1. DEFINITIONS
In this By-Law:
1.1
"ALL-TERRAIN VEHICLE or ATV" means an off-road vehicle that,
(a)
has four wheels, the tires of which are all in contact with the ground,
(b)
has steering handlebars,
(c)
has a seat that is designed to be straddled by the driver, and
(d)
is designed to carry,
i)
a driver only and no passengers, or
ii)
a driver and only one passenger, if the vehicle,
A)
has one passenger seat that is designed to be straddled
by the passenger while sitting facing forward behind the
driver, and
B)
is equipped with footrests for the passenger that are
separate from the footrests for the driver.
1.2
"AUTHORIZED SIGN" means any sign or device placed or erected on a
highway or on a designated fire route under the authority of this by-law and
the Town's Director of Operations, Public Works Manager of Operations,
Chief of Police or Fire Chief, for the purpose of regulating, warning or guiding
traffic.
1.3
"BICYCLE" means a two-wheeled, three-wheeled or four-wheeled
conveyance propelled by muscular power and equipped with steering
handlebars, pedals, one or two saddles or seats and a braking system but
excludes an E-Bike.
1.4
"BICYCLE LANE" - means that portion of a Highway that is identified as a
bicycle lane by solid-line or dotted-line pavement markings or by signage
erected by the Town of Aylmer.
1.5
"BOULEVARD" shall be construed to mean that portion of every highway or
road allowance within the limits of the Town of Aylmer which is not used as a
sidewalk, driveway access or travelled roadway.
1.6
"BYLAW ENFORCEMENT OFFICER" means a person duly appointed by the
Town of Aylmer for enforcing the provisions of this By-law and who shall have
the powers as set out in the Provincial Offences Act, R.S.O., 1990, Chapter
P.33 as amended.
1.7
"COMMERCIAL MOTOR VEHICLE" means a motor vehicle having
permanently attached thereto a truck or delivery body and includes
ambulances, hearses, casket wagons, fire apparatus, buses and tractors
used for hauling purposes on the highways; as defined under the Ontario
Highway Traffic Act.
1.8
"COMMUNITY SAFETY ZONE" is identified as parts of a roadway where
public safety is of special concern. This includes roadways near Schools, and
marked by official signs indicating such zone. Traffic fines are increased for
violations committed within these zones.
1.9
"COMPACT CAR" means a small and economical car occupying little space
compared with others of its type.
1.10
"COMPACT CAR PARKING SPACE" means parking spaces designed by
reducing the depth of the stall to 4.5 metres. Compact car parking spaces
shall be clearly delineated by means of signage.
1.11
"CORNER" with reference to a highway intersection means the point of
intersection of the lateral curb lines or, in the absence of curbs, the extension
of the edges of the roadways.
1.12
"CORPORATION" means the Corporation of the Town of Aylmer.
1.13
"COUNCIL" means the Council of the Corporation of the Town of Aylmer.
1.14
"CROSSWALK" that part of a highway at an intersection that is included
within the connections of the lateral lines of the sidewalks on opposite
sides of the highway measured from the curbs or, in the absence of
curbs, from the edges of the roadway, or any portion of a roadway at an
intersection or elsewhere distinctly indicated for pedestrian crossing by
signs or by lines or other markings on the surface; as defined under the
Ontario Highway Traffic Act.
1.15
"CURBLINE" means, where the curb is constructed, the line thereof; where
no curb is constructed "curbline" shall be construed as meaning the edge of
the travelled portion of the highway.
1.16
" DESIGNATED FIRE ROUTE" or "FIRE ROUTE" means any private route,
road, lane, ramp, or other means of vehicular access to or egress from a
building or structure, and it may include part of a parking lot designated
under the authority of this by-law.
1.17
"DESIGNATED DISABLED PERSON PARKING SPACE" means a parking
space located on any public highway in the Town of Aylmer or on a Town
owned or operated parking lot, or on any property owned or occupied by the
municipality or any local board thereof designated for parking of vehicles, and
marked by an official sign and/or pavement markings indicating such space
to be for the sole use of vehicles displaying a disabled person parking permit.
1.18
"DESIGNATED SCHOOL ZONE" means any part of a public highway in the
Town of Aylmer designated as a School Zone, and marked by official signs
indicating such zone.
1.19
"DISABLED PERSON" is as defined under the Ontario Highway Traffic Act.
1.20
"DISABLED PERSON PARKING PERMIT" means a disabled person parking
permit issued under the Ontario Highway Traffic Act.
1.21
"DRIVEWAY" means improved land on a highway which provides vehicular
access from the roadway to a laneway or a parking area on adjacent land.
1.22
"E-BIKE" - means a conveyance that:
(a)
has steering handlebars and is equipped with pedals;
(b)
travels on not more than three wheels in contact with the ground;
(c)
is capable of being propelled by muscular power applied to pedals;
(d)
has one or more electric motors that have, singly or in combination,
the following characteristics:
i)
it has a total continuous power output rating, measured at the
shaft of each motor, of 500 watts or less;
ii)
if it is engaged by the use of muscular power, power assistance
immediately ceases when the muscular power ceases;
iii)
if it is engaged by the use of an accelerator controller, power
assistance immediately ceases when the brakes are applied;
and
iv) it is incapable of providing further assistance when the bicycle
attains a speed of 32 km/h on level ground;
(e)
bears a label that is permanently affixed by the manufacturer and
appears in a conspicuous location stating, in both official languages,
that the vehicle is a power-assisted bicycle as defined in this
subsection; and
(f)
has one of the following safety features:
i)
an enabling mechanism to turn the electric motor on and off that
is separate from the accelerator controller and fitted in such a
manner that it is operable by the driver; or
ii)
a mechanism that prevents the motor from being engaged
before the conveyance attains a speed of 3 km/h
1.23
"ELECTRIC VEHICLE" means,
(a)
a battery electric vehicle that runs only on a battery and an electric
drive train, or
(b)
a plug-in hybrid electric vehicle that runs on a battery and an electric
drive train, and also uses an internal combustion engine;
1.24
"ELECTRIC VEHICLE CHARGING STATION" means a publicly or privately-
owned parking space that provides access to equipment that supplies a source
of electricity for charging electric vehicles.
1.25
"EXTREME TERRAIN VEHICLE" means an off-road vehicle that,
(a)
has six or eight wheels, the tires of which are all in contact with the
ground,
(b)
has no tracks that are in contact with the ground,
(c)
has seats that are not designed to be straddled, and
(d)
has a minimum cargo capacity of 159 kilograms.
1.26
"FAIL TO YIELD" means one or more of the following failings:
(a)
to give an audible signal to a Pedestrian of an intention to pass;
(b)
to pass a Pedestrian at a slow rate of speed and at a safe distance;
and/or
(c)
contravening Section 144(29) of the Highway Traffic Act.
