Hamlet of Cambridge Bay By-Laws By-Law - No. 37 Noise Control Page 1 By-Law Name: Noise Control By-Law Number: 37 Description Being a by-law of the Municipality of Cambridge Bay in Nunavut to reduce and control unusual, unnecessary or excessive noise or vibration which may disturb or annoy the inhabitants of the Municipality of Cambridge Bay. Pursuant to the Hamlets Acts S.N.W.T., 1987(1) being Chapter M17 S. 120 and to Section 203(1)(f) of the Vehicles Ordinance, being Chapter V-2 of the Revised Ordinances of the Northwest Territories, 1974,as amended; By-Law Now, therefore, The Council of the Municipality of Cambridge Bay, in the Northwest Territories, in a regular meeting duly assembled, enacts as follows: 1. Short Title This By-Law may be cited as the Noise Control By-Law. 2. Interpretation In this By-Law: a) "Conveyance" includes a vehicle as defined in the Vehicle Ordinance and any other device employed to transport a person or persons or goods from place to place. b) "Municipality" means the Incorporated Hamlet of Cambridge Bay. c) "Council" means the Council of the Incorporated Hamlet of Cambridge Bay. d) "Noise" meaning any unnecessary and excessive sound including any loud outcry, clamor, shouting or Hamlet of Cambridge Bay By-Laws By-Law - No. 37 Noise Control Page 2 movement, or and sound that is loud or harsh or undesirable. e) "Officer" means a constable of the Municipality of Cambridge Bays By-law Division and ex official, and any member of the R.C.M.P. f) "Person" includes any company, corporation, owner, partnership, firm, association, society or party; g) "Property" means real property and includes land, other than a highway, together with all improvements which have been so affixed to the land as to make them in fact and in law a part thereof. h) "Quiet Time" means the time from 23:00 hours to 07:00 hours (11:00 P.M. to 7:00 A.M.). i) "Quiet Zone" means that area defined as the area located within the Municipal Boundary of the Hamlet of Cambridge Bay. j) "Senior Administrative Officer" means the Senior Administrative Officer of the Hamlet of Cambridge Bay. 3. Save as herein otherwise provided, the terms and expressions used in this By-Law shall have the same meaning as in the Interpretation Ordinance, the Municipal Ordinance and the Vehicles Ordinance respectively. 4. General Prohibitions a) No Person shall make cause, or permit to be made or caused, any noise in or on a public or private place which disturbs or tends to disturb the quiet, peace, rest, enjoyment, comfort, or convenience of any person or persons during the Municipality's Quiet Time. b) No Person shall play or operate any radio, stereophonic equipment or other instrument or any apparatus for the production or amplification of sound either in or on private premises or in any public place in such a manner as to disturb the quiet, peace, rest, enjoyment, comfort or convenience of any person or persons during the Hamlet's Quiet Time. c) No Person shall operate a motor vehicle, motorcycle, or other Conveyance which disturbs the quiet, peace, rest, enjoyment, comfort or conveyance which disturbs the Hamlet of Cambridge Bay By-Laws By-Law - No. 37 Noise Control Page 3 quiet, peace, rest, enjoyment, comfort or convenience of the person or persons in the vicinity during the Hamlet's Quiet Time. d) No person shall emit, cause, or permit the emission of any Noise as described in this By-Law which disturbs the quiet, peace, rest, enjoyment, comfort or convenience of individuals located in the Hamlet's Quiet Zone at any time of the day or night. 5. Penalty Section a) Every person who contravenes any of the provisions of this by-law is guilty of an offence, punishable on summary conviction and is liable to a fine of not more than Five Hundred ($500.00) dollars or to imprisonment for one (1) month or both; and in default of payment of any fine imposed, a period of imprisonment not exceeding one (1) month. b) An officer who has reasonable or probable grounds to believe that a person is violating any provision of this by-law may give such person written notice of intention to prosecute in the form of a ticket as defined in the Summary Conviction Procedures Ordinance, setting forth the date, time and place of the offense; briefly stating the nature of the offence and stating that payment may be made under Section 5 (c) of the by-law. c) A person, who has received a ticket pursuant to Section 5 (b) in respect of an alleged offence under this by-law, may within fourteen (14) days after receipt of such ticket, in lieu of prosecution under this by-law pay a fine in the sum of fifty ($50.00) dollars.
