Garbage By-law No. 323 Page 1 of 7 Municipality of Rankin Inlet Garbage by-law No. 323 A by-law of the Municipal Corporation of the Hamlet of Rankin Inlet in the Nunavut Territory to establish a system for the collection, removal, disposal, and collection of garbage services fees, pursuant to the provisions of the Hamlet Act S. NU 2003, c.3, c169. WHEREAS it is necessary and expedient for the Hamlet Council to pass a by-law to state rates, conditions, and regulations for the garbage services within the Hamlet of Rankin Inlet. NOW, THEREFORE, THE COUNCIL OF THE HAMLET OF RANKIN INLET, in a duly constituted meeting, enacts as follows: 1. SHORT TITLE This by-law may be cited as the "Garbage Collection By-law". 2. INTERPRETATION In this By-law: "Business" means a profession, trade, or commercial operation of undertaking of any kind; "Collector" means employees of the Hamlet that collects garbage within the Hamlet of Rankin Inlet; "Contractor" means any individual, business, and/or entity that constructing any building or providing maintenance services for government, the local housing Association, and/or business; "Council" means the Council members of the Hamlet of Rankin Inlet; "Dismantled vehicle" means any vehicles that are wrecked, not running or unsafe to operate; "Foreman" means the Hamlet public works director; "Garbage" means all putrescent material including condemned meats, fish, fruits and vegetables resulting from the handling, preparation, cooking, and consumption of food; "Garbage bin" means an acceptable container approved by the Hamlet; "Hamlet" means the Hamlet of Rankin Inlet; "Housing Unit" means any housing unit owned, operated, and/ or managed by the local Housing Association; "Owner" means the registered owner or the legal leaseholder of the premises; "Person" means the occupant or person in charge of the premises; "Premises" means the building or site including any structure erected thereon; Garbage By-law No. 323 Page 2 of 7 "Resident" means a person privately owns or renting their home within the Hamlet of Rankin Inlet; "Tipping Fees" means the fee paid by anyone who disposes waste to the landfill; fees shall be outlined on Schedule D attached and forming part of this By-law. 3. GENERAL PROHIBITIONS AND REQUIREMENTS 3.1 PROHIBITIONS 3.1.1 No person shall put out any garbage, or any sort of waste, unless such is contained in the Garbage bin or containers approved by the Hamlet as defined in this By-law. 3.1.2 No person shall deposit or permit to deposit, at any time, Garbage or other waste material of any kind whatsoever on or near any street or any public property. 3.1.3 No person shall burn or permit the burning of any garbage or other items in the Garbage bin or container. 3.1.4 No person shall place or permit to place any explosive wastes, or other highly combustible material for removal as Garbage. 3.1.5 No Person shall deposit of, or permit to dispose of, any Garbage, or other waste material at any place within the Hamlet other than the landfill or a place designated by the Council. 3.1.6 No person shall haul any Garbage, or other waste material in an open truck without placing tarpaulin, or any sort of secured covering, over the box of the truck to ensure that none of the Garbage, or other waste material falls out. 3.1.7 No person shall collect, dispose, or remove Garbage except in accordance with the provisions of this By-law. 3.2 REQUIREMENTS 3.2.1 Owners shall ensure that Garbage bin is kept clean of snow or loose Garbage. 3.2.2 All wet garbage, food leftovers, and/or animal carcass, shall be wrapped securely in garbage bags prior to being placed in garbage containers for collection. 3.2.3 All large items which exceed a capacity of five cubic feet with the maximum weight of 50 lbs., shall be collected on a per call basis only. 3.2.4 Notwithstanding any other provisions of this By-law, the Collector is not obligated to collect unless the Owner complies with the provisions of this By-law. 3.2.5 The Hamlet provides Garbage bin or container to privately-owned single-dwellings and all housing units except for commercial buildings, row-house dwellings, and any sort of residential units owned by a for-profit organization. 4. SCHEDULE OF COLLECTION Garbage By-law No. 323 Page 3 of 7 4.1 Collection of garbage, and/or other waste, shall be made as per Schedule A attached to this By- law. 4.2 Landfill regular operating hours pursuant to this By-law shall be outlined in Schedule C attached hereto and forming part of this By-law. 5. GARBAGE COLLECTION RATES AND TIPPING 5.1 The collection rates for Garbage collection service pursuant to this By-law shall be set in Schedule B attached hereto and forming part of this By-law. 5.2 Owner receiving garbage collection service pursuant to this By-law shall pay the charges set out in Schedule B of this By-law; all payments shall be due and payable when rendered by the Hamlet. 5.3 All persons utilizing the Hamlet landfill shall be required to obtain tipping permit in the form set out in Schedule D attached and forming part of this By-law. 5.4 Tipping permits shall be issued upon remittance to the Hamlet the tipping permit fees as outlined on Schedule C attached and forming part of this By-law. 5.5 Council may amend the tipping fees and garbage collection rates from time to time. 6. PENALTIES 6.1 Any person who contravenes any provision of this By-law is guilty of an offence and is liable upon summary of conviction to a fine of: 6.1.1 Not less than $500 and not more than $1,000 for an individual; or 6.1.2 Not less than $1,000 and not more than $5,000 for a corporation. 7. REPEAL BY-LAW By-law Number 247 (dated April 23, 2012) is hereby repealed. By-law Number 290 (dated October 25,2017) is hereby repealed. By-law Number 308 (dated June 22, 2020) is hereby repealed. 8. ENACTMENT This By-Law shall come into force and have effect from and after the date of the third reading. Read a first time this 24th day of August, 2021. SCHEDULE C LANDFILL OPERATING SCHEDULE Monday-Friday 10 am -12 pm Closed during lunch hour 1 pm-5 pm Saturday 12 pm - 4 pm Sunday Closed 1. Landfill facility is closed on statutory holidays and shall resume its regular operating hours on the following business days. 2. Only contractors or commercial businesses may dispose waste in the landfill after hours; this privilege can only be acquired if arrangements are made prematurely with the Hamlet Foreman.