1.27
"FIRE CHIEF" means the Fire Chief of the Town of Aylmer or persons
designated to act on behalf thereof.
1.28
"GROSS VEHICLE WEIGHT" means the combined weight of vehicle and
load as defined under the Ontario Highway Traffic Act.
1.29
"HEAVY TRUCK" means any commercial motor vehicle which has a
registered gross vehicle or gross weight exceeding 3,000 kilograms
according to the current permit or vehicle registration which has been issued
under the Ontario Highway Traffic Act, regardless of the actual weight of such
vehicles, but does not include a vehicle operated by or on behalf of the
Corporation, a passenger vehicle, an ambulance or any vehicle of a police
or fire department.
1.30
"HELMET" - means a helmet which meets the requirements of Sections 3
and 4 of Ontario Regulation 610 under the Highway Traffic Act and which
is fastened under the wearer's chin.
1.31
"HIGHWAY" means includes a common and public highway, street,
avenue, parkway, driveway, square, place, bridge, viaduct or trestle, any
part of which is intended for or used by the general public for the passage
of vehicles and includes the area between the lateral property lines thereof
as defined under the Ontario Highway Traffic Act.
1.32
"HIGHWAY TRAFFIC ACT" as defined under R.S.O. 1990, Chapter H.8.
1.33
"HOLIDAY" means a day appointed or proclaimed by the Government of
Canada, the Province of Ontario, or the Town of Aylmer to be celebrated as
a public holiday and includes: New Year's Day, Family Day, Good Friday,
Easter Sunday, Easter Monday, Victoria Day, Canada Day, Civic Holiday
(first Monday in August), Labour Day, Thanksgiving Day, Christmas Day and
Boxing Day.
1.34
"IDLE" means the operation of the engine of a vehicle while the vehicle
is not in motion and not being used to operate auxiliary equipment that
is essential to the basic function of the vehicle and "idling" has a
corresponding meaning.
1.35
"IN-LINE SKATING or ROLLER SKATING" - means propelling oneself while
wearing a boot or shoe or other piece of footwear that is mounted upon one
or more wheels which are attached to the sole of the boot or shoe. In-Line
Skate or Roller Skate shall have the corresponding meaning.
1.36
"INTERSECTION" means the area embraced within the prolongation or
connection of the lateral curb lines or, if none, then of the lateral boundary
lines of two or more highways that join one another at an angle, whether or
not one highway crosses the other as defined under the Ontario Highway
Traffic Act.
1.37
"LANEWAY" means improved land adjacent to the highway which provides
access from the highway to a parking area or to commercial property on
adjacent land.
1.38
"LAYOVER" means stopping at a point along a transit route for a
maximum of fifteen (15) minutes to allow a transit vehicle to
adjust to service schedules.
1.39
"LOADING ZONE - BUS" means the part of a highway set apart for the
exclusive purpose of parking a school bus to load or unload the same.
1.40
"LOADING ZONE - TRUCK" means the part of a highway set apart for the
exclusive purpose of parking a commercial vehicle to load or unload the
same.
1.41
"LOCAL BOARD" means a school board, police services board, planning
advisory committee, or any other board, commission, committee, body or
local authority established and exercising any power or authority under any
general or special Act with respect to any of the affairs or purposes, including
school purposes, of a municipality or of two or more municipalities or parts
thereof.
1.42
"MOBILE WORKSHOP" means
a)
a vehicle containing equipment that must be operated inside or in
association with the vehicle; or
b)
a vehicle serving as a facility for taking measurements or making
observations or conducting maintenance or construction operated
by or on behalf of a municipality, public utility or police, fire or
emergency service.
1.43
"MOTOR HOME" refers to a motor vehicle which can be moved and
includes living quarters designed for accommodation. This definition may
include types of Recreation Vehicles, however, excludes mobile homes.
1.44
"MOTOR VEHICLE" includes an automobile, a motorcycle, a motor-
assisted bicycle unless otherwise indicated in this Act, and any other
vehicle propelled or driven otherwise than by muscular power, but does not
include a street car or other motor vehicle running only upon rails, a power-
assisted bicycle, a motorized snow vehicle, a traction engine, a farm
tractor, a self-propelled implement of husbandry or a road-building
machine; as defined under the Ontario Highway Traffic Act.
1.45
"MOTORIZED SNOW VEHICLE" means a self-propelled motorized vehicle
designed to be driven primarily on snow as defined under the Motorized
Snow Vehicles Act. that;
(a) has headlights and taillights that must be on at all times
(b) has an operating rear brake light
(c) has a registration number on both sides of the cowling
(d) has insurance
1.46
"MOBILE HOME" means a single dwelling, designed and constructed to be
transported on its own chassis and capable of being moved to a new location
on short notice. This definition excludes a travel trailer or tent trailer, camping
trailer, truck camper, motor home or a recreational vehicle.
1.47
"MOBILITY AID" means a mobility device used to facilitate the transportation
of a person with a disability, such as a wheelchair but also includes mobility
electric scooters that are equivalent to a power wheelchair but configured like
a motorscooter.
1.48
"M.T.O" means the Ministry of Transportation of the Province of Ontario.
1.49
"MULTI-PURPOSE OFF-HIGHWAY UTILITY VEHCILE" means an off-road
vehicle that,
(a)
has four or more wheels, the tires of which are all in contact with the
ground,
(b)
has a steering wheel for steering control,
(c)
has seats that are not designed to be straddled, and
(d)
has a minimum cargo capacity of 159 kilograms.
1.50
"MUNICIPALITY" means the Corporation of the Town of Aylmer.
1.51
"OFFICER" means either a member of the Aylmer Police Service or any
other person authorized by Council for enforcing or carrying out the
provisions of this by-law.
1.52
"OFFICIAL SIGN" means a sign approved by the Ministry of Transportation.
1.53
"OFF-ROAD MOTORCYCLE" means an off-road vehicle, designed primarily
for recreational use, that,
(a)
has steering handlebars,
(b)
has two wheels, the tires of which are all in contact with the ground,
(c)
has a minimum wheel rim diameter of 250 millimetres,
(d)
has a minimum wheelbase of 1,016 millimetres,
(e)
has a seat that is designed to be straddled by the driver,
(f)
is designed to carry a driver only and no passengers, and
(g)
does not have a sidecar.
1.54
"OFF-ROAD VEHICLE" has the same meaning as in the Off-Road Vehicles
Act;
1.55
"ONE-WAY STREET" means a street upon which motor vehicular traffic is
limited to movement in one direction; as defined under the Ontario Highway
Traffic Act.
1.56
"PARK" or "PARKING", when prohibited, means the standing of a vehicle,
whether occupied or not, except when standing temporarily for the purpose
of and while actually engaged in loading or unloading merchandise or
passengers; as defined under the Ontario Highway Traffic Act.
