## The Corporation of the Town of Atikokan By-law No. 08-11 Being a by-law for the regulating of traffic, parking, standing or stopping offences, and prohibiting of heavy traffic WHEREAS Section 207 of the Municipal Act, M.45, R.S.O. 1990, as amended, subject to the Highway Traffic Act, H.8, R.S.O. 1990, provides for regulating traffic on the highways and for prohibiting heavy traffic as defined in the by-law; WHEREAS the Council of The Corporation of the Town of Atikokan deems it expedient to consolidate Traffic By-law No. 23-79, and amending By-laws Nos. 8-80, 31-81, 15-82, 40-82, 37-83, 15-84, 46-90, 34-94, 47-94, 43-95 and 11-99; THEREFORE the Council of The Corporation of the Town of Atikokan ENACTS AS FOLLOWS: ## 1. TITLE: - 1.1 This by-law may be referred to as "THE TRAFFIC BY-LAW". ## 2. DEFINITIONS: ## 2.1 In this By-law; - 2.1.1 "AUTHORIZED SIGN" means any sign, or any marking placed or made on a roadway, curb or sidewalk, which is authorized by Council for the purpose of regulating traffic; - 2.1.2 "BICYCLE" includes a tricycle and unicycle but does not include a motor assisted bicycle; - 2.1.3 "BY-LAW ENFORCEMENT OFFICER" mean a by-law enforcement officer appointed by Council for The Corporation of the Town of Atikokan; - 2.1.4 "BOULEVARD" means that portion of a street or highway that has been leveled or planted with grass or otherwise improved to indicate that it is not to be used for vehicular traffic and which is not designed nor intended for, or used by, the general public for the passage or parking of vehicles and which lie outside the lateral lines of a roadway as defined herein; where curbs are installed, such curbs shall be the lateral lines of the street or highway; - 2.1.5 "CLERK" means Clerk of The Corporation of the Town of Atikokan as appointed by Council: - 2.1.6 "COMMERCIAL MOTOR VEHICLE" means a motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, casket wagons, fire apparatus, buses, and tractors used for hauling purposes on the highways; - 2.1.7 "COMMUNITY SAFETY ZONE" means a highway or part of a highway that is identified by "Community Safety Zone" signs as prescribed in regulations under the Highway Traffic Act, and where public safety is of special concern and fines have been increased for certain traffic violations; - 2.1.8 "COUNCIL" means the Council for The Corporation of the Town of Atikokan; | 2.1.9 | "CROSSWALK" means, that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the roadway; or, any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or by lines or | |-------------------|-----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------| | 2.1.10 | "CURB" shall include the edge of the traveled portion of a street; | | 2.1.11 | "DRIVER" means a person who drives a vehicle on a highway; | | 2.1.12 | "HEAVY TRUCK" means a commercial motor vehicle having a weight when unloaded of three (3) tons or more, or when loaded a weight of five (5) tons or more; | | 2.1.13 | "HIGHWAY" includes a common and public highway, laneway, Street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof; | | 2.1.14 | "HOLIDAY" includes Sunday, New Year's Day, Good Friday, Easter Monday, Victoria Day, Canada Day, Labour Day, Thanksgiving, Christmas Day, Boxing Day, and any day appointed by proclamation of the Governor-General or the Lieutenant Governor as a public holiday; | | 2.1.15 | "INTERSECTION" means the area embraced within the prolongation or connection of the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other; | | 2.1.16 | "OFFICER OF THE CORPORATION" means any person designated by the Municipal Corporation to issue permits for the moving of heavy vehicles, loads, objects or structures; | | 2.1.17 | "MOTORCYCLE" means a self-propelled vehicle having a seat or saddle for the use of the driver and designed to travel on not more than three wheels in contact with the ground, and includes a motor- scooter, but does not include a motor-assisted bicycle; | | 2.1.18 | "MOTOR ASSISTED BICYLCE" means a bicycle, | | 2.1.18.1 | that is fitted with pedals that are operable at all