BY-LAW NUMBER 05-2013
BEING A BY-LAW TO REGULATE THE TRAFFIC AND THE PLACING, STANDING,
STOPPING OR PARKING OF AN OBJECT OR VEHICLE ON HIGHWAYS AND
PARKING LOTS WITHIN THE TOWNSHIP OF ASHFIELD-COLBORNE-WAWANOSH
WHEREAS subsection 11 (3)1 of the Municipal Act, 2001, S.O. 2001 , c. 25, as amended (the
"Municipal Act"), authorizes a municipality to pass by-laws respecting its highways, including
parking and traffic on highways;
AND WHEREAS subsection 11 (3)8 of the Municipal Act authorizes a municipality to pass a
by-law respecting parking, except on highways;
AND WHEREAS section 100 of the Municipal Act authorizes a municipality, in respect of land
not owned or occupied by the municipality that is used as a parking lot, to regulate or prohibit
the parking or leaving of motor vehicles on that land without the consent of the owner of the
land or regulate or prohibit traffic on that land if a sign is erected at each entrance to the land
clearly indicating the regulation or prohibition;
AND WHEREAS section 100.1 of the Municipal Act authorizes a municipality to regulate or
prohibit the parking or leaving of motor vehicles without the consent of the owner of the land;
AND WHEREAS section 425 of the Municipal Act authorizes a municipality to pass a by-law
providing that a person who contravenes a by-law of the municipality passed under the
Municipal Act is guilty of an offence;
AND WHEREAS section 428 of the Municipal Act authorizes a municipality to pass a by-law
authorizing that, where a vehicle has been left parked, stopped or standing in contravention of
a by-law passed under this Act, the owner of the vehicle is guilty of an offence, even though
the owner was not the driver of the vehicle at the time of the contravention of the by-law;
AND WHEREAS section 128 of the Highway Traffic Act, R.S.O., 1990, c. H.8, as amended,
authorizes a municipality to pass a by-law prescribing a rate of speed different from the rate
set out in section 128 of the Highway Traffic Act;

NOW THEREFORE, the Council of The Corporation of the Township of Ashfield-Colborne-
Wawanosh enacts as follows:
PART I -SHORT TITLE
1. This by-law may be cited as The Corporation of the Township of Ashfield-Colborne-
Wawanosh Traffic and Parking By-law.
PART 11- DEFINITIONS
2. For purposes of this by-law:
a. Accessible Parking Permit means an unexpired accessible parking permit
issued under and displayed in accordance with the Highway Traffic Act or an
unexpired accessible parking permit, number plate or other marker or device
issued by another jurisdiction recognized under the Highway Traffic Act.
b. Accessible Parking Space means a Parking Space designated for the
exclusive use of a Person with a Disability in accordance with the

requirements of section 11 of R.R.O. 1990, Regulation 581 under the
Highway Traffic Act.
c. Authorized Sign means any Traffic Control Device or Traffic Control Signal
placed or erected on a Highway under the authority of this by-law for the
purpose of regulating, warning or guiding traffic.
d. Bicycle includes a tricycle having a wheel or wheels of more than 50
centimetres in diameter.
e. Bicycle Lane means a dedicated portion of the Roadway for Bicycle use,
which is designated by a lane marking separating the portion of Roadway
used by Vehicles from the portion of Roadway used by Bicycles.
f.
Boulevard means that part of the Highway situated between the curb line and
the property line of the lot abutting the Highway, including a Driveway, but
does not include a Sidewalk or Shoulder.
g. Bus Stop means that portion of a Highway designated by an Authorized Sign
for the use of buses, as a space for loading and unloading passengers.
h. By-Law Enforcement Officer means a person appointed by Council to enforce
and carry out the provisions of this by~law.
i.
Commercial Parking Permit means a permit, which, when affixed to the lower
right hand corner of the windshield of a commercial Vehicle, will authorize
such Vehicle to park at any Parking Meters or loading zone while engaged in
loading or unloading passengers and/or merchandise without inserting the fee
prescribed in this by-law into the Parking Meter. A Commercial Parking Permit
shall only be applicable in the Municipality which same was issued.
j.
Community Safety Zones means a community safety zone as defined in
section 214.1 of the Highway Traffic Act.
k. Corner means the point of intersection of Curb Lines.
I.
Council means the Council of the Municipality.
m. Cul-De-Sac means a Highway terminating in a turn-around.
n. Curb Lines:
i. where a curb has been constructed, means the line of curb; and,
ii. where no curb has been constructed, means the edge of the Roadway.
o. Superintendent means the Superintendent of Public Works for the
Municipality, or his or her designate.
p. Driveway means the improved land on a Highway which provides vehicular
access from the Roadway to adjacent land.
q. Essential Service Parking Permit means a permit, which when affixed to the
lower right hand corner of the windshield of a commercial Vehicle, will
authorize such Vehicle to park at any Parking Meter or loading zone within the
Municipality for a period not exceeding one hour for the purpose of carrying
out repairs to public utilities or other essential public services without inserting
the fee as prescribed in this by-law into the Parking Meter.
r.
Flankage Yard means a Yard on a corner lot that extends from the Front Yard
to the Rear Yard, between the longer lot line abutting a Highway and the
nearest wall of the main building.
s. Front Yard means a Yard extending across the full width of a lot between the
Highway to the nearest wall of the main building on the lot, disregarding open
terraces or steps; but on a corner lot, means a Yard extending across the full
width of a lot between the shorter lot line abutting a Highway, other than a
public lane, and the nearest wall of the main building or structure on the lot.

