THE CORPORATION OF THE TOWNSHIP OF
ASHFIELD-COLBORNE-WAWANOSH
BY-LAW NUMBER 21-2006
BEING A BY-LAW TO REGULATE RESIDENTIAL FENCES IN SETTLEMNET
AREAS OF THE TOWNSHIP OF ASHFIELD-COLBORNE-WAWANOSH
WHEREAS section 11 (1) 7 of the Municipal Act 2001, S.O. 2001, C.25 authorizes a
municipality to pass by-laws respecting matters relating to structures including fences;
AND WHEREAS Council of the Corporation of the Township of Ashfield-Colborne-Wawanosh
deems it expedient to regulate fences in settlement areas of the Township;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP
OF ASHFIELD-COLBORNE-WAWANOSH ENACTS AS FOLLOWS:
1. Definitions:
a. "Fence"
Shall mean a barrier comprised of wooden or metal posts, wire
mesh, masonry wall, wood, plastic/vinyl, or stone, used as a
boundary or means of enclosure.
b. "Road"
includes a common and public highway, street, avenue, or
parkway, any part of which is intended for or used by the general
public for the passage of vehicles and includes the area between
the lateral property lines thereof.
2. GENERAL PROVISION
In a settlement area, a fence on a residential lot shall not be established closer than 2.0
metres to any lot line fronting a road. For corner lots, the provisions of the Site
Triangle Section of the zoning by-law shall also apply.
The maximum height of a fence in the front yard shall not exceed 1.3 metres.
The maximum height of a fence in the rear and side yards shall not exceed 2.0 metres.
3. ENFORCEMENT
Fences established prior to the passing of this by-law shall be deemed in compliance
with the provisions herein. This By-law shall be enforced by the By-Law
Enforcement Officer of the Township of Ashfield-Colborne-Wawanosh. It will be at
the discretion of the By-Law Enforcement Officer to determine if the type of fence is
in compliance with Definitions 1 (a).
4. PENALTY
Every person who contravenes any provision of this by-law is guilty of an offence
and is liable, upon conviction, to a fine not exceeding $5,000 exclusive of costs for
each offence and is recoverable under the Provincial Offences Act, R.S.O. 1990,
Chapter P.33 as amended from time to time.
5. This By-law shall come into full force and effect on the date of its final passing.