times to propel the bicycle, that weighs not more than fifty-five kilograms, | | 2.1.18.2 2.1.18.3 | that has no hand or foot operated clutch or gearbox driven by the motor and transferring power to the driven wheel, | | 2.1.18.4 | and | | 2.1.18.5 | that does not have sufficient power to enable the bicycle to attain a speed greater than 50 kilometres per hour on level ground within a distance of 2 kilometres from a standing start; | | 2.1.19 | "ONE-WAY STREET" means a highway designated for the use of one way traffic; | | 2.2.20 | "PARK" or "PARKING" when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; | - 2.2.21 "PEDESTRIAN" means a person on foot, or in a wheelchair or motorized cart, and a child in a carriage; - 2.2.22 "PERMIT" means a written request for the moving of heavy vehicles, loads, objects or structures in excess of the dimensional limits or weight limits set; - 2.2.23 "POLICE SERVICES" means the Ontario Provincial Police or any policing agency that is under contract with The Corporation of the Town of Atikokan; - 2.2.24 "PUBLIC UTILITY" includes the works pertaining to the transmission of gas, electricity and telephone equipment; - 2.2.25 "PUBLIC WORKS DEPARTMENT" means the Public Works Department of the Town of Atikokan; - 2.2.26 "REGULATIONS" means the Ontario Regulations as passed and revised from time to time by the Province of Ontario; - 2.2.27 "ROADWAY" means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively; - 2.2.28 "SCHOOL CROSSING" means any part of a highway, designed as such by authorized signs, which motor or other vehicles are prohibited from entering while a pedestrian is thereon or about to enter thereon; - 2.2.29 "SIDEWALK" means that portion of a street between the curb lines or the lateral lines of a roadway and the adjacent property lines intended for the use of pedestrians; - 2.2.30 "STAND" or "STANDING", when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers; - 2.2.31 "STOP" means a complete cessation of movement; - 2.2.32 "STOP" or "STOPPPING", when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or of a traffic control sign or signal; - 2.2.33 "TRAFFIC" includes pedestrians, ridden or herded animals, vehicles, and other conveyances either singly or together while using any street for the purpose of travel; - 2.2.34 "TRAFFIC CONTROL DEVICE" means any sign, or roadway, curb or sidewalk marking; or other device erected or placed under the authority of the Town Council for the purpose of guiding or directing traffic; - 2.2.35 "U-TURN" means the turning of a vehicle within a highway so as to proceed in the opposite direction; - 2.2.36 "VEHICLE" means a motor vehicle, trailer, traction engine, farm tractor, road building machine and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include the cars of electric or steam railways running only upon rails; - 2.2.37 "WHEELCHAIR" means a chair mounted on wheels driven by nuscular or any other kind of power and used for the carriage of person who has a physical defect or disability Where a definition is not found in this by-law the Highway Traffic Act definition shall apply. ## 3. ENFORCEMENT AND ADMINISTRATION: - 3.1 This By-law shall be enforced: - 3.1.1 By members of the Ontario Provincial Police; or - 3.1.2 By By-law Enforcement Officers. ## 4. OBEDIENCE TO SIGNS &amp; ENFORCEMENT: - 4.1 Every person shall promptly obey all signs given either by a peace officer or by traffic control device or traffic signal. - 4.2 The Police Service and the By-Law Enforcement Officer shall enforce the provisions of this By-Law. - 4.3 The Public Works Department is authorized to place and maintain all: - 4.3.1 Traffic signs and traffic signals as are required to give effect to the provisions of this By-law; - 4.3.2 The Public Works Department is authorized to erect emergency signs to facilitate; - 4.3.3 The removal of snow, ice or debris from all highways and other public property under the jurisdiction of the Town; - 4.3.4 The construction or repair of roads, curbs, gutters, sewers and watermains; - 4.3.5 The installation and