Heavy Truck means a truck having an unloaded weight of at least 4.6 metric
tonnes, but does not include a passenger Vehicle, an ambulance, or a Vehicle
of the Police or Fire Departments.
u. Highway includes a common and public highway, street, avenue, parkway,
driveway, square, place, bridge, viaduct or trestle, any part of which is
intended for or used by the general public for the passage of Vehicles and
includes the area between the lateral property lines thereof.
v. Highway Traffic Act refers to the Highway Traffic Act, R.S.O., 1990, c. H.8, as
amended, and any regulations thereunder.
w. Lot Line means any boundary of a parcel or tract of land.
x. Municipality means The Corporation of the Township of Ashfield-Colborne-
Wawanosh.
y.
Municipal Property means any property owned by the Municipality.
z. One Way Street means a Highway upon which vehicular traffic is limited to
movement in one direction.
aa. Parking Lot means a lot, building or structure on or in which licensed Vehicles
are parked for compensation or otherwise.
bb. Parking Meter means a device that shall indicate thereon the interval of time
during which a Vehicle may be parked, and which shall include: a receptacle
for receiving and storing payment, a timing mechanism to measure the
passage of the interval of time of permitted parking, and a display signaling
when the permitted interval of time has elapsed .

cc. Parking Space means that part of the Highway that is designated for the
purpose of parking a Vehicle.
dd. Pedestrian means any person afoot, children in wheeled carriages, and
muscular powered or motorized wheelchairs
ee. Person with a Disability shall have the same meaning as in the Highway
Traffic Act.
ff. Private Property means land not owned by the Municipality.
gg. Provincial Offences Act refers to the Provincial Offences Act, R.S.O. 1990, c.
P.33, as amended, and any regulations thereunder.
hh. Rear Yard means a Yard extending across the full width of a lot and
extending from the rear Lot Line to the rear wall of the main building located
on the lot or, in the case of a triangular lot, between the apex of the triangle
formed by the intersection of the side Lot Lines and the nearest wall of the
main building.
ii.
Reserved Parking Permit means a permit, as authorized from time to time by
the Superintendent, which when displayed as indicated by the Municipality will
authorize any Vehicle to park in any legal Parking Space beyond the
designated time limit at the prevailing rate.
jj. Roadway means the part of the Highway that is improved, designed or
ordinarily used for vehicular traffic, but does not include the Shoulder, and,
where a Highway includes two or more separate roadways, the term
"roadway" refers to any one roadway separately and not to all of the roadways
collectively
kk. Shoulder means that portion of the Highway lying adjacent to the Roadway
which is improved with granular or paved surface and is not intended for the
passage of vehicular traffic .

II.
Side Yard means a Yard extending from the Front Yard to the Rear Yard
between the side Lot Line and the nearest wall of the main building, but does
not include a legal driveway and/or a legal parking area.
mm. Sidewalk means that portion of a Highway between the Curb Line and the
property line of the lot abutting the Highway improved for the use of
Pedestrians.
nn.
Traffic Control Device means a sign, marking or other device on a Highway
for the purpose of controlling, guiding or directing traffic.
oo. Traffic Control
Signal
means any device, manually, electrically
or
mechanically operated for the regulation of traffic.
pp. U-Turn means to turn a Vehicle within a Highway so as to proceed in the
opposite direction.
qq. Vehicle means a "Motor Vehicle" as defined in the Highway Traffic Act.
rr. Yard means a space open from the ground to the sky on the same lot with a
building, unoccupied except for such accessory buildings as are permitted by
the Zoning By-law.
PART 111- ENFORCEMENT AND AUTHORITY
3. ENFORCEMENT
All provisions of this by-law may be enforced by police officers throughout the judicial
district of the Municipality. Those persons who are appointed as By-law Enforcement
Officers and are non-police officers shall only enforce the parking and stopping
provisions of this by-law.
4. AUTHORITY TO INSTALL SIGNS
a. The Superintendent is hereby authorized to place, erect and maintain such
Traffic Control Devices and Traffic Control Signals that are required to give
effect to the provisions of this by-law and/or which are authorized by the
Schedules to this by-law.
b. The Superintendent is further authorized for the duration of the situation, to
place, erect or maintain such Traffic Control Devices and Traffic Control
Signals that are not authorized by this by-law but are required for safety
and/or emergency reasons.
c. Unless otherwise permitted, no person shall place, maintain, or display upon
any Highway, any sign, signal, marking or device which purports to be or is an
imitation of or resembles any Traffic Control Device or Traffic Control Signal
without the prior approval of the Superintendent.
PART IV- GENERAL
5. OPERATION OF VEHICLES
a. Driving On Other Than A Roadway
No person shall drive a Vehicle, a motor assisted Bicycle or a Bicycle on or
along any Sidewalk or Boulevard except at a Driveway.
b. Closed Roads
No person shall drive a Vehicle, except an emergency Vehicle or a Vehicle
authorized by the Superintendent or by a police officer pursuant to section 134
of the Highway Traffic Act, through or enter upon any Highway or part thereof
that is roped, barricaded or marked by Authorized Signs prohibiting its use.

