The Corporation of the Town of Atikokan
By-Law No. 01-24
Being a By-Law to Establish Water Rates, and Sewage Service Rates.
WHEREAS pursuant to Section 391 of the MunicipalAct, 2001, S.O. 2001, c.25, as amended, a
municipality may pass by-laws imposing fees or charges on any class of persons for services or
activities provided or done by or on behalf of it; and
WHEREAS Section 1(1) of the MunicipalAct, 2001, S.O. 2001, c.25, as amended, defines a
public utility as a system that is used to provide water and sewage services to the public; and
WHEREAS the Council of The Corporation of the Town of Atikokan deems it expedient to
enact a by-law to establish fees for water and wastewater services provided by the Town of
Atikokan;
NOW THEREFORE the Council of The Corporation of the Town of Atikokan
ENACTS AS FOLLOWS:
1.
That By-Law No. 03-23 be hereby rescinded.
2.
That rates for water and for sewage service supplied to owners and occupants of all property
are hereby imposed as indicated in Schedule "A" attached hereto and forming part of this by
law.
3.
That water and sewage service levies become due and payable as follows:

25% (twenty-five percent) of the current year's annual rate on February 29, 2024
-
25% (twenty-five percent) of the current year's annual rate on April 30, 2024
- 25% (twenty-five percent) of the current year's annual rate on July 31, 2024
- 25% (twenty-five percent) of the current year's annual rate on September 30, 2024

That a late payment charge of one and one-half percent (1.5%) per month in default on the
first of each month.

That default of payment the Corporation may shut off the water supply after a period of sixty
(60) days in arrears of due date, and may be recoverable by action in a Court of competent
jurisdiction.
6.
That a service charge shall be imposed for turning "ON" and "OFF" the water supply with
the exception of an emergency turn OFF to carry out repairs and turn ON after repairs are
completed as per the current fees by-law.
7.
That any request for work to be done after normal working hours will be billed as per current
fees by-law with the exception of an emergency.
8.
That this By-law shall come into force and take effect the lS day of January, 2024.
READ a FIRST, SECOND and THIRD time and FINALLY PASSED this 8 day of
January, 2024.