repair of any public utility provided, however, that whenever possible such signs shall be erected at least one hour before the work is to commence; ## 5. PARKING PROHIBITED AT ALL TIMES: - 5.1 No person shall park a vehicle on a highway, excepting an emergency vehicle in any of the following places, or portions of same including blocking any part of: - 5.1.1 Within three metres of a fire hydrant; - 5.1.2 In front of a public or private driveway or laneway; - 5.1.3 Within an intersection, or within eight {8) metres of an intersection; - 5.1.4 On any roadway having an overall width of less than six {6) meters; - 5.1.5 On a pedestrian crosswalk; - 5.1.6 On a sidewalk; - 5.1.7 On any boulevard; - 5.1.8 On any bridge or overpass; - 5.1.9 On any street in such a manner as to obstruct traffic; - 5.1.10 Between the hours of five o'clock in the forenoon {5:00 a.m.) and eight o'clock in the forenoon (8:00 a.m.} from November 15' to March 315t ; - 5.1.11 No vehicle shall be parked on a highway for the sole purpose of offering the vehicle for sale; - 5.1.12 No person shall park a vehicle on grass within any road allowance. ## 6. OPERATION OF VEHICLES: ## 6.1 Rate of Speed: - 6.1.1 No person shall drive a motor vehicle on the highways or portions of highways designated in Column 1 &amp; 2 of Schedule X attached hereto to at a greater speed than is prescribed in Column 3 of said Schedule X; - 6.1.2 No person shall drive a motor vehicle on the highways or portion of highways in the Town of Atikokan at a greater speed than 50 km per hour, except as may be otherwise provided for within this ByLaw. ## 6.2 Prohibited Turns: - 6.2.1 U-Turns: No driver or operator of a vehicle upon a highway shall turn the vehicle so as to proceed in the opposite direction: - 6.2.1.1 unless it can be made in safety without interfering with other traffic, on Main Street, in its entirety; - 6.2.1.2 at any intersection where stop signs are erected. - 6.2.2 Where authorized signs are displayed, no person operating a vehicle in the intersection or portion of the highway as set out in Schedule VIll of this by-law. ## 6.3 Driving Rules: - 6.3.1 No person shall drive a motor vehicle upon a sidewalk or footpath except for the purpose of driving directly across it; - 6.3.2 Before driving onto a sidewalk the driver or operator of a vehicle emerging from a driveway or laneway shall yield the right-of- way to pedestrians upon the sidewalk; - 6.3.3 No person shall drive a motor vehicle over a raised curb except where a ramp is provided; - 6.3.4 No person shall intersect a funeral or authorized procession while it is in motion except under the direction of a Police Officer; - 6.3.5 Reverse - Not-In-Safety: No driver or operator of a vehicle shall Reverse a vehicle unless the movement can be made in safety and without interfering with pedestrians and vehicles upon the highway. ## 7. PEDESTRIAN RULES: - 7.1 Pedestrians shall keep to the right while walking on the sidewalks. Where sidewalks do not exist, pedestrians shall walk on the left side of a street facing oncoming traffic. - 7.2 Pedestrians shall not step from the sidewalk in crossing a street without looking in both directions and shall cross only on crosswalks or pedestrian crossovers. - 7.3 Pedestrians shall observe the movement of traffic at street intersections and govern themselves accordingly; - 7.4 Pedestrians shall observe the signal of a peace officer in charge of directing traffic. ## 8. Roller Skate, Etc: - 8.1 No person upon roller blades/skates/in-line skates, or riding in, or by means of any coaster; toy vehicles, skateboard or similar device shall travel on a roadway except to directly cross the roadway on a crosswalk. ## 9. BICYCLE RULES: - 9.1 Every rider of a bicycle shall at all times when riding same on a public thoroughfare, keep his or her feet on the pedals, and both hands on the handlebars thereof, and no person while riding a bicycle shall indulge in trick riding or carry any articles in his or her hands, or otherwise ride so as to prevent the full use of both hands to operate or control