By-Law Title: Water, Sewer & Garbage Payment Security Deposit By-Law Number: 74 1 MUNICIPALITY OF CLYDE RIVER BY-LAWS By-Law #74 - Water, Sewer & Garbage Payment Security Deposit A by-law of the Municipal Corporation of the Hamlet of Clyde River, Nunavut to establish and levy a payment security deposit for water, sewer and garbage services, pursuant to the provisions of the Emergency Measures Act and the Hamlets Act. WHEREAS the Municipality of Clyde River desires to establish and levy a water, sewer and garbage payment security deposit to ensure payment for water, sewer and garbage services provided; NOW, THEREFORE, THE COUNCIL OF THE HAMLET OF CLYDE RIVER, at a duly assembled meeting enacts as follows: SHORT TITLE 1. This by-law may be cited as the "Water, Sewer & Garbage Payment Security Deposit By-Law". INTERPRETATION 2. In this by-law: a) "Council" means the Council of the Hamlet; b) "Customer" means the recipient of the services provided; c) "Hamlet" means the Hamlet of Clyde River as established under the authority of the Hamlets Act; d) "Mayor" means the Mayor of the Hamlet; e) "SAO" means the Senior Administrative Officer of the Municipality f) "Security Deposit" means money paid or given to the Hamlet by a customer or his/her agent to be held by the Hamlet as a security against g) "Services" means water, sewer and garbage services. GENERAL PROVISIONS 3. A customer upon making application for water, sewer and garbage services shall pay to the Hamlet a security deposit of one hundred dollars ($100.00). 4. The Hamlet shall pay interest on the security deposit for the period held, calculated at the current savings interest rate paid by the Hamlet's bank, when the deposit is returned to the customer. 5. The security deposit plus accrued interest shall be returned to a customer in good standing within ten (10) days of closure of the account. 6. The SAO shall keep records of the security deposits received.