c.
Newly Painted Lines
No person shall drive or attempt to drive on or over or tamper with or walk on
any newly painted line or series of lines, on any Roadway, when the presence
of such is indicated by markers, electric lanterns or otherwise.
d. Blocking Intersection
A person driving a Vehicle approaching a green Traffic Control Signal at an
intersection shall not enter the intersection unless traffic in front is moving in a
manner that would reasonably lead to the belief that the Vehicle can be cleared
of the intersection before the Traffic Control Signal turns red.
This prohibition, however, does not apply to the driver or operator of a Vehicle
who enters an intersection for the purpose of turning to the right or left onto an
intersecting Roadway and signals intention to make such turn prior to entering
the intersection.
6. PEDESTRIAN RIGHTS AND DUTIES
a. Crossing Roadway
Except where Traffic Control Signals are in operation or where traffic is being
controlled by a police officer, a Pedestri'an crossing a Roadway at a place other
than a Pedestrian crossover shall yield the right-of-way to all Vehicles upon the
Roadway, but nothing in this section shall relieve the person driving a Vehicle
from the obligation of taking all due care to avoid a collision.
b. Games or Sports
No person shall play or take part in any game or sport upon a Highway and no
person upon roller skates, roller blades, skateboards or riding in or by means of
any coaster, toy Vehicles or similar devices shall go upon a Highway except for
the purpose of crossing the Roadway and when so crossing such person shall
have the rights and be subject to the obligations of a Pedestrian.
c. The Use Of Sidewalks
All Pedestrians shall utilize Sidewalks whenever they are provided adjacent to a
Roadway.
7. BICYCLES
a. Operation of Bicycles
Every person operating a Bicycle shall exercise due care and attention giving
regard to Pedestrians and other Vehicles.
b. Riding Abreast
No person shall ride a Bicycle on any Roadway abreast of another Bicycle
except in the course of passing the other Bicycle.
c. Passengers
-
i. No person shall on a Roadway, while riding a Bicycle designed to carry
one person only, carry another person on the Bicycle unless in a carrier
specifically designed and attached thereto for that purpose.
ii. No person shall while riding a Bicycle on a Roadway carry any goods
thereon in such manner as to interfere with the rider having full control
of the Bicycle.
d. Parking
iii. No person shall park a Bicycle on any Roadway.
iv. No person shall park a Bicycle on any Boulevard, Sidewalk or Shoulder
except in an upright position.

8. ANIMALS
a. Riding On Other Than Roadway
No person shall ride, drive, lead or back any animal, except household pets,
within, across or along any Sidewalk or Boulevard except on a Driveway.
b. Attendance While In Motion
The driver or other person in charge of an animal drawn Vehicle on a Highway
shall remain upon the Vehicle while it is in motion or walk beside the animal
drawing it.
c.
Parking
No person shall leave a carriage, cart, wagon, sleigh or sled drawn by an
animal on a Highway without the animal by which it was drawn.
PART V - PARKING AND STOPPING RESTRICTIONS
9. METHOD OF PARKING
a. General
Unless otherwise
permitted in this by-law, no person shall park or stop a
Vehicle on any Highway except on the right side of the Highway having regard
to the direction in which the Vehicle has been proceeding, with the right front
and right rear wheels or runners not more than 0.15 metres from the curb line.
b. Parking On One Way Streets
Where parking is permitted on either side or both sides of a One Way Street, a
person may park a Vehicle only in the direction it was permitted to proceed,
parallel to and not exceeding a distance of 0.15 metres from the curb line.
c. Angle Parking
Where angle parking is permitted, no person shall park a Vehicle except at the
angle with the Roadway as indicated by markings and/or signs, or so that the
front end of the Vehicle is nearest to the edge of the Highway.
d. Boulevard
Where Boulevard parking is permitted, no person shall park a Vehicle on the
abutting Roadway or any part thereof.
e. Parking Spaces
vVhere Parking Spaces are designated on a Highway, no person shall park a
Vehicle in such a manner as to infringe upon or take up more than one Parking
Space unless the Vehicle cannot be accommodated in one Parking Space.
10. PARKING PROHIBITED
a. General
Unless otherwise permitted in this by-law, no person shall at any time park a
Vehicle in any of the following places:
i. on or overhanging the Sidewalk or curb;
ii. on or overhanging any portion of the Boulevard;
iii. within an intersection;
iv. within 3 metres, from a point on the curb or edge of the Roadway, of any
fire hydrant;
v. within 15 metres of any railway track which crosses the Roadway or is
adjacent to a Roadway;