such bicycle. - 9.2 Two or more persons riding bicycles shall not ride abreast or nearly so, on any highway in the Town of Atikokan, except in the course of overtaking and passing other vehicles. - 9.3 No person shall ride a bicycle, other than a tricycle or sidewalk bicycle, on any sidewalks in the Town of Atikokan. - 9.4 No person riding on a bicycle designed for carrying one person only shall carry any other person thereon. ## 10. STOPPING AND PARKING: - 10.1 No person shall park or stop a vehicle upon any highway or portion thereof except as follows: - 10.1.1 where there is a raised curb, on the right side of the roadway, having regard to the direction such vehicle was proceeding, with the right front and rear wheels parallel to, and not more than thirty {30} centimetres from, the curb; - 10.1.2 where there is no curb or there is a rolled curb, on the right side of the roadway, having regard to the direction such vehicle was proceeding, with the right front and rear wheels parallel to and as near to the right hand limit of the roadway as is possible without stopping or parking on a sidewalk, footpath, boulevard or any other part of the highway not intended for the use of vehicles; - 10.1.3 where parking spaces are designated by lines painted on the roadway, within those lines; - 10.1.4 The provisions of sub-sections (i) and fil) do not apply where by reason of the accumulation of snow or ice it is impossible for the driver of a vehicle to comply, provided however, that a driver shall at all times comply with these sub-sections as closely as is possible under the circumstances; - 10.1.5 No person shall park a trailer, as defined by the Highway Traffic Act, on any street or in a municipal parking lot at any time for any purpose unless it is securely attached to a vehicle capable of drawing it upon a highway; - 10.1.6 No person shall park a vehicle with left wheels to curb; - 10.1.7 No person shall park a vehicle facing the wrong way of the intended traffic direction. ## 11. STOPPING A VEHICLE PROHIBITED AT ALL TIMES: - 11.1 No person shall stop a vehicle - 11.1.1 On a sidewalk; - 11.1.2 Between a safety zone and the adjacent side of the roadway or within thirty {30} metres of a safety zone; - 11.1.3 Within thirty {30) metres of an excavation, repair work or obstruction; - 11.1.4 On a roadway alongside another vehicle which is stopped or parked; - 11.1.5 On a roadway, directly opposite a vehicle stopped or parked on the other side of the roadway, where the width of the roadway is less than ten (10} metres; - 11.1.6 On a bridge, overpass or other elevated structure or within a tunnel or underpass; - 11.1.7 On or adjacent to, either side or end of a centre strip separating two roadways. ## 12. PARKING PROHIBITED: - 12.1 No person shall park a vehicle on a highway, excepting an emergency vehicle in any of the following places, or portions of same including blocking any part of: - 12.1.1 Within three metres of a fire hydrant; - 12.1.2 In front of a public or private driveway or laneway; - 12.1.3 Within an intersection, or within ten {10} metres of an intersection; - 12.1.4 On any roadway having an overall width of less than six {6} metres; - 12.1.5 On a pedestrian crosswalk; - 12.1.6 On a sidewalk; - 12.1.7 On any boulevard; - 12.1.8 No person shall park a vehicle on grass within any road allowance; - 12.1.9 On any bridge or overpass; - 12.1.10 On any street in such a manner as to obstruct traffic; - 12.1.11 Between the hours of five o'clock in the forenoon (5:00 a.m.) and eight o'clock in the forenoon {8:00 a.m.) from November 1s' to March 315!; - 12.1.12 No vehicle shall be parked on a highway for the sole purpose of offering the vehicle for sale; - 12.1.12. No person shall park a trailer, as defined by the Highway Traffic Act, on any street or in a municipal parking lot at any time for any purpose unless it is securely attached to a vehicle capable of drawing it upon a highway; - 12.1.13 No person shall park a vehicle with left wheels to curb; - 12.1.14 No person shall park a vehicle facing the wrong way of the