hamlet of Cambridge Bay By-Laws By-Law - No. 82 Animal Control Page 4 5.3 The SAO or other Hamlet official shall issue a dog tag in conjunction with every license issued. 5.4 A dog tag issued under section 5.3 is not transferable between dogs. 5.5 A dog tag issues under Section 5.3 is valid only until March 31 of the third year following its issue. 5.6 Every dog shall have the tag issues for it attached to its collar at all times. 5.7 No owner or other person shall remove a valid tag from the dog's collar or transfer such tag to another dog except as provided under this bylaw. 5.8 Where the SAO or other Hamlet official is satisfied that a tag has been lost, stolen or other misplaced, or destroyed or disfigured, a new tag shall be issued in replacement provided the owner has completed the appropriate application form and paid the appropriate fee. 5.9 Where an owner changes address or telephone number, the owner shall report the change and fill out the appropriate license form within seven (7) days of the change of address or telephone number. 5.10 Where the ownership of a dog changes, the new owner shall inform the SAO and complete the required licensing form within seven (7) days of the change of ownership. 6. General Provisions 6.1 No personal shall tether, or allow being tethered more than two (2) adult dogs on premises at any given time without written approval of the SAO or designating. 6.2 No person shall tether a dog on land other than the premises of the owner, without expressed approval of the owner or tenant of that property. 6.3 No person shall tether a dog on Crown Land ??? place specifically designated by Council. 6.4 No person shall interfere with, obstruct or attempt to obstruct an Officer who is lawfully engaged in the pursuit or destruction of an animal according to the terms of this bylaw. 6.5 No person shall unlock, unlatch or otherwise open a vehicle or pound in which an animal has been impounded without the expressed permission of an Officer. Hamlet of Cambridge Bay By-Laws By-Law - No. 82 Animal Control Page 5 6.6 No person shall knowingly induce or coax an animal into a house or other enclosure for the expressed purpose of keeping the animal from being capture, impounded or destroyed according to the terms of this bylaw. 6.7 No person shall falsely represent himself as being the owner of an animal so as to establish that the animal is not running at large or is roaming at will. 6.8 It is not a defense to a charge under this bylaw that the person accused: a) took all reasonable steps to prevent the animal from engaging in prohibited activity; or b) honestly and reasonably believed the that animal would not be able to engage in prohibited activity. 7. Enforcement 7.1 No person shall allow a dog to run at large within the Hamlet. 7.2 No person shall remove a dog from its tether or from its enclosure so that the dog may run at large. 7.3 Where an officer determines that a dog is running at large, the officer will make all reasonable attempts to notify the owner, if known to the officer and shall instruct the owner, in writing, to tether the dog immediately, failing which the Officer shall impound the dog for a period of not more than three days. 7.4 An owner of an impounded dog shall recover the dog and pay associated costs within twenty-four (24) hours of receiving the written notification. 7.5 Where an owner cannot be located or is unknown to the officer, the officer may impound the dog at the Hamlet pound for a period not to exceed three days. 7.6 If the owner of an impounded dog cannot be located or refuses to recover the dog, the Officer shall destroy the dog and impose any penalties permissible under this bylaw, and no damages or compensation may be recovered on account of the destruction. 7.7 Where is dog is unlicensed, and carries no tag, or is otherwise not identifiable and is seen as a nuisance or menace, the officer may destroy the dog immediately and no damages or compensation may be recovered on account of the destruction. 7.8 Should an owner be identified subsequent to the destruction of a dog, the Officer may impose any penalties permissible under this bylaw on that owner. 7.9 An officer is not responsible for identifying a dog or an owner if there is no valid tag attached to the dog's collar. Hamlet of Cambridge Bay By-Laws By-Law - No. 82 Animal Control Page 6 7.10 When an owner determines that his dog is running at large and cannot locate the dog, the owner shall immediately inform the SAO or an Officer giving a description of the dog. 7.11 Where the SAO or an Officer determines, by inspection or complain, that a dog is making excessive noise or is in contravention of the Noise Control Bylaw or other similar legislation, the owner shall be Informed in writing to remedy the matter immediately. 7.12 Where an owner has failed to comply with two (2) written warnings as provided in section 7.11, an Officer may impound the dog or take such other action as may be necessary to remedy the matter. 7.13 When, in the opinion off an Officer, public safety is in Jeopardy or any member. of the public is caused to fear by the presence of a dog running at large, the Officer may impound the dog and may place notices in conspicuous places within the Hamlet informing the public of the potential danger. 