THE CORPORATION OF THE TOWNSHIP OF ASPHODEL-NORWOOD BY-LAW NUMBER 2026-05 Being a By-law to set water service charges for users of the Trentview Estates Water System in the Township of Asphodel-Norwood WHEREAS the Corporation of the Township of Asphodel-Norwood (the "Corporation") operates and maintains municipal water distribution systems; and AND WHEREAS Section 391 of the Municipal Act, 2001, S.O. 2001, c.25 as amended provides that the municipality may pass By-laws imposing fees or charges on any class of persons, 391 (1) (a) of the Municipal Act, 2001 for services or activities provided or done by or on behalf of it; and AND WHEREAS the Municipal Act, 2001, the Public Utilities Act, 1990, and the Ontario Water Resources Act,1990, all or separately, authorizes the Municipality to pass By-laws to regulate the supply of water and to fix the price to be paid by owners or occupants of lands who derive a benefit from the installation and maintenance of the Public Water Systems; and AND WHEREAS the Council deems it necessary and expedient to establish water rates for the Trentview Estates Water System operated within the Township of Asphodel-Norwood; and AND WHEREAS a Regular and Public Meeting was advertised and held on December 9, 2025. NOW THEREFORE the Council of the Township of Asphodel-Norwood enacts as follows: 1. The Administration service charge of $36.02 per month shall apply to all lots in the Trentview Estates Subdivision with the exception of vacant lots; 2. The connection charge of $6.86 per month shall apply to all lots in the Trentview Estates Subdivision; 3. Metered Water rates shall be $1.50 per cubic meter and will be billed on a bi-monthly basis. 4. All newly constructed buildings that are connected to the Trentview Water system will have a meter installed. Meters are to be installed by the Township or an approved designate at a fee as approved in the Township's current Fees & Charges By-law. 5. A charge of SEVENTY-FIVE DOLLARS ($75.00) will be made for turning off the water service and also for turning on the water service after the initial installation. No person other than an employee of the Township's Public Works or Water/Wastewater Department or their designate shall turn off or turn on the water supply from the Trentview Estates Distribution system to the owner's premises. 6. It is the responsibility of the property owner to have the water shut off valve accessible to the Township at all times. 7. If water is disconnected from a unit, the monthly consumption charge shall be discontinued, however the monthly administration fees and connection amounts shall continue. 8. Fees and charges that are due and unpaid will be charged a penalty of one and one quarter (1.25) percent per month. Costs incurred by the municipality in collecting unpaid fees and charges shall be added to the amount due and owing. The Treasurer may add unpaid fees and charges THE CORPORATION OF THE TOWNSHIP OF ASPHODEL-NORWOOD BY-LAW NUMBER 2026-05 to the tax roll of the property to which the service was provided and collect them in the same manner as municipal taxes. 9. This By-law shall come into force and and take effect on February 1, 2026. 10. That By-law 2025-05 is hereby repealed, effective February 1, 2026.