intended traffic direction; - 12.1.15 When properly worded signs have been erected and are on display, no person shall park a vehicle in any of the places set out in Schedule XI (Handicapped Parking Only) attached to and forming part of this by-law, except those vehicles in which are displayed a disabled person parking permit as issued by the Ontario Ministry of Transportation and Communications or such equivalent permit issued by other governments. ## 13. SIGNING: - 13.1 When authorized signs are displayed, no person shall, in contravention thereof, park a vehicle on a highway: - 13.1.1 At a freight loading zone during the time period indicated on the sign; - 13.1.2 Within thirty {30) metres of a bus stop; - 13.1.3 Within thirty {30) metres of the driveway of a firehall; - 13.1.4 Within fifteen (15} metres of an intersection or within thirty {30} metres of an intersection controlled by traffic signals; - 13.1.5 Within thirty {30} metres of a railroad level crossing; - 13.1.6 Within fifteen {15} metres of a school crossing; - 13.1.7 Adjacent to school property, between the hours of 8:00 a.m. and 5:00 p.m. on days on which school is regularly held; - 13.1.8 Adjacent to a playground or park, between the hours of 8:00 a.m. and 10:00 p.m. on any day; - 13.1.9 Within a turning basin or cul-de-sac, or within nine {9} metres of a cul-de-sac; - 13.1.10 Alongside the tracks of any railway; - 13.1.11 On any shoulder; - 13.2 Yellow paint applied to the face of a curb shall be an authorized sign meaning that no vehicle shall be parked adjacent to the area painted yellow at any time. - 13.3 Where authorized signs are displayed, no person shall, in contravention thereof: - 13.3.1 Park a vehicle on any highway set out in Schedule I to this by-law; - 13.3.2 Park a vehicle on any highway set for a restricted time period as set out in Schedule Ill to this by-law. - 13.4 When properly worded signs have been erected and are on display, on the streets listed in Schedule IX, no person shall park a vehicle in any such designated parking spaces for a period in excess of one (1} hour. All vehicles parked on the streets listed in Schedule IX of this by-law shall be parked in accordance with Section 13.3.2. ## 14. IHROUGH TRAFFIC: - 14.1 The highways set out in Schedule IV to this by-law are designated as through highways for the purposes of the Highway Traffic Act. ## 15. STOP SIGNS: - 15.1 The intersections set out in Column I of Schedule V to this by-law, are designated as intersections where stop signs shall be erected facing traffic in the direction set out in Column 2. ## 16. YIELD SIGNS: - 16.1 The intersections set out in Schedule VI to this by-law, are designated as intersections where yield right-of-way signs shall be erected facing traffic in the direction set out in Column 2. ## 17. HEAVY TRUCK ROUTE: - 17.1 Unless authorized signs are displayed, no person shall drive a heavy truck on any highway, other than those set out in Schedule VII to this by-law. - 17.2 Notwithstanding sub-section 15.1, heavy trucks used for garbage collection, recycling collection, moving vans, or those owned and used by the Town for municipal purposes, shall be permitted to operate on any highway. ## 18. HALF LOAD LIMIT: - 18.1 Where authorized signs are displayed, half load limits shall apply for designated advertised periods of time, on Heavy Truck Routes as set out in Schedule VII. ## 19. SNOW REMOVAL: - 19.1 Vehicles interfering with the Traffic and Snow Removal: - 19.1.1 No person shall: - 19.1.1.1 Park or stand a vehicle on a highway in such a manner as to interfere with the movement of traffic or the clearing of snow from the highway; - 19.1.1.2 Deposit of Snow on Highway - No person shall deposit snow or ice on a roadway without permission in writing to do so from the Town. ## 20. GENERAL - 20.1 Exemptions: Where compliance herewith would be impracticable, the provisions of Sections 6 {drive); 9 (stop); 8 {park); 11 {signs); 6.2 {turns); and 6.1 (speed} of this by-law shall not apply to: - 20.1.1 Ambulances, police or fire department vehicles, public