WHEREAS the Municipal Act, 2001 provides that a municipality may pass by-laws in ,respect of a highway only if it has jurisdiction over the highway; I AND WHEREAS the Council of the Township of Alfred and PI~ntagenet deems it expedient to prohibit heavy traffic on certain municipal highways; THEREFORE, the Council of the Township of Alfred and Plantagenet enacts as follows: 1. DEFINITIONS i) "Heavy truck" means a vehicle, object or contrivance for moving loads having a gross weight, including the vehicle, object or contrivance or lOad in excess of 4,500 kilograms. ii) "Highway" includes a common highway, street, avenUt3. parkway, square, place, bridge, viaduct or trestle. any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof. 4. No person shall drive or cause to be driven a heavy truck on. the highway or part of a , highway where "no heavy truck" signs are erected or are on display on any highway between the limits set out in the attached Schedule "A" forming part of this by-law. 3. The follOwing shall not apply to Section 2 of this By-Law: a) deliveries to a location on a no heavy truck route; b) the performance of services on a no heavy tt'uck route; c) emergency vehicles. road construction vehicles for the purpose of maintenance, repair or reconstruction of a no heavy truck route; d) public services by the Township of Alfred and Plantagenet; e) proceeding to or from a garage for the purpose of housing, storing. repairing a heavy truck on a no heavy truck route; f) a privately-owned vehicle driven to or from the owner's residence; g) public services by The Nation Municipality and the City of Clarence-Rockland on boundary roads. . 4. Every person who cO.nti"avenes any provisions of this by':law is guilty of an offence and on conviction thereof shall forfeit and pay a penalty for each such offence and every such penalty shall be recoverable under the Provincial Offences Act. The p(ovisions of this By~Law shaH be enforced by the Municipal Law Enforcement Officer 5. Every person who contravenes any of the provisions of this by-law is guilty of ~ offence and on conviction thereof shall forfeit, and pay a penalty for each such offcmce and every such penalty shall be recoveIll,ble un4er the Provillcial Offences Act, RS.O. 1990, chapter P.33 and amendillents thereto. 6. When a person has been convicted of an offence under this by-law, the County Court of the County of Prescott and Russell, or any court of competent jurisdiction thereafter, may, in addition to any other penalty imposed on the person convicted, issue an order prohibiting the continuation or repetition of the offence or the doing of any act or thing by the person convicted directed toward the continuation or repetition of the offence. 7. The req'uitements of this by-law a:teseverable. If any requirements of this by-law are held inv~id, the applic~tion of such requirements to other circumstanc.es and the remainder of this by-law shall not be affected. 8.