1.57
"PARKING INFRACTION" means any unlawful parking, standing or stopping
of a vehicle that constitutes an offence.
1.58
"PARKING SPACE" means a parking space located on any public highway
in the Town of Aylmer or on a Town owned or operated parking lot, or on any
property owned or occupied by the municipality or any local board thereof
designated for parking of vehicles, and marked by an official sign and/or
delineated by pavement markings indicating such space.
1.59
"PEDESTRIAN" - means a person afoot, children in wheeled carriages and
a person using a mobility aid but excludes a person engaged in the activity of
In-Line Skating or Roller Skating or Skateboarding.
1.60
"PEDESTRIAN CROSSOVER" means any portion of a roadway,
designated by By-law of a municipality, at an intersection or elsewhere,
distinctly indicated for pedestrian crossing by signs on the highway and
lines or other markings on the surface of the roadway as prescribed by the
regulations; as defined under the Ontario Highway Traffic Act.
1.61
"POLICE OFFICER" means a member of the Aylmer Police Service.
1.62
"PRIVATE ROADWAY" means any private road, lane, ramp, or other means
of vehicular access to or egress, not owned or maintained by the municipality
of the Town of Aylmer, from a building or structure and it may include part of
a parking lot.
1.63
"PROPERTY OWNER" includes:
a.) a person deemed to be the owner under the appropriate land registration
system; and,
b.) a person who is or appears to be receiving rent or other compensation
from the use of land by a third party whether receiving it as the owner
or as agent, trustee or representative or like capacity.
1.64
"PUBLIC LAND" means land or property owned, occupied, managed,
maintained or controlled by the Corporation of the Town of Aylmer, including
a Sidewalk and a Sidewalk Walkway but excluding the traveled portion of a
Highway;
1.65
"RECREATIONAL OFF-HIGHWAY VEHICLE" means an off-road vehicle
that,
(a)
has four or more wheels, the tires of which are all in contact with the
ground,
(b)
has a steering wheel for steering control,
(c)
has seats that are not designed to be straddled, and
(d)
has an engine displacement equal to or less than 1,000 cubic
centimetres.
1.66
"ROADWAY" means the part of the highway that is improved, designed or
ordinarily used for vehicular traffic, but does not include the shoulder, and,
where a highway includes two or more separate roadways, the term
"roadway" refers to any one roadway separately and not to all of the
roadways collectively; as defined under the Ontario Highway Traffic Act.
1.67
"SCOOTER-STYLED E-BIKE" means a type of E-Bike that is not a Bicycle-
styler E-Bike;
1.68
"SIDEWALK" includes all such parts of a highway as are set aside by the
Corporation for use by the general public for the passage of pedestrians.
1.69
"SKATEBOARD" means a conveyance mounted on two or more wheels
which are attached to a platform upon which a person stands while propelling
oneself. Skateboarding shall have the corresponding meaning. If the context
requires, Skateboard shall also mean the act of Skateboarding.
1.70
"STAND" or "STANDING", when prohibited, means the halting of a vehicle,
whether occupied or not, except for the purpose of and while actually
engaged in receiving or discharging passengers; as defined under the
Ontario Highway Traffic Act.
1.71
"STOP" or "STOPPING", when prohibited, means the halting of a vehicle,
even momentarily, whether occupied or not, except when necessary to
avoid conflict with other traffic or in compliance with the directions of a
police officer or of a traffic control sign or signal; as defined under the
Ontario Highway Traffic Act.
1.72
"STOPOVER" means a scheduled delay of a maximum of fifteen (15)
minutes at a transit vehicle terminal to allow transit vehicles to
adjust service schedules.
1.73
"TIME" means standard time except in periods when daylight saving time is
in effect, in which periods it shall mean daylight saving time.
1.74
"THROUGH HIGHWAY" means a highway or part of a highway designated
as such by the Minister or by by-law of a municipality, and every such
highway shall be marked by a stop sign or yield right of way sign in
compliance with the regulations of the Ministry; as defined under the
Ontario Highway Traffic Act.
1.75
"TOWN" means the Corporation of the Town of Aylmer.
1.76 "TRAILER" as defined in this by-law is a transportation device that is typically
drawn by another motor vehicle. The definition of Trailer in this By-Law
includes trailers for hauling equipment, vehicles, materials, goods, and
camping trailers.
1.77
"TRAFFIC CONTROL DEVICE" means any sign or other device erected or
placed for the purpose of guiding, directing or regulating traffic.
1.78
"TRAFFIC CONTROL SIGNAL SYSTEM" means any device manually,
electronically or mechanically operated for the regulation of traffic.
1.79
"TRANSIT VEHICLE" means transit vehicles, such as paratransit
vehicles, school buses, tour buses and motor coaches.
1.80
"U-TURN" means to turn a vehicle upon a highway so as to proceed in the
opposite direction.
1.81
"VEHICLE" includes a motor vehicle, trailer, traction engine, farm tractor,
road-building machine as defined in the Ontario Highway Traffic Act, and
any vehicle drawn, propelled or driven by any kind of non-muscular power
but does not include cars of electric or diesel electric railways running
exclusively upon rails.
1.82
"WHEEL CHAIR" includes a seated wheeled vehicle that can be driven by
muscular power or other types of power, and is designed for and used by
people whose mobility is limited by one or more conditions or functional
impairments.

INTERPRETATION
In this By-law,
3.1
All distances/ dimensions are indicated in the metric measurement.
3.2
A word interpreted in the singular number has a corresponding meaning when
used in the plural.
3.3
Reference to the masculine gender shall be interpreted to refer to all genders.
3.4
The word "may" shall be interpreted to be permissive.
3.5
The word "shall" shall be interpreted to be imperative.
4.
APPLICATION
4.1
This By-law shall apply to all highways under the jurisdiction of the
Corporation of the Town of Aylmer.
4.2
Except where otherwise expressly provided by this by-law or the Highway
Traffic Act, every person who:
(a)
contravenes any provision of this by-law; or
(b)
is the owner of a vehicle that is parked, standing or stopped in
contravention of any provision of this by-law, is guilty of an
offence and on conviction is liable to any penalty as provided in
the Provincial Offences Act.
5.
ENFORCEMENT
5.1
All provisions under this By-law may be enforced by an Aylmer Police Officer
and "designated" civilian personnel, or Municipal By-law Enforcement Officer
appointed by the Council of the Town of Aylmer designated pursuant to the
Provincial Offences Act as a Provincial Offences Officer.
5.2
Where a vehicle is found in contravention of the provisions of this By-law, an
officer so finding the vehicle may complete and place upon or attach to the
vehicle or give to the person driving the vehicle an infraction notice in the form
of a serially numbered notice stating:
5.2.1 the license number of the vehicle, concise description of vehicle and
the expiry date of the sticker;
5.2.2 a description of the offence;
5.2.3 the date, time and location of the alleged offence;
5.2.4 the signature of the issuing officer;
5.2.5 the set fine for the alleged offence;
5.2.6 that the owner or driver thereof may make a voluntary early payment
in the amount and manner set forth in Section 56 or pay the set fine
as indicated on the infraction notice prior to the 15th day as set out in
the Provincial Offences Act and Set Fine Schedule "Q" attached.