vi. within 9 metres of an intersecting Roadway;
vii. in front of or within 1.5 metres of the entrance to a Driveway or so as to
prevent ingress to or egress from such Driveway;
viii. in such a manner as to obstruct traffic;
ix. on any Highway for a longer period of time than three (3) consecutive
hours;
.
x. on any Highway between the hours of 2:30a.m. and 6:00 a.m.;
xi. on any Highway for the purpose of repairing, washing, or maintenance
of a Vehicle, save when such use of the Highway is unavoidable
through emergency;
xii. on any Highway for the purpose of soliciting, vending, buying or selling
goods and/or services, unless otherwise permitted by by-law;
xiii. within 15 metres on either side of a point designated as a Bus Stop;
and,
xiv. on the Front Yard, Side Yard, Rear Yard or Flankage Yard of any
residential property.
b. Emergency Prohibition of Parking
Despite Parts V and VI of this by-law and anything in Schedules 1, 2, 3, 4, 5, 6
and 7, when Authorized Signs are on display, parking is prohibited on any
Highway during any emergency. For this purpose "emergency" includes, but is
not limited to, a fire, flood or other natural disaster, road maintenance or
repairs, maintenance or repair work of a public utility and any circumstance in
which section 134 of the Highway Traffic Act applies.
c. Bus Prohibition
Subject to PART XVIII, no person shall park a bus, including a school bus, on
any Highway.
11 . NO PARKING
a. Where signs establishing a "No Parking Zone" have been erected, no person
shall park a Vehicle within such zone except when necessary to avoid conflict
with other traffic or in compliance with a Traffic Control Signal Sign or Traffic
Control Device or the directions of a Police Officer.
b. Without limiting the generality of the provisions of subsection (a), Authorized
Signs may be erected prohibiting the parking of a Vehicle on a Highway in
any of the following places:
i. on any of the Highways or parts of Highways named or described in
Schedule '1' to this by-law, on the side or sides of Highways set out in
the said schedule, during the times and/or days set out in the said
schedule;
ii. on any public lane;
iii. in a Cul-De-Sac along the turn around;
iv. on any Highway within 15 metres of the termination of a dead end
Highway;
v. in front of an emergency entrance to or exit from a hospital, theatre,
auditorium or other building in which persons may be expected to
congregate in large numbers;
vi. within 30 metres on either side of a point designated as a Bus Stop;

vii. on that side of any Highway where the same abuts on the property of
any public park, public playground or school;
viii. within 15 metres on either side of an access to a Community Trail as
established by the Municipality;
ix. within 8 metres of any fire hall access on the side of the Highway on
which the fire hall is located and/or within 30 metres of such fire hall
access on the opposite side of the Highway;
x. within 15 metres of an intersection;
xi. within 30 metres of an intersection controlled by Traffic Control Signals;
and,
xii. on or in such a manner as to obstruct any designated Bicycle Lane,
unless it is for the momentary stopping of transit buses at signs marking
a Bus Stop, taxis while actively engaged in receiving or discharging
passengers or other Vehicles while actively engaged in receiving or
discharging passengers who are disabled.
12. LIMITED PARKING
When Authorized Signs have been erected and are on display, no person shall park a
Vehicle on any of the Highways or parts of Highways named or described in Schedule
z to this by-law, except on the side or sides of Highways set out in the schedule,
during the times and/or days set out in the schedule, for the length of time set out in the
schedule.
13. ANGLE PARKING
When Authorized Signs have been erected and are on display, no person shall park a
Vehicle on any of the Highways or parts of Highways named or described in Schedule
~ to this by-law, on the side or sides of Highways set out in the schedule, except in
accordance with Part V, subsection 9 ( c) to this by-law.
14. STOPPING PROHIBITED
a. In Specified Places
Unless otherwise permitted in this by-law, no person shall at anytime on a
Highway stop a Vehicle in any of the following places:
i. within a School Bus Loading Zone;
,.
ii. on any median strip separating two Roadways or adjacent to either side
or ends of such median strip; or
iii. on, under or within 30 metres of a bridge, elevated structure, tunnel or
underpass.
15. NO STOPPING
a. Where signs establishing a "No Stopping Zone" have been erected, no
person shall stop a Vehicle within such zone except when necessary to avoid
conflict with other traffic or in compliance with a Traffic Control Signal Sign or
Traffic Control Device or the directions of a Police Officer.
b. Without limiting the generality of the provision of subsection (a), Authorized
Signing may be erected prohibiting the stopping of a Vehicle on a Highway in
any of the following places:
i. on any of the Highways or parts of Highways named or described in
Schedule '4' to this by-law, on the side or sides of Highways set out in
the schedule, during the times and/or days set out in the schedule;
ii. within 30 metres of a designated school crosswalk;