utility emergency vehicles, or - 20.1.2 Vehicles actually engaged in works undertaken for or on behalf of The Corporation of the Town of Atikokan, or any municipal corporation or public transit system. ## 21. PENALTIES: - 21.1 General: Every person who contravenes this by-law is guilty of an offence, and on conviction, is liable to a fine of not more than Five Thousand Dollars ($5,000.00) exclusive of costs and all such penalties shall be recoverable under the Provincial Offences Act, R.S.O. 1990, and amendments thereto. ## 22. COMMUNITY SAFETY ZONES: - 22.1 The streets and parts of streets set out in Schedule Il attached hereto are designated as "Community Safety Zones" as defined in this by-law. ## 23.PARKING TAGS: - 23.1 Where a member of the Ontario Provincial Police, or a By-law Enforcement Officer, finds a vehicle parked in contravention of any of the stopping and parking provisions of this by-law, he/she shall attach to the vehicle a parking tag, in the form of a serially numbered notice, stating: - 23.1.1 The license plate number of the vehicle; - 23.1.2 That the vehicle is unlawfully parked, - 23.1.3 The date, time and place of the alleged offence. - 23.2 The ticket may be voluntarily paid at the office of the Town of Atikokan or, by mail with the ticket, together with the applicable sum to the Municipal Office, within seven (7} days exclusive of Saturday, Sundays, and other holidays, after the day when the ticket is issued. - 23.3 The Town of Atikokan assumes no responsibility for receipt of any such voluntary payment other than those for with it has issued a receipt. - 23.4 In the event of failure to make such voluntary payment a Notice of Impending Conviction will be issued to the owner of the vehicle. - 23.5 The ticket shall be paid at the offices of the Treasurer of the Town of Atikokan within seven days, exclusive of Saturdays, Sundays or holidays, after the date when the ticket is issued. A receipt, if requested, shall be given to the person making the payment: - 23.5.1 The following amounts shall be accepted as payment of a penality in full satisfaction in respect to the alleged offences respectively; - 23.5.1.1 For each parking violation, twenty-five dollars ($25.00); - 23.5.1.2 For each parking violation by a non-handicapped licensed vehicle in a "Handicapped Parking" spot, three hundred dollars ($300.00). - 23.6 If voluntary payment is note made in accordance with the procedure provided in this section, the provisions of subsection 23.7 shall apply. - 23.7 Except as herein otherwise provided, any person who contravenes the provision of this By-Law is liable to a fine not exceeding $300.00, exclusive of costs. This subsection shall not apply to the following sections: 6.1., 6.2., 7., 14., 19., 22. - 23.8 Any vehicle found parked or left contrary to this By-Law, may, in addition to the penalty for contravention, be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicles, which may be enforced in the manner provided by the Repair and Storage Liens Act, R.S.O. 1990, c.R.25 ## 24. ONTARIO TRAFFIC ACT, and PROVINCIAL OFFENCES ACT TO GOVERN: - 24.1 The provisions of this by-law shall be subject to the provisions of the Highway Traffic Act and the Provincial Offences Act. ## 25. EXCEPTION OF MUNICIPAL AUTHORITIES: - 25.1 For the purposes of maintenance and emergency or provisions of public services, the parking provisions of the by-law and amendments thereto shall not apply to the equipment and vehicles owned by or to any equipment or vehicles under contract or hire with the Town of Atikokan. White Street | South side, 225 White Street One parking space south of main entrance | ## The Corporation of the Township of Atikokan ## By-law No. 36-11 Being a by-law to amend By-law No. 08-11, a by-law with respect to the regulation of traffic WHEREAS the Council of the Corporation of the Township of Atikokan deems it expedient to amend By-law 08-11, a by-law to control and regulate traffic; NOW THEREFORE the Council of The Corporation of the Township of Atikokan ENACTS AS FOLLOWS: 1. That Schedule I - No Parking to By-law 08-11 be amended to include "No Parking" on the odd (East) side of Steerola Street from the addresses of 411 Steerola Street to 417 Steerola Street, Northbound on Steerola Street. 