5.3
Where an individual is found in contravention of the provisions of this By-law,
an officer may detain them and require they provide identification for the
purposes of issuing an infraction notice stating:
5.3.1 the name of the individual in contravention of the By-Law;
5.3.2 a description of the offence;
5.3.3 the date, time and location of the alleged offence;
5.3.4 the signature of the issuing officer;
5.3.5 the set fine for the alleged offence;
5.3.6 that the individual may make a voluntary early payment in the amount
and manner set forth in Section 56 or pay the set fine as indicated on
the infraction notice prior to the 15th day as set out in the Provincial
Offences Act and Set Fine Schedule "Q" attached.
5.4
Where a vehicle has been left parked, stopped or left standing in
contravention of this by-law as passed, the owner of the vehicle,
notwithstanding that they were not the driver of the vehicle at the time of the
contravention of the by-law, is guilty of an offence and is liable to the fine
prescribed for the offence unless, at the time of the offence, the vehicle was
in the possession of some person other than the owner without the owner's
consent.
5.5
No person shall permit a vehicle to be parked or left on Corporation-owned
or occupied land without the authorization of the Corporation.
5.6
An appointed Officer or Police Officer may cause a vehicle parked or left in
contravention of this by-law to be moved or taken to and placed or stored in a
suitable place and all costs and charges for removing, care and storage, if
any, are a lien against the said vehicle which may be enforced in the manner
provided by the Repair and Storage Liens Act.
5.7
No person shall prevent, hinder or obstruct, or attempt to hinder or obstruct
an Officer who is exercising a power or performing a duty under this By-law.
5.8
For the purposes of this By-law, the holder of a permit as defined in the
Ontario Highway Traffic Act, shall be deemed to be the owner of the vehicle
referred to in the permit if a number plate bearing a number that corresponds
to the permit was displayed on the vehicle at the time an offence was
committed unless the number plate was displayed thereon without his
consent, the burden of proof of which shall be on the holder.
5.9
For the purposes of this By-law, where a number plate issued under the
Ontario Highway Traffic Act, is exposed on a vehicle, the holder of the permit
corresponding thereto shall be deemed to be the owner of that vehicle unless
the number plate was exposed thereon without his consent, the burden of
proof of which is on the permit holder.
6.
TEMPORARY PROVISIONS
6.1
The Chief of Police, Fire Chief, Director of Operations, Public Works Manager
of Operations or their designates are hereby granted authority to make
temporary provisions for the safety of pedestrians and the safe movement of
traffic in the Town, or any part thereof, by means of highway marking signs,
temporary curbs and safety devices, as deemed necessary as result of
accidents, emergency or planned construction projects, parades, or other
occasions where such provisions are required.
6.2
Whenever possible, such temporary provisions shall be confirmed by
resolution of Council prior to being implemented.
7.
HIGHWAY TRAFFIC ACT
7.1
The provisions of this by-law are subject to the provisions of the "Ontario
Highway Traffic Act" and Regulations thereto.
8.
DISPLAYING VEHICLES FOR SALE
8.1
No person shall park any vehicle on any highway or municipally owned
parking lot for the purpose of displaying the same for sale.
8.2
Any owner of a vehicle in violation of Section 8.1 is guilty of an offence under
this by-law.
9.
EXEMPTION OF MUNICIPAL VEHICLES
9.1
This by-law does not apply to vehicles operated by the municipality from time
to time for municipal purposes.
10.
FUNERALS AND PARADES
10.1
No person shall drive any vehicle, except emergency vehicles, between the
vehicles in any duly authorized parade or funeral procession on any highway.
10.2
Any person found in violation of Section 10.1 of this by-law is guilty of an
offence.
11.
PLAYING ON ROADWAYS, MUNICIPALLY OWNED PARKING LOTS & LANDS
11.1
No person shall engage in any group game or sports activity upon roller
skates, roller blades, in-line blades, hand-drawn sleigh, wagon, or riding in or
by means of any non-motorized coaster, skateboard, e-scooter, toy vehicle
or similar device upon any roadway or municipal parking lot.
11.2
No person shall engage in any activity upon a skateboard, rollerskates, in-line
skates, scooter, or similar device upon any sidewalk located in the downtown
core area.
11.3
No person shall engage in any activity upon a skateboard, rollerskates, in-line
skates, scooter, or similar device on any municipally owned lands as posted.
11.4
Any person found in violation of Section 11.1, 11.2 or 11.3 is guilty of an
offence under this by-law.
12.
PROHIBITION OF REPAIRING, WASHING, WAXING OR GREASING OF
VEHICLES
12.1
No person shall make use of any roadway for the purpose of washing,
waxing, greasing or repairing any vehicle, except such emergency repairs as
are necessary to enable the vehicle to be removed from the highway, and
disabled vehicles shall be removed or caused to be removed from the
highway by the driver or owner without delay.
12.2
Any person found in violation of Section 12.1 of this by-law is guilty of an
offence.
13.
RULES OF THE ROAD NOT PROVIDED FOR IN THE HIGHWAY TRAFFIC ACT
13.1
No driver of any vehicle shall drive within, upon, across or along any sidewalk,
path or boulevard except at a driveway, unless the need for such use of a
motor vehicle is created by an emergency, or such motor vehicle is actually
engaged in works undertaken by or on behalf of the Town of Aylmer.
13.2
Any person found in violation of Section 13.1 of this by-law is guilty of an
offence.
14.
UNAUTHORIZED SIGNS
14.1
No person shall place or exhibit any unauthorized device, sign, standard,
tamper with a pay and display device, other marking upon any street
attempting or purporting to guide, direct or regulate traffic or the parking of
vehicles on a street.
i)
Any such device, sign, standard or marking shall be deemed a public
nuisance and any Police or other Officer authorized to enforce this
by-law, may remove the same without notice.
14.2
No unauthorized person shall give any signal or direction attempting or
purporting to direct traffic unless in an emergency to direct traffic around
the scene of an accident, or obstacle, excavation, debris, glass or other
hazard.
14.3
Any person found in violation of Section 14.1 or 14.2 of this by-law is guilty of
an offence.
15.
PROHIBITED TURNS
15.1
No person operating a motor vehicle shall make any turn on any portion of
roadway as set out in Schedule "H" attached to this by-law.
15.2
No person operating a motor vehicle shall make a left turn:
15.2.1
North onto John St., from a private lane opening on the West side of John St.,
approximately 23.5 m. North of Talbot St., and being the exit from the Royal
Bank of Canada parking lot.