iii. on that side of any Highway where the same abuts on the property of
any school except for school buses engaged in loading or unloading
passengers at which time the red signal lights and stop arm are in
operation;
iv. within 15 metres of a Pedestrian crossover; and,
v. on the opposite side of any Highway adjacent to school property,
between the hours of 8:00 a.m. and 4:30 p.m. from Monday through
Friday inclusive.
16. PRIVATE PARKING
a. No person shall park or leave a Vehicle on Private Property without the
consent of the owner of the property.
b. No person shall park or leave a Vehicle on Private Property that is being used
as a Parking Lot without the consent of lhe owner of the property.
c. If signs are erected on Private Property specifying conditions on which a
Vehicle may be parked or left on Private Property or regulating or prohibiting
the parking or leaving of a Vehicle on Private Property, a Vehicle parked or
left on Private Property contrary to the proscribed conditions, regulations or
prohibitions shall be deemed to have been parked or left without the consent
of the owner.
d. If there are pavement markings specifying where a Vehicle may be parked or
left in a Parking Lot, a Vehicle parked or left in a Parking Lot contrary to those
pavement markings shall be deemed to have been parked or left without the
consent of the owner.
17. PARKING ON MUNICIPAL PROPERTY
a. No person shall park or leave a Vehicle on Municipal Property without the
consent of the Municipality.
b. No person shall park or leave a Vehicle in a Parking Lot owned by the
Municipality without the consent of the Municipality.
c. If signs are erected on Municipal Property, including a municipally owned
Parking Lot, specifying conditions on which a Vehicle may be parked or left on
Municipal Property or regulating or prohibiting the parking or leaving of a
Vehicle on Municipal Property, a Vehicle parked or left on Municipal Property
contrary to the proscribed conditions, regulations or prohibitions shall be
deemed to have been parked or left without the consent of the Municipality.
d. If there are pavement markings specifying where a Vehicle may be parked or
left on Municipal Parking, including a municipally owned Parking Lot, a
Vehicle parked or left on Municipal Property contrary to those pavement
markings shall be deemed to have been parked or left without the consent of
the Municipality.
18. LOADING ZONES
a. When Authorized Signs have been erected and are on display, no person
shall stop a Vehicle, other than a commercial Vehicle, on any of the Highways
or parts of Highways named or described in Schedule '5' to this by-law, and
on dates, times and locations set out in the schedule.
b. Notwithstanding subsection (a), a person driving a passenger Vehicle may
temporarily stop in a loading zone for the purpose of and while actually
engaged in loading or unloading passengers and/or merchandise, provided
that such stopping does not interfere with any commercial Vehicle entering or
exiting such loading zone.

19. TAXICAB STANDS
a. When Authorized Signs have been erected and are on display, no person
shall stop a Vehicle other than a taxicab on any of the Highways or parts of
Highways names or described in Schedule '6' to this by-law on the side or
sides of Highways set out in the schedule.
b. Notwithstanding subsection (a), a person driving of a passenger Vehicle may
temporarily stop in a taxicab stand for the purpose of and while actually
engaged in loading or unloading passengers and/or merchandise provided
that such stopping does not interfere with any taxicab entering or exiting such
taxicab stand.
20. RESERVED PARKING PERMIT
a. The Superintendent may issue a Reserved Parking Permit as defined in Part
11.
.
b. Every Vehicle for which a Reserved Parking Permit has been issued shall be
identified by having the permit affixed thereto on the lower corner of the
interior of the windshield on the passenger side, facing outward.
c. Any Vehicle for which a Reserved Parking Permit has been issued and affixed
may be parked at any legal Parking Space within the Municipality beyond the
time prescribed in Part V, section 1 O(a)(ix) and Schedule '2' of this by-law,
provided that such Vehicle is parked for the purpose of loading or unloading
passengers and/or merchandise or engaged in providing repairs or
installations.
d. The fee for every Reserved Parking Permit shall be charged per Parking
Space per day or part thereof as per the Municipality's rate review.
21 . COMMERCIAL PARKING PERMIT
a. The Superintendent may issue a Commercial Parking Permit, as defined in
Part II, to the owner of any commercial Vehicle operated in the Municipality.
b. Every commercial Vehicle for which a Commercial Parking Permit has been
issued shall be identified by having the permit affixed thereto on the lower
corner of the windshield on the passenger side.
c. Any commercial Vehicle for which a Commercial Parking Permit has been
issued and affixed may be parked at any metered parking or truck loading
space in the Municipality for a period of time not exceeding one hour without
payment of the fee prescribed by this by-law, provided that such Vehicle is
engaged in loading or unloading goods, wares or merchandise.
d. The fee for every Commercial Parking Permit shall be the sum of $100.00 per
year or part thereof. Every Commercial Parking Permit shall expire on the
31
st day of December of the year for which it was issued.
22. ESSENTIAL SERVICE PARKING PERMIT
a. The Superintendent may issue an Essential Service Parking Permit as
defined in Part II, to the owner of any commercial Vehicle required for the
performance of essential services in the Municipality.
b. Every commercial Vehicle for which an Essential Service Parking Permit has
been issued shall be identified by having the permit affixed thereto on the
lower corner of the windshield on the passenger side.
c. Any commercial Vehicle for which an Essential Service Parking Permit has
been issued and affixed may be parked at any parking or truck loading space
within the Municipality without payment of the fee prescribed by this by-law for
any period of time not exceeding one hour provided that such Vehicle is
engaged in providing essential repairs or installations.

