MUNICIPALITY OF CLYDE RIVER BY-LAWS
By-Law #9 - Domestic Animals
Being a by-law of the Hamlet of Clyde River in the Northwest Territories to regulate the control of
Domestic Animals within the boundaries of the Hamlet of Clyde River, Northwest Territories.
WHEREAS Section 182 of the Municipal Ordinance provides that Municipal Council may make rules and
regulations for the control of domestic animals within its Municipal boundaries;
NOW, THEREFORE, THE COUNCIL OF THE HAMLET OF CLYDE RIVER, at a duly assembled meeting
enacts as follows:
SHORT TITLE
1.
This by-law may be cited as the "Domestic Animal By-Law".
INTERPRETATION
2.
In this by-law:
a) "Council"
means the Council of the Hamlet of Clyde River;
b) "Dog"
means a male or female dog over six (6) months of age;
c) "Dog Officer"
shall mean a person appointed by the Council of the Hamlet of Clyde
River to follow and carry out the provisions of the by-law;
d) "Hamlet"
means the Hamlet of Clyde River;
e) "Owner"
means a person who owns, harbours, possesses or has control or custody
of a dog.
f) For the purpose of this by-law, a dog is running at large if it is off the premises of its owner
and is not under the physical control of any person.
g) For the purpose of this by-law, the Hamlet of Clyde River shall be deemed to consist of all
that portion of the Municipality that lies within a radius of point nine kilometres (0.9 km) of
lot number twenty-five (25) (lot #25 being the lot on which stands the Government duplex
staff house).
REGULATIONS
3. a) No person shall permit a dog to run at large within the Hamlet of Clyde River.
SEIZURE
4. a) The Dog Officer shall try to seize a dog running at large or cause the owner to seize the dog
running at large within one (1) hour of notice to seize.
b) Where, at the end of one (1) hour, action has not been taken by the owner to seize, the dog
may be shot on site by the Dog Officer.
c)
Where, in the opinion of the Dog Officer, a dog seized is injured or should be destroyed
without delay for humane reasons or for reason of safety, the Dog Officer may destroy the dog
as soon after seizure as he/she thinks fit without permitting any person to claim the dog.

d) Should the Dog Officer request assistance from the owner of the dog running at large, and the
owner refuses assistance, then the owner is guilty of an offence against this by-law.
DESTRUCTION WHERE UNABLE TO SEIZE
5. a) When the Dog Officer is unable to seize a dog that is running at large, he/she may destroy the
dog.
b) A person may kill any dog that is running at large and in the act of pursuing, attacking, injuring,
damaging, killing or destroying:
i. a person;
ii. another dog that is tethered;
iii. a food cache, harness or other equipment.
c)
A person may kill any dog that is acting abnormally and is suspected of rabies.
d) No damages or compensation may be recovered on account of the destruction of a dog by the
Dog Officer.
OFFENCES AND PENALTIES
6. a) Every person who contravenes any section of this by-law is guilty of an offence and is liable
upon summary conviction of a fine of not more than twenty-five dollars ($25.00) or
imprisonment not more than ten (10) days or both.
GENERAL PROVISIONS
7. a) Save as herein otherwise provided, the provisions of the Ordinance Respecting Dogs, being
Chapter D-8 of the Revised Ordinance of the Northwest Territories, 1974, as amended, apply
mutatis mutandis to the control of dogs within the Hamlet.
EFFECTIVE DATE
8.
This by-law will come into effect after the third (3rd) reading.