15.2.2
South onto John St., from Coopers Alley, being the exit from the Municipal
Parking Lot located North on Sydenham St.;
15.2.3
North onto King St., from Coopers Alley;
15.2.4
East from John St. into Coopers Alley.
15.2.5
West from East Street onto Talbot Street East (Highway #3).
15.2.6
West from St. Andrew Street onto Talbot Street, Monday - Friday, 7:00 a.m.
- 6:00 p.m.
15.3
No person operating a motor vehicle shall make a right turn:
15.3.1
East from John St. into Coopers Alley;
16.
THROUGH HIGHWAYS
16.1
The highways set out in Column 1 of Schedule "G" to this by-law, between
the limits set out in Columns 2 and 3 of the said Schedule are, except as
provided in subsection (2) of this section, hereby designated as "Through
Highways".
16.2
The designation, in subsection (1) of this section, of a highway or part thereof
as a "Through Highway', shall not include any intersection thereon where the
road intersected is a King's Highway or where traffic control signals are
installed.
17.
ONE-WAY TRAFFIC
17.1
Vehicles travelling on highways named in Column 1 of Schedule "E" to this
By-Law, shall only travel in the direction permitted in Column 2 of the said
Schedule, within the limits named in Column 3 and 4 of the said Schedule.
17.2
This section shall come into force when official signs indicating the direction
of traffic have been erected and are on display at every intersection where
movement in the opposite direction is prohibited.
18.
MAXIMUM SPEED
18.1
The maximum rate of speed for any vehicle travelling on any highway within
the Town of Aylmer shall be 50 km/h unless otherwise posted.
18.2
The maximum rate of speed for any vehicle travelling over the Myrtle Street
Bridge shall be 35 km/h.
18.3
The maximum rate of speed for any vehicle travelling in a designated
"Community Safety Zone" with a reduced speed limit as set out in Schedule
"N" shall be 40 km/h.
19.
LOADING AND UNLOADING ZONES
19.1
No person shall stop or park a vehicle in a designated loading zone unless
for the purposes of loading or unloading.
19.2
The highways or portions of highways set out in Column 1 of Schedule "I" to
this By-law on the side set out in Column 2 of the said Schedule between the
limits set out in Column 3 and 4 of the said Schedule are hereby designated
as Loading and Unloading Zones.
20.
SCHOOL BUS LOADING ZONES
20.1
The highways or portions of highways set out in Column 1 of Schedule "A" to
this By-law on the side set out in Column 2 of the said Schedule between the
limits set out in Column 3 and 4 of the said Schedule and at the school or
institution set out in Column 5 of the said Schedule are hereby designated as
"School Bus Loading Zones".
20.2
Each of the designations referred to in Schedule "A" shall not become
effective until the highways or portions thereof are appropriately signed to
comply with the Regulations made under the Ontario Highway Traffic Act.
20.3
When a School Bus Loading Zone has been established and signs have been
erected and are on display, no person operating a School Bus shall park the
bus in the vicinity of a school except within a School Bus Loading Zone.
20.4
No vehicle that is not a School Bus may park in an established School Bus
Loading Zone during the times restricted times posted.
21.
TRUCK ROUTE
21.1
Signs indicate that heavy trucks travelling East into Town, along Talbot St.
West (Highway #3) and wanting to reach John St. North (Elgin County Rd.
#73) shall turn North on Elm St. (Elgin County Rd. #53), then East on Beech
St. Trucks entering the Town from John St. North and wanting to reach Talbot
St. West shall turn West on Beech St., (Elgin County Road #53) then South
on Elm St. as set out in Schedule "J" attached to this by-law;
21.2
Heavy trucks are required to remain upon the routes identified in Section 21.1;
21.3
Section (21.2) does not apply where a heavy truck is being necessarily
operated in the usual conduct of business and proceeds by way of the
shortest route to or from any street or part thereof set forth in Schedule "J" of
this by-law.
21.4
All those in contravention of any portion of Sections 21 are guilty of an offence
under this by-law.
22.
IDLING PROHIBITIONS
22.1
No person shall cause or permit a vehicle to idle for more than (5)
consecutive minutes.
22.2.1
Section 22.1 does not apply to;
a)
Police, fire, or ambulance vehicles while engaged in
operational activities, including training activities;
b)
vehicles assisting in an emergency activity;
c)
mobile workshops while they are in the course of being
used for their basic function;
d)
vehicles where the idling is required as part of a repair
process or to prepare a vehicle for servicing;
e)
armoured vehicles where a person remains inside the
vehicle while guarding the contents of the vehicle or while
the vehicle is being loaded or unloaded;
f)
vehicles that remain motionless because of an
emergency, traffic or weather conditions or mechanical
difficulties over which the driver has no control;
g)
vehicles engaged in a parade or race or any other such
authorized event;
h)
transit and passenger vehicles while passengers are
embarking or disembarking en route or at terminals;
i)
transit vehicles while at a layover or stopover location,
except where idling is required to maintain a comfortable
environment for passengers;
j)
vehicles transporting a person where a medical doctor
certifies in writing that for medical reasons, the person
requires the temperature or humidity be maintained within
a certain range;
22.3
The provisions of this section do not apply to federally owned lands upon
which motorized vehicles or electric or diesel electric railways run exclusively
on rails.
22.4 All those in contravention of any portion of Sections 19, 20, 21 or 22 are guilty
of an offence under this by-law.
23.
OVERSIZED LOAD PERMIT
23.1
The Chief of Police, Chief Building Official, Director of Operations and/or the
Clerk may, upon application in writing, grant a permit for the moving of heavy
vehicles, loads, objects, or structures in excess of the dimensional limits and
weight limits as set out in the Ontario Highway Traffic Act of the Province of
Ontario. The permit may be general or may limit the time and particular
highway that might be used, and may contain conditions relating to the
protection of persons and property from injury or damage and may require a
bond or security sufficient to cover the cost of repairing any possible damage
to the highway. The owner, operator, or mover of a heavy vehicle, load,
object, or structure in respect of which a permit is issued under this section is
nevertheless responsible for all damages that may be caused to the highway.
23.2
Any person and/or corporation transporting heavy vehicles, loads, objects, or
structures in excess of the dimensional limits and weight limits as set out in
the Ontario Highway Traffic Act of the Province of Ontario without first
securing a permit as described in section 23.1 is guilty of an offence in
contravention of this by-law.
23.3
Failure to receive a permit under Section 23.1 does not remove the
requirements of the owner, operator or mover of a heavy vehicle, load, object,
or structure of their responsibilities for all damages that may be caused to the
highway or municipal infrastructure.
24.
BICYCLES & E-BIKES
24.1
No person shall operate a bicycle with a wheel diameter in excess of 40 cm.
on any sidewalk located in the Town of Aylmer;
24.2
No person shall operate a e-bike, scooter styled e-bike on any sidewalk
located in the Town of Aylmer.