d. The fee for every Essential Service Parking Permit shall be the sum of
$100.00 per year or part thereof. Every Essential Service Parking Permit shall
expire on the 31
st day of December of the year for which it was issued.
23. ACCESSIBLE PARKING SPACE
a. No person shall park, stop or leave a Vehicle in an Accessible Parking Space
at any time without displaying an Accessible Parking Permit.
b. No person shall park, stop or leave a Vehicle displaying an Accessible
Parking Permit in an Accessible Parking Space if the Vehicle is not
transporting or picking-up a Person with a Disability.
PART VI - ON STREET PARKING METERS
24. The Highways, parts of Highways and side of Highways named or described in
Schedule '8' to this by-law are hereby designated as Parking Meter Zones and the fee
for the use of a metered Parking Space located in a Parking Meter Zone is as indicated
in the said schedule.
25. No person shall park a Vehicle in a Parking Meter Zone during the time period set out
in Schedule '8', except during legal holidays, unless the driver of the Vehicle deposits
in the Parking Meter for the Parking Space the fee required by Schedule '8'.
26. The maximum length of continuous parking permitted in any Parking Space shall be as
set out in Schedule '8' to this by-law. Every Parking Meter shall have affixed thereto a
sign or notice indicating the hours and days parking is permitted and the maximum
length of time for which continuous parking is permitted in the Parking Space adjacent
thereto, and the fee prescribed for the use of such Parking Space.
27. No person shall park a Vehicle in a Parking Space for a period longer than that for
which payment has been deposited in the Parking Meter or meters, provided however,
that this shall not prevent the driver of a Vehicle from using the unexpired time
remaining in the meter or meters from its previous use without depositing further
payment.
28. No person shall park a Vehicle in a Parking Space for a period longer than the
maximum length of time for which continuous parking is permitted as indicated on the
sign or notice affixed to Parking Meter provided for the Parking Space and described in
Schedule '8' of this by-law.
29. No person shall deposit or cause to be deposited in any Parking Meter any slug, device
or other substitute for a coin of Canada or the United States of America.
30. No person shall park a Vehicle in a Parking Meter Zone in such a manner that it is not
wholly within an area designated as a Parking Space and if the Vehicle is of such
length as to prevent it being parked within one space, then the person parking the
Vehicle shall make the necessary payment in the Parking Meter provided for each
Parking Space occupied. This section shall not authorize a Vehicle to be parked
parallel to the curb or edge of Roadway in a location where angle parking only is
permitted.
31 . TAXICABS
a. The Municipality, on the application of a taxicab operator, may designate
Parking Spaces in a Parking Meter Zone within the Municipality as taxicab
stands and may grant to such operator a license to park taxicabs operated by
that person in such stands.
b. No such taxicab stand shall be greater in length than 16 metres and the
yearly license fee therefore shall be $5.00 per 30 centimetres of curb space.
c. No person shall park a taxicab in a metered Parking Space, whether the
prescribed fee for the use thereof is paid or not, for the purpose of soliciting
business.