2. That traffic control signs as required to give effect to the provisions of this bylaw, or as are required to warn or guide traffic for the safety and convenience of the public, be erected by the Public Works Dept. 3. The penalties provided in the Highway Traffic Act shall apply to offences against this By-law. 4. This by-law shall take effect and come into force upon date of passing. O. 1990, provides for regulating traffic on the highways and for prohibiting heavy traffic as defined in the by-law. WHEREAS it is deemed necessary and expedient to amend certain sections of By-Law No. 08-11, being a by-law for the regulating of traffic, parking, standing or stopping offences, and prohibiting of heavy traffic. WHEREAS this amending by-law shall be referred to as "THE TRAFFIC BY-LAW". No. 59-12 and shall become a part of By-Law No. 08-11. WHEREAS the amendments to the Traffic By-Law No.08-11 listed herein are in order of Additions, Deletions and Amendments; THEREFORE the Council of The Corporation of the Town of Atikokan ENACTS AS FOLLOWS: ## ADDITIONS ## Section 2 Definitions "Driveway" means the access to private property which is perpendicular to the street or highway, includes that portion of the property from the intersection of the street to the intersection of the property line. ## Section 5 Parking Prohibited At All Times - 5.2 No vehicle or combination of vehicles exceeding 6,75 m (22 feet) in length shall park on any street in any Residential Zone at any time. Exception is permitted when parked temporarily for the purpose of active delivery service or maintenance to the adjacent property. ## Section 12 Parking Prohibited - 12.1.17 No vehicle shall park on any street or highway between November 1,thru to March 31 between the hours of 5:00 a.m. and 8:00 a.m, for the purpose of snow removal. With an exception, the following streets which are subject to portable signs which may be installed as required by the Town of Atikokan: Main Street from Burns Street to White Street O'Brien Street from Niven Street to MacKenzie Avenue ## DELETIONS ## Section 2 Definitions "Commercial Motor Vehicle" shall be deleted. "Motorcycle" shall be deleted "Motor Assisted Bicycle" shall be deleted. ## Section 13 Signing ## 13.4 · Shall be deleted ## AMENDMENTS ## Section 2 Definitions "Boulevard" means the area travelled between the edge of the roadway and the adjoining property line that may or may not contain a sidewalk or other facilities or features, does not include a driveway. "Highway" includes a common and public highway, laneway, street, avenue, parkway, square, place, bridge, ay part of which is intended for or used by the general public for the passage of vehicles and includes the area between the lateral property lines thereof. "Pedestrian" means a person afoot, or a person in a wheelchair or a child's carriage or physically handicapped person operating a motorized mobility-aid. "Vehicle" . means a vehicle, trailer, motor assisted bicycle, motorized snow machine, traction engine, farm tractor, all-terrain vehicle, road building machine, and any vehicle drawn, propelled or driven by any kind of power, including muscular power, does not include a wheelchair. ## Section 5 Parking Prohibited at all Times That section 5.1.3 is hereby amended to read Within an intersection, or within ten (10) metres of an intersection. That section 5.1.10 is hereby amended to read On any highway set out in "Schedule 1 to this by-law. ## Section 12 Parking Prohibited That section 12.1.11 is hereby amended to read On any highway set out in Schedule I, Schedule Ill and Schedule IX, to this by-law. That sections 12.1.12 to 12.1.16 shall be renumbered accordingly. ## Section 13 Signing That section 13.1.4 is hereby amended to read - Within ten (10) metres of an intersection or within thirty (30) metres of an intersection controlled by traffic signals.