24.3
Any person found in violation of Section 24.1 or 24.2 of this by-law is guilty of
an offence under this by-law.
25.
BLOCKING OF SIGNALIZED INTERSECTIONS
25.1
No driver or operator of a vehicle, when approaching a green signal light at
an intersection, shall enter the intersection unless traffic in front of him is
moving in a manner that would reasonably lead him to believe he can clear
the intersection before the signal light turns red.
25.2
No person shall stop or park a vehicle within an intersection.
25.3
Any person found in violation of sections 2.51 or 2.52 of this By-law is guilty
of an offence.
26.
COMMUNITY SAFETY ZONES
26.1
The highways or portions of highways set out in Column 1 of Schedule "M" to
this By-law between the limits set out in Column 2 of the said Schedule are
hereby designated as Community Safety Zones.
26.2
Each of the designations referred to in Schedule "M" shall not become
effective until the highways or portions thereof are marked to comply with the
Regulations made under the Ontario Highway Traffic Act.
26.3
The Community Safety Zones are in effect during the hours of 8:00 a.m. to
4:00 p.m., Monday - Friday, during the months of September through June.
27.
FIRE PROTECTION
27.1
In order to give access to or egress from buildings, a sign or signs may be
erected on public or private property in areas approved by the municipality, to
identify a designated "Fire Route". The Fire Chief or his/her designate may
enter onto private lands in order to identify a Fire Route or to evaluate a Fire
Route's signage, and may require such route to be marked with appropriate
signage.
27.2
If after inspection of any building, the Fire Chief of the Corporation is satisfied
that, in order to suppress and prevent the spread of fires, a "Fire Route" is
warranted in respect of any building, he/she may serve or cause to be served
by personal service or prepaid registered mail to the owner of the property
shown on records of the Land Registry Office, an order requiring the owner
to comply with the provisions of the Fire Protection and Prevention Act and/or
Building Code Act Regulations, and every owner shall comply with such order
within sixty (60) days of the date of its service upon him/her or its mailing to
him/her.
27.3 Upon designation of a fire route on private property, in accordance with the
direction and approval of the Fire Chief or his/her designate, the owner
shall:
27.3.1
erect signage at his/her expense, marking the private roadways
thereon as fire routes;
27.3.2
maintain the signs marking it as fire route;
27.3.3
keep the roadway in good repair, clear of ice and snow and free
from all obstructions.
27.4
Those Fire Routes listed in Schedule "L" to this By-law are hereby
designated as "Fire Routes".
27.5
No person shall stop or park a vehicle:
27.5.1
in an area posted a fire route where authorized signage has been
erected and is on display where stopping or parking is prohibited;
27.5.1.1
subsection 27.5.1 does not apply to a person who
parks or stops an ambulance, police, fire or other
emergency vehicle.
27.5.2
within 15 metres of any Fire Hall on the side of the highway on
which the Fire Hall is located.
27.5.3
within 30 metres of any Fire Hall on the opposite side of the
highway on which the Fire Hall is located;
27.5.4
within 3 metres of a fire hydrant or, where the hydrant is set back
from the edge of a highway or street, within 3 meters of the point
at which the prolongation of the center line of the hydrant at right
angles to edge of the highway or street would intersect such edge.
27.6
Any person found in violation of a provision within Section 27.5 of this by-law
is guilty of an offence and enforcement may include immediate removal of the
vehicle under Section 5.6 of this by-law.
28.
GENERAL PARKING REGULATIONS
28.1
No person shall stop or park a vehicle:
28.1.1
on or over any sidewalk, crosswalk, or boulevard
28.1.2
in front of or within 1.0 m of any lane, driveway or alley entrance;
28.1.3
with the right hand wheels of the vehicle at a greater distance from
the curbline than 0.3 m except at places where parking is
otherwise designated and/or marked, or in winter, subject to
Paragraph 28.1.5 of this section, as nearly within such distance
as the conditions of the highway permit;
28.1.4
on the roadway side of a vehicle stopped or parked at the edge
or curb of a highway;
28.1.5
at the edge or curb on the left side of the roadway having regard
to the direction such vehicle was proceeding except where
parking is permitted on the left-hand side of the roadway of a
highway designated for one-way traffic;
28.1.6
in such a position as to obstruct traffic;
28.1.7
on any street within 9 metres of the corner point of the curbline of
any intersecting street, except where otherwise defined in this By-
law and posted;
28.1.8
on any bridge and/or any approach thereto, except on the John
Street North Bridge, East side.
28.1.9
on the same side of the highway directly in front of the entrance
to a church, hotel, theatre, hall or other public building where large
numbers of people assemble, except while actually taking on or
discharging passengers.
28.1.10
within 15 metres of an intersection where Traffic Control Signals
are installed.
28.1.11
within 15 metres of the nearest rail of a level railway crossing.
28.1.12
in a position or place that prevents or is likely to prevent the
removal of any
vehicle already parked on the highway.
28.1.13
in such a manner, where parking spaces are clearly
designated/delineated, as to occupy more than one parking
space or to project beyond such a parking space.
28.1.14 In a location that is posted as an accessible parking space without
properly displaying the required accessible parking permit
placard.
28.2
No person driving or in charge of a motor vehicle, other than a commercial
motor vehicle, shall allow such motor vehicle to stand unattended with the key
in the ignition of the vehicle unless it is locked in such a manner as to prevent
its operation by any person not authorized by the owner, driver or person in
charge.
28.3
On municipally owned lands where there are signs prohibiting or regulating
the parking of vehicles, no person shall park a vehicle in a manner contrary
to the signs.
28.4
All those in contravention of any portion of Sections 28.1, 28.2, 28.3 or 28.4
of this by-law is guilty of an offence and enforcement may include immediate
removal of the vehicle under Section 5.6 of this by-law.
29.
PARKING OF HEAVY TRUCKS, BUSES, TRAILERS AND MOTOR HOMES
29.1
No person shall park a heavy truck or trailer or allow a heavy truck, mobile
home, trailer or bus to stand on any highway in any residential zone, or on
any highway in any commercial zone.
29.2 No person shall park a boat trailer, camper trailer or motor home, to be
parked in any residential or commercial zone for longer than 48 consecutive
hours between April 15th and November 15th.
29.3
The provisions of subsection 29.1 of this section do not apply to prohibit the
parking of any heavy truck, trailer or bus upon a highway in any residential
zone or in any commercial zone, while the operator thereof is actually
engaged in the delivery of goods or services to any premises within the zones
set out in Schedule "I" attached to this By-law, or to prohibit the parking of
any bus or school bus upon a highway in any residential zone or in any
commercial zone, as set out in Schedule "A" attached to this By-law, while
the operator thereof is actually engaged in the embarking or disembarking of
passengers within any such zone.