d. It shall be lawful for the driver of a taxicab to stop the taxicab in any
unoccupied Parking Space while actually engaged in loading or unloading
passengers, without having to pay the fee prescribed in Schedule '8' · to this
by-law.
32. FUNERAL SERVICES
a. Churches and funeral parlors within the Parking Meter Zone at which funeral
services are being held are hereby given authority to place signs on Parking
Meters, or otherwise in a manner approved by the Municipality, in their
location indicating that parking, except for those attending such service, is
temporarily prohibited in the Parking Spaces.
b. The temporary prohibition on parking shall be for a period of one hour in
advance of the scheduled time of such service and during such service.
c. Where a sign is placed on Parking Meters pursuant to subsection (a), any
person disobeying the instructions of the signs shall be considered violating
the provisions of this part of the by-law.
d. Where a sign is placed on Parking Meters pursuant to subsection (a), it shall
not be necessary for the owner or driver of a Vehicle parked in connection
with such service in the Parking Spaces so marked to deposit any coin during
the aforesaid period.
PART VII - TRAFFIC CONTROL SIGNALS
33. The installation of Traffic Control Signals is hereby authorized at the locations set out in
Schedule '9' to this by-law.
PART VIII- PEDESTRIAN CROSSOVERS
34. When Authorized Signs have been erected and are on display, the Highways or parts
of Highways named or described in Schedule '1 O' to this by-law, at the locations set out
in the schedule, are hereby designated as Pedestrian Crossovers.
PART IX- THROUGH HIGHWAYS
35. The Highways or parts of Highways named or described in Schedule '11' to this by-law
are designated as "Through Highways" except at intersections thereon where Traffic
Control Signals are installed and are in operation.
For all Highways or parts of
Highways designated as a "Through Highway", a stop sign or a yield sign shall be
erected facing approaching traffic on the Highways or parts of Highways intersecting
the "Through Highway".
PART X -INTERSECTION STOP SIGNS
36. Stop signs shall be erected at the intersections named or described in Schedule '12' to
this by-law, facing the traffic travelling in the direction specified in the schedule.
PART XI -INTERSECTION YIELD SIGNS
37. Yield signs shall be erected at the intersections named or described in Schedule '13' to
this by-law, facing the traffic travelling in the direction specified in the schedule.
PART XII - TURN MOVEMENTS
38. U-TURNS
When Authorized Signs have been erected and are on display, no person shall operate
a Vehicle in such a manner as to make a U-Turn on any of the Highways or parts of
Highways named or described in Schedule '14' to this by-law.
39. PROHIBITED MOVEMENT(S)
When Authorized Signs have been erected and are on display, no person operating a
Vehicle on any of the Highways or parts of Highways named or described in Schedule
15
-
'15' to this by-law, proceeding in the direction or emerging from a property set out in
the schedule, shall make the movement(s) set out in the schedule, during the times
and/or days set out in the schedule.
·
40. LANE DESIGNATION
When Authorized Signs have been erected and are on display, a person operating a
Vehicle on any of the Highways or parts of Highways named or described in Schedule
'16' to this by-law, proceeding in the direction set out in the schedule, at the location
set out in the schedule, shall make the movement(s) set out in the schedule.
PART XIII - ONE WAY STREETS
41 . When Authorized Signs have been erected and are on display, the Highways or parts
of Highways named or described in Schedule '17' to this by-law are designated as One
Way Streets in the direction of travel stated in the schedule.
PART XIV- RATES OF SPEED (km/h)
42. HIGHWAYS
When Authorized Signs have been erected and are on display, the maximum
permissible rate of speed on any of the Highways or parts of Highways named or
described in Schedule '18' to this by-law shall be that rate of speed set out in the said
schedule.
43. BRIDGES
When Authorized Signs have been erected and are on display, the maximum
permissible rate of speed on any bridge named or described in Schedule '19' to this by-
law shall be that rate of speed set out in the said schedule.
PART XV- CENTRE LANE: DUAL LEFT TURNS
44. When Authorized Signs have been erected and are on display, no person shall operate
a Vehicle on any of the Highways or parts of Highways named or described in
Schedule '20' to this by-law, except for the purpose of turning left.
PART XVI- REDUCED LOADS
45. When Authorized Signs have been erected and are on display, no person shall drive a
Vehicle or combination of Vehicles on the Highway if the gross weight of the Vehicle(s)
i_s in excess of the weight posted on the Highway.
46. When Authorized Signs have been erected and are on display, no person shall drive a
Vehicle or combination of Vehicles on a bridge if the gross weight of the Vehicle(s) is in
excess of the weight posted for the bridge on the Highway.
47. No person shall drive a Vehicle or combination of Vehicles on the Highway that is in
excess of the dimensions and weight set out in the Highway Traffic Act without first
having obtained a permit from the Superintendent.
PART XVII- HEAVY TRUCK PROHIBITION
48. HIGHWAYS
When Authorized Signs have been erected and are on display, no person shall drive,
move, or operate a Heavy Truck on any of the Highways or parts of Highways named
or described in Schedule '21 ' to this by-law, during the times and/or days set out in the
said schedule.
49. PARKING OF TRUCKS
No person shall park a Heavy Truck on any Highway.

50. BONA FIDE DESTINATIONS
Section 48 shall not apply to the driver of a Heavy Truck making a bona fide delivery
to, or a collection from, a premise or premises which cannot be reached by any route
other than a Highway or part of a Highway, where Heavy Trucks are prohibited within
this by-law, provided that when making such a delivery or collection the same Highway
or portion of Highway is travelled only insofar as is unavoidable in getting to and from
such premise or premises.
PART XVIII - SCHOOL BUS LOADING ZONES
51. When Authorized Signs have been erected and are on display, the driver of a school
bus must stop on those Highways or parts of Highways named or described in
Schedule '22' to this by-law on the side or sides of Highways set out in the said
schedule.
PART XIX- COMMUNITY SAFETY ZONES
52. When Authorized Signs are on display, the Highway or parts of Highways named or
described in Schedule '23' to this by-law are designated as Community Safety Zones
as set out in the schedule.
PART XX- BICYCLE LANES
53. When Authorized Signs are on display, the parts of Highways named or described in
Schedule '24' to this by-law, on the side or sides of Highways set out in the schedule,
for the length of time set out in the schedule are designated for use only by persons
riding a Bicycle in the direction or directions set out in the schedule.
PART XXI- PENALTIES
54. PENAL TIES
-
a. Every person who contravenes any provision of this by-law is guilty of an
offence and is liable upon conviction to a fine not exceeding Five Thousand
Dollars ($5,000.00), exclusive of costs, for each offence, recoverable under
the Provincial Offences Act.
b. In addition to the provisions of subsection (a), every person who contravenes
any provision of this by-law is guilty of an offence and is liable upon conviction
to the set fine, set out in Schedule '25', exclusive of costs.
c. Notwithstanding subsections (a) and (b)
above, every person who
contravenes any of the provisions of PARTS VII, VIII, IX, X, XI, XII, XIII, XIV,
XV, XVI, Section 49 of PART XVII , XVIII , XIX and PART XX is guilty of an
offence and shall be subject to the penalty provided for such violations under
the Highway Traffic Act.
d. Where a Vehicle has been parked or stopped in contravention of this by-law,
the owner of the Vehicle is guilty of an offence, even though the owner was
not the driver of the Vehicle at the time of the contravention of the by-law, and
is liable to a fine set out in subsection (a) of this part.
55. VOLUNTARY PAYMENT OF SET FINE
a. Notwithstanding all other provisions of this part in respect to penalties for
violations of the provisions of this by-law, any person may, upon presentation
of a Parking Infraction Notice issued by a By-law Enforcement Officer alleging
commission of any of the offences under this by-law as further described in
Schedule '25' :
pay out of court within the time limit specified on the said Parking
Infraction Notice, the set fine for such offence, as indicated in Schedule
'25' to this by-law. Upon such payment no further proceedings shall be
taken under this by-law in respect of the said alleged offence.

