Consolidated Trailer By-law 2025-19 2 THE CORPORATION OF THE TOWNSHIP OF ASSIGINACK BY-LAW NO. 2025-19 BEING A BY-LAW TO PROHIBIT AND/OR REGULATE THE OCCUPANCY OF RECREATIONAL TRAILERS, TRAILERS OR TENTS WITHIN THE TOWNSHIP OF ASSIGINACK WHEREAS Section 9 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS Section 10 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality may pass by-laws respecting matters related to: - (2)(5) economic, social and environmental well-being of the municipality, - (2)(6) health, safety and well-being of persons, and - (2)(8) protection of persons and property; AND WHEREAS Section 128(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a municipality may prohibit and regulate public nuisances; AND WHEREAS Section 164(1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes a municipality to prohibit or licence trailers located in the municipality; AND WHEREAS Section 224(a) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, authorizes municipalities to consider the well-being and interests of the municipality; AND WHEREAS Section 391(1)(a) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, enables a municipality to pass by-laws imposing fees or charges for services; NOW THEREFORE the Council of the Corporation of the Township of Assiginack enacts as follows: SECTION 1 -- DEFINITIONS For the purpose of this by-law, the following definitions shall apply: - "By-law Enforcement Officer" or "Officer" means a person appointed by Council to enforce this by-law and who has the powers of a Provincial Offences Officer for that purpose. Consolidated Trailer By-law 2025-19 3 - "Council" means the Council of the Corporation of the Township of Assiginack. - "Immediate Family" means the spouse, partner, children of the property owner or co-owner, and their respective spouses, partners, and children. - "Occupy" means to inhabit a recreational trailer, trailer, or tent by cooking, eating, or sleeping in it. - "Recreational Trailer or Vehicle" means an object designed for accommodation intended and used exclusively for travel, recreation and vacation and which is capable of being drawn or propelled by a motor vehicle or is self-propelled and includes but is not limited to tent trailers, motor homes, park models, campers, or similar transportable accommodation but does not include a mobile home. - "Short Term Accommodation" means a building or structure or any part thereof that operates or offers a place of temporary residence, lodging or occupancy by way of concession, permit, lease, rental agreement or similar arrangement for any period equal to or less than 30 consecutive calendar days, through all or any part of the calendar year. Short term accommodation does not mean or include a motel, hotel, authorized bed and breakfast establishments, authorized tourist cabin or cottage, authorized camping establishments, hospital, authorized commercial resort unit, village commercial resort unit or similar commercial or institutional uses. - "Temporary Trailer Permit" or "Permit" means a permit issued by the Township of Assiginack authorizing temporary occupancy of a recreational trailer, trailer or tent, valid only under the conditions set out in this by-law. - "Trailer" means any recreational trailer or vehicle as defined above. - "Township" means the Corporation of the Township of Assiginack. SECTION 2 -- TEMPORARY TRAILER PERMIT AGREEMENT 1. No person shall occupy a recreational trailer, trailer, or tent on any land within the Township without first applying for and obtaining a valid Temporary Trailer Permit issued by the Township of Assiginack. 2. A Temporary Trailer Permit shall only authorize occupancy for the period from April 1 to November 15 annually. Occupancy of trailers between November 16 and March 30 is strictly prohibited, regardless of permit status. 3. Temporary Trailer Permits may be issued for the purpose of occupancy during the construction of a dwelling on the property, provided the occupancy occurs strictly within the permitted period (April 1 to November 15). 4. For any other purpose, a Temporary Trailer Permit shall only be issued if the occupant(s) are immediate family members of the property owner or registered co-owners of the land. No other persons, including extended family such as aunts, uncles, cousins, or unrelated individuals, shall be permitted unless they are co-owners of the subject land. 5. Applications for a Temporary Trailer Permit must include: (a) A detailed description of the exact location where the trailer will be placed; (b) Information on provisions for heat, hydro, water, sewage, garbage disposal, on-site parking and access to the property; (c) A letter of authorization from the property owner, if the applicant is not the owner; (d) Proof of immediate family relationship or ownership interest, if Consolidated Trailer By-law 2025-19 4 applicable; (e) Any other information deemed necessary by Council or its designate to properly evaluate the application. 6. Temporary Trailer Permits shall only be valid for the calendar year in which they are issued and must be renewed annually. 7. In no event shall an owner of a recreational trailer or vehicle, permit it to be used as a Short Term Accommodation. Refer to By-law 2022-07 for operating a Short Term Accommodation. 8. The maximum permitted trailer length is forty (40) feet. 9. By-law Enforcement Officers are authorized to request and verify government-issued identification and documentation to confirm eligibility, including proof of relationship or ownership. SECTION 3 -- CAMPING PROHIBITIONS 1. Camping, as defined in this by-law, except as permitted by Section 2, is hereby declared a public nuisance and is prohibited within the Township of Assiginack. 2. No person shall camp or occupy a recreational trailer, trailer, or tent on any land within the Township without a valid permit issued under Section 2. 3. The only exceptions to the prohibitions above are: (a) Camping in areas specifically designated by the Township's Comprehensive Zoning By-law, if any; (b) Special exemptions granted by Council for specific events (e.g., scouts/guides, family reunions), which may be issued without a fee at Council's discretion; (c) Camping governed by external organizations such as the Bruce Trail Conservancy on their trail network, subject to their regulations. SECTION 4 -- PENALTY AND ENFORCEMENT PROVISIONS 1. Any person who contravenes any provision of this by-law is guilty of an offence and upon conviction is liable to the fines prescribed under the Provincial Offences Act, R.S.O. 1990, c. P.33. 2. No person shall willfully obstruct, hinder or interfere with a By-law Enforcement Officer in the performance of their duties under this by- law. 3. Where an Officer has reasonable grounds to believe an offence has been committed, the Officer may require the name, address, and proof of identity of the person and may require proof of immediate family relationship or ownership to enforce this by-law. The person shall supply the required information. SECTION 5 -- SHORT TITLE This by-law shall be known as the "Trailer and Camping By-law." SECTION 6 -- VALIDITY Consolidated Trailer By-law 2025-19 5 If any section or provision of this by-law is declared invalid by a court of competent jurisdiction, such invalidity shall not affect the remainder of the by-law. SECTION 7 -- REPEAL By-law No. 2020-14 of the Corporation of the Township of Assiginack, and any amendments thereto, are hereby repealed. SECTION 8 -- EFFECTIVE DATE This by-law shall come into force and effect on the date of its final passing.