29.4
All those in contravention of Section 29.1 or 2.92 are guilty of an offence
under this By-Law.
30.
SPECIAL PARKING
30.1
As set out in Schedule "O" attached to this By-law, where appropriate
signs are erected, no person shall park any vehicle or allow any vehicle to
stand:
30.1.1
on the North side of Talbot Street East between a point
measured Easterly 18 m. from Queen Street and a second
point 6 m. to the East of the first point.
31.
OVERNIGHT PARKING
31.1
No person shall, without authorization of the Chief of Police and/or the
Director of Operations, park any vehicle on any street or highway within the
Town of Aylmer, between the hours of 3:00 a.m. to 6:00 a.m., between
November 15th and April 15th inclusive unless specifically authorized within
this By-Law.
31.2
That Parking shall be permitted between the hours of 3:00 a.m. to 6:00 a.m.
on the South Side of Anne Street from Caverly Rd to 200.0m Westerly
between November 15th and April 15th.
32.
CONSECUTIVE PARKING
32.1
No person shall, without authorization of the Chief of Police and/or the
Director of Operations, park any vehicle on any street or highway within the
Town of Aylmer, for a period of time in excess of 72 consecutive hours, year
round.
33.
PARKING SPACES
33.1
The Town Council, with the assistance of the Director of Operations, Public
Works Manager of Operations and the Chief of Police, is hereby authorized
and directed to designate such individual parking spaces as are deemed
proper along the streets within the Town of Aylmer.
34.
PARKING ON ONE-WAY STREET
34.1
Where a street, or part thereof, has been designated pursuant to this by-law
as a one-way street and parking is permitted on both sides of such one-way
street, no person shall park a vehicle on the left hand side of such street
unless the left hand wheels of the vehicle are not more than 0.3 metres from
the curb line, except at places where parking is otherwise designated and/or
marked, or in winter, as nearly within the distance as the conditions of the
highway permit.
34.2
Any owner of a vehicle in contravention of any portion of Sections 29,
30,31,32 or 34 of this by-law is guilty of an offence and the vehicle may be
removed immediately under Section 5.6 of this by-law.
35.
PARALLEL PARKING
35.1
Unless otherwise indicated, no person shall park a vehicle on any highway or
street, other than in the parallel position.
36.
ANGLE PARKING
36.1
The following areas shall be designated as zones where on-street angle
parking shall be permitted as set out in Column 1 of Schedule "K" to this
By-law, on the side set out in Column 2 of the said schedule between the
limits set out in Column 3 and 4 of the said schedule.
36.1.1
The East side of Centre St., from a point 6 m North of the North
limit of Pine St. then Northerly 42.5 m.
36.1.2
The West side of Myrtle St., from a point 43.5 m. South of the
South limit of Chestnut St., to a point 83.5 m. further South.
36.1.3
The North side of South St., from a point 17 m East of
Rutherford Ave to a point 82 meters East of Rutherford Ave.
36.1.4
The North side of Sydenham Street from a point 8.5 m East
of John St. S. to a point 4.5 m West of King Street.
37.
PARKING - PROHIBITED AREAS
37.1
Where appropriate signs are erected and are on display, no person shall
park a vehicle on any highway, at the side and between the limits set out in
Columns 1,2,3, and 4 of Schedule "B" to this By-law, during the prohibited
times or days set out in Column 5 of the said Schedule.
37.2
Where appropriate signs are erected and are on display, no person shall
park a vehicle on a highway adjacent to a school from September through
June inclusive.
37.3
Any owner of a vehicle found in violation of Section 37.1 or 37.2 of this by-law
is guilty of an offence and enforcement may include immediate removal of the
vehicle as outlined in section 5.6.
38.
PARKING - RESTRICTED AREAS
38.1
Where appropriate signs are erected and are on display, no person shall
park a vehicle on any highway, at the side and between the limits set out in
Columns 1,2,3, and 4 of Schedule "C'" to this By-law, at any time, for a
period longer than that set out in Column 5 of the said Schedule.
38.2
Where appropriate signs are erected and are on display, only a compact car
will be allowed to be parked at the side and between the limits set out in
Columns 1,2,3 and 4 of Schedule "C" to this By-law, for the period as listed
and set out in Column 5 of the said Schedule.
38.3
Where appropriate signs are erected and are on display, no person shall park
a vehicle on any highway, at the side and between the limits set out in
Columns 1,2,3, and 4 of Schedule "C'" to this By-law, for the period of time
during the Parent Drop-off / Pick-up times as listed and set out in Column 5
of the said Schedule.
38.4
Where appropriate signs are erected and are on display, no person shall park
a heavy vehicle on any highway where restricted, at the side and between
the limits set out in Columns 1,2,3, and 4 of Schedule "C'" to this By-law, for
the period of time and Gross Vehicle Weight as listed and set out in Column
5 of the said Schedule.
38.5 Where appropriate signage or roadway painting is erected to indicated
an accessible parking spot on municipal property.
38.6 All those in contravention of any portion of Sections 38.1, 3.82, 3.83,
38.4 or 38.4 are guilty of an offence under this by-law.
39.
NO STOPPING AREAS
39.1
Where appropriate signs are erected and are on display, no person shall
stop a vehicle on any highway, at the side and between the limits set out in
Column 1,2,3, and 4 of Schedule "D" to this By-law, during the prohibited
times or days set out in Column 5 of the said Schedule.
39.2
Any owner of a vehicle stopped, standing, or parked in a no stopping area is
guilty of an offence, enforcement may include immediate removal of the
vehicle as outlined in section 5.6.
40.
LOCATION OF MUNICIPAL PARKING LOTS
40.1
The Town Council, with the assistance of the Director of Operations, Public
Works Manager of Operations is hereby authorized and directed to designate
individual parking spaces within the parking lots owned by the Town, such
parking lots being described as follows:
40.1.1
Municipal Parking Lot #1-(Main) - all of Lots 1,2,3,4, and 5, North
of Sydenham St., located between John Street and King Street
in Block One, as shown on Registered Plan Number 164, in the
Town of Aylmer;
40.1.2
Municipal Parking Lot #2- (Town Hall) - part of the North part of
Township Lot Number 83, South of Talbot St. East, more
particularly known as the North halves of Town Lots Number 1
and 2 North of Sydenham St., and all of Lots 3 and 4 North of
Sydenham St., located between Centre Street and John Street
in the Town of Aylmer, according to a Registered Plan of the
Town made by John D. Bailie, Esq., P.L.S.;
40.2
Municipal Parking Lot #1 and the immediate adjacent angle parking on
Sydenham St. along with Municipal Parking Lot #2 are defined as parking
meter zones in which parking is timed by pay and display parking meters
and in respect of which official signs are erected and on display and which
signs are hereby authorized, one or more pay and display parking meters
shall be placed at a location or locations convenient to a number of parking
spaces within such parking meter zones.