b. If a voluntary payment is not made in accordance with the procedure provided
in subsection (a), the procedures of the Provincial Offences Act or any
successors thereof shall apply.
56. EXEMPTIONS
Sections 9, 10, 24, 25, 38, 39, 41, 44, 45, 46, 47, 48 and 49 shall not, if compliance
therewith would be impractical, apply to an emergency Vehicle as defined within the
Highway Traffic Act and/or a Vehicle engaged in works undertaken for or on behalf of
the Municipality or a public utility.
PART XXIII - ACTS TO GOVERN
57. HIGHWAY TRAFFIC ACT
The provisions of this by-law shall be subject to the provisions of the Highway Traffic
Act.
The definitions contained within the Highway Traffic Act shall apply in the
interpretation of this by-law except where they are inconsistent, in which case the
definition under this by-law shall apply.
PART XXIV- BY-LAWS REPEALED
58. By-law Numbers 40-2006, 42-2008, 43-2008, and 38-2010, as amended, are repealed
as of the effective date set out in Part XXVI.
59. Where the provisions of any other by-laws are inconsistent with the provisions of this
by-law, the provisions of this by-law prevail, unless otherwise stated.
60. Notwithstanding section 58, the provisions of By-Law Numbers 40-2006, 42-2008,
43-2008, and 38-2010, as amended, are deemed to continue in force and effect with
respect any and all permits, fines, appeals or prosecutions issued, filed or commenced
under those by-laws and any assessment, rate, charge, tax, fee, liability or penalty
outstanding under those by-Laws may be collected as if such by-laws had not been
repealed.
61 . Notwithstanding section 58, by-laws named in section 58 are deemed to continue in full
force and effect with respect to any enforcement under Part I and Part II of the
Provincial Offences Act, R.S.O. 1990, c. P. 33, as amended, as well as the set fine
schedule as approved by the Chief Justice, until such time as the Chief Justice
approves the set fine schedule for this by-law. Where the provisions of by-laws named
in section 58 are inconsistent with the provisions of this by-law, the provisions of this
by-law shall prevail.
PART XXV- VALIDITY
62. Should any part, section or provision of this by-law be declared by a court of competent
jurisdiction to be invalid, the same shall not affect the validity of the by-law as a whole
or in part thereof other than the part which was declared to be invalid .

PART XXVI - EFFECTIVE DATE
63. This by-law will come into force and take effect on the date of passage.

BY-LAW 42-2020
BEING A BY-LAW to amend By-law 05-2013, being a by-law to regulate the traffic and
the placing, standing, stopping or parking of an object or vehicle on highways and parking
lots within the Township of Ashfield-Colborne-Wawanosh to include Falls Reserve Line
WHEREAS a subsection 11(3)1 of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended authorizes a municipality to pass by-laws respecting its highways, including
parking and traffic on highways;
AND WHEREAS Section 128 of the Highway Traffic Act, R.S.O., 1990, c. H.8, as
amended, authorizes a municipality to pass a by-law prescribing a rate of speed different
from the rate set out in section 128 of the Highway Traffic Act;
AND WHEREAS in the interest of public safety Falls Reserve Line, Col borne Ward, has
been determined to require a reduced rate of speed;
NOW THEREFORE the Council of the Township of Ashfield-Colborne-Wawanosh
enacts as follows:
1.
That Schedule 18 - Rates of Speed - Highways of By-law 05-2013 be
amended to include Falls Reserve Line under the heading of Colborne Ward
with the maximum rate of speed of 50 km per hour.
2.
That Schedule 18 of By-law 05-2013 be replaced with the Schedule as
attached hereto.

BY-LAW NUMBER 39-2022
BEING A BY-LAW to amend By-law 05-2013, being a by-law to regulate the traffic and
the placing, standing, stopping or parking of an object or vehicle on highways and
parking lots within the Township of Ashfield-Colborne-Wawanosh.
WHEREAS a subsection 11 (3)1 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended
authorizes a municipality to pass by-laws respecting its highways, including parking and
traffic on highways;
AND WHEREAS Council has determined it in the interest of public safety that a portion of
Londesboro Road be designated as a No Parking Zone;
NOW THEREFORE, the Council of the Corporation of the Township of Ashfield-Colborne-
Wawanosh enacts as follows:
1. That Schedule 1 - No Parking Zones of By-Law 05-2013 be amended to include the