8. Working Dogs 8.1 No person shall keep or harbor dog teams outside a residence unless authorized to do so by resolution of Council. 8.2 Subject to Section 8.1, dog teams shall he kept in a permanent dog team area as set out in Schedule 4 and no person shall place dogs in this area without application to and expressed permission from an Officer. 8.3 All dogs in a dog team shall be tethered to a chain or stringer and the length of their leashes shall be sufficient to all proper mobility. 8.4 Dog team owners shall keep their area well-maintained, clean and orderly and free from the accumulation of urine, feces or unsightly material. 8.5 An Officer shall provide one (1) written warning concerning an infraction under Section 8.4 and inspect the area three (3) days later to ensure compliance. 8.6 An Officer shall maintain a register of dog teams, including name and address of owners, number of dogs, and location of the team. 8.7 Provisions of this bylaw apply equally to working dogs and other dogs. 9. Exotic Animals 9.1 No person shall keep or harbor any wild animal that is indigenous to the Northwest Territories accept as may be allowed by motion of Council. Hamlet of Cambridge Bay By-Laws By-Law - No. 82 Animal Control Page 7 9.2 No person shall keep or harbor any animal that is not indigenous to the Northwest Territories, except for birds which are caged and fish which are kept in aquaria, and which meet federal and territorial regulations, and other animals as may be specifically allowed by motion of council. 10. Humane Destruction of Animals 10.1 A dog shall he destroyed by an Officer as humanely as possible through the use of a suitable shotgun or other firearm or by a lethal injection. 10.2 Any animal necessarily destroyed by an Officer shall be cremated at a convenient place within twenty-roar (24) hours of the destruction. 10.3 In the event of an outbreak of a communicable disease within the community the Council may, by resolution, declare that no dog shall be permitted outside a residence, and any dog found outside a residence shall be considered to be running at large, despite any license or tag issued for that dog. 10.4 A dog shall be destroyed forthwith on the order of an Environmental Health Officer or other competent official. 11. Offenses and Penalties 11.1 Any person who contravenes any provision of this bylaw is guilty of an offence and is liable, on summary conviction, to a fine of not less than twenty-five dollars ($25) or more than Five hundred dollars ($500) or to imprisonment for a term of not more than thirty (30) days. 11.2 Any person who fails to comply with a written warning under this bylaw is guilty of an offence and is liable, on summary conviction, to a fine of not less than twenty- five dollars ($25) and not more than five hundred dollars ($500) or imprisonment for a term of not more than thirty (30) days. 11.3 Any person who is convicted of an offence under this bylaw more than one time is subject to a fine of the same multiple to fines listed in Section 11.1 as the multiple of the number of offenses to the original offence. 11.4 The Court may order the destruction of any animal that the Court considers should be destroyed for humane reasons, for damaging property, or for the safety of the general public. 11.5 In lieu of prosecution, an owner or other person may pay within twenty-one (21) days of notice the penalty in the amount specified in the notice. Effective Date 13.1 This bylaw takes effect one month after third reading. BY-LAW No. 82 - Schedule 2 ANIMAL CONTROL PROCEDURE FOR DOG CAPTURE AND DISPOSAL 1. Dog is captured by an officer and put in dog pound. 2. The officer shall register the dog impounded using Form Schedule 2(b). 3. The By-Law Officer will check the dog pound each day to ensure that there is sufficient food and water. 4. If the dog is claimed by the owner, the dog owner will be required to do the following: a) If the dog is licensed, pay the impoundment fee; b) If the dog is not licensed, pay the impoundment fee, have the dog inoculated for rabies and apply for a license for the dog. 5. After the period of impoundment for the dog has expired (3 days), the By-Law officer shall notify the SAO that the dog be destroyed the next day. LICENCING: a) Each un-spayed female dog $20.00 b) Each un-neutered male dog $15.00 c) Each spayed female dog $7.00 d) Each neutered male dog $7.00 e) Each dog team $50.00 f) Replacement dog tag $4.00 2. IMPOUNDMENT FEES Pound fees shall be compounded as follows for each working day of impoundment in the Hamlet dog pound, including the day of seizure, in respect of each dog impounded. a) For the first day of impoundment $ 5.00 b) For the second day of impoundment $15.00 c) For the third day of impoundment $30.00 3. PENALTIES In addition to the impoundment fees, the owner of a licensed dog shall pay the Hamlet the following penalties: a) For the first offence $25.00 b) For the Second offence or if second written warning is issued $30.00 c) For the third and subsequent offences or after second warning is issued $40.00 In addition to the impoundment fees, the owner of an unlicensed dog shall pay to the Hamlet the following penalties: a) For the first offence $35.00 b) For the second offence or if second written warning is issued $45.00 c) For the third and subsequent offences or after second warning is issued $65.00