41.
GENERAL REGULATIONS FOR MUNICIPAL PARKING LOTS
41.1
In this By-law, where payment is required for the use of a parking space, such
payment may only be made as follows:
a)
In the case of a daily, monthly, 6-month or annual parking permit for
Municipal Lot #1 or #2 through payment at Town Hall of the
established fee and immediate display of the parking tag provided in
the front right windshield or rear-view mirror.
41.2
No person shall park a in any parking space within a municipal parking lot
during the days and times indicated on the official sign for a period longer
than two (2) hours without displaying a permit.
41.3
No person shall park a vehicle in any parking space within a parking
meter zone during the days, times and for a period of time greater than
that indicated on the official sign.
41.4
Subsection 41.2 does not apply to a persons who parks a vehicle of a
disabled person with an official disabled persons permit as identified in
Section 1.20 of this by-law nor does it apply to a person who is actively
recharging an Electronic Vehicle at a designated Electric Vehicle Charging
Station.
41.5
Within municipal parking lots where parking spaces are clearly designated,
no vehicle shall be parked in such manner as to occupy more than one
parking space or to project beyond such parking space into the travelled
portion of such lot or park in any area other than those designated as parking
spaces.
41.6
No person shall allow any vehicle to block another vehicle on any public
parking lot and/or any vehicle obstructing the lanes of any such lot shall be
removed, at the personal expense of the owner of such vehicle.
41.7
Signage will be posted informing the patrons of the regulations for the
municipal parking lots.
41.8
No person shall park a motorcycle in a municipal parking lot for longer than
two (2) hours without appropriately displaying a permit for parking in a visible
manner on the motorcycle.
41.9
(1)
No person shall park a vehicle in any parking space or part thereof
for a period longer than that for which payment has been made.
(2)
For the purposes of subsection (1) a vehicle is deemed to have
been parked for a period longer than for which payment has been
made:
(i)
The daily, monthly, 6-month, or annual permit is not clearly
visibly displayed on the rear-view mirror or front right
windshield.
(ii)
if the daily, monthly, 6-month, annual permit indicates a time
or date that has expired.
(iii)
If the enforcement officer is satisfied that the vehicle has
been parked in the same location for over two (2) hours.
(iv)
If the vehicle is parked in the municipal parking lot during a
prohibited time period.
41.10
No person shall permit a vehicle to be parked in the same parking space
for a longer period at any one time than the maximum period allowable for
such zone as provided in this by-law.
42. ISSUE OF PARKING PERMITS FOR MUNICIPAL PARKING LOTS
42.1
Daily, Monthly, Six Month or Annual Parking Permits shall be available for
sale for the two municipal parking lots, being described in Section 41 above.
42.2
Under the direction of the Town Clerk, municipal officials (employees) are
authorized to issue a permit to any person or company applying for same,
upon payment of fees as listed per Schedule "P". Such permit will allow such
person or company to park a motor vehicle (more than one may be identified
on the permit) in any parking space in the two municipal parking lots as
described in Section 40 above, provided such permit is visibly displayed upon
such vehicle during the time of such parking.
42.3
The following conditions of use and sale shall apply to permits purchased
for parking in designated lots;
42.3.1
The permit will not be replaced if lost or stolen.
42.3.2
Parking charges are for space rental only. No credit is allowed for
periods when parking space is not used. No refund is provided for
early surrender or cancellation of a parking pass.
42.3.3
The Town cannot guarantee availability of space. Individual parking
space cannot be reserved; therefore, in and out movement of
vehicles is at owner's own risk.
42.3.4
Vehicles are parked at owner's risk; the Town is not responsible for
loss or damages of any kind.
44.
RESERVED SPACES IN PARKING LOTS
44.1
The three parking stalls located on the Northwest side of Municipal Parking
Lot #2 (Town Hall), directly adjacent to the Town Hall, shall be appropriately
signed and reserved for use by Town Hall officials/ employees.
44.3
The three angled parking stalls located on the North side of Municipal Parking
Lot #2 (Town Hall), adjacent to the rear of the building of 20 John Street South
may be appropriately signed and reserved for use by the tenants of the
building pending an agreement and associated fees are in place.
44.4
The two parking stalls located on the Northeast side of Municipal Parking Lot
#2 (Town Hall), south/adjacent to the Old Town Hall/Library, may be
appropriately signed and reserved for use by Elgin County Library employees
pending an agreement as associated fees are in place.
44.5
The two parking stalls located at the Southwest corner of Municipal Parking
Lot #1 (Main), immediately located north of the designated "Electrical Vehicle
Charging Station", shall be appropriately signed and reserved for use by
electrical powered vehicles using the charging station.
44.6
The six parking stalls located at the South end of the East side of the East
Elgin Community Complex building shall be appropriately signed and
reserved for use by East Elgin Community Complex employees.
45.
PARKING FOR PHYSICALLLY DISABLED PERSONS
45.1
No person shall stand or park a vehicle in a designated physically disabled
parking stall unless a valid permit is displayed on the vehicle.
45.2
The following areas shall be designated and appropriately signed for use by
physically disabled persons only:
45.2.1
the first two (2) parking stalls in the first lane of Municipal Parking Lot
#1, (Main) adjacent to John St., and immediately South of Coopers
Alley;
45.2.2
the most South Westerly parking stall located in Municipal Parking Lot
#1, (Main) south of Coopers Alley and adjacent to the intersection of
John Street South and Sydenham Street.
45.2.3
the most Northerly parking stall located in Municipal Parking Lot #2,
(Town Hall) immediately behind the Old Town Hall building.
45.2.4
the two parking stalls located along the West side of Municipal
Parking Lot #2, (Town Hall) adjacent to the walkway exiting from the
East side of Palmer Park.
45.2.5
in each of the first parking stalls located along the North end of the
main parking lots; South of the building at the East Elgin Community
Complex, seven (7) stalls in total.
45.2.6
the first parking stall located on the East side of Centre Street, just
South of the Talbot Street intersection.
45.2.7
the first parking stall located on the East side of John Street South,
21.0m South of the Sydenham Street intersection.
45.2.8
the parking stalls abutting the courtesy crossing on the north side of
Talbot Street East West of the King Street intersection.
46.
ONE-WAY TRAFFIC - PARKING LOTS
46.1
Vehicular traffic entering and/or exiting the municipal parking lots shall move
only in the direction as described hereunder:
46.1.1
At egress from Parking Lot 1 (Main), vehicular traffic shall move only
in the direction described hereunder:
46.1.1.1 Exit shall be made to John Street South, in a Westerly
direction from the lot.
46.1.2
At egress from Parking Lot 2 (Town Hall), vehicular traffic shall move
only in the direction described hereunder:
46.1.2.1
Exit shall be made to Centre St., in a Westerly direction
from the lot.
46.2
Vehicular traffic travelling within all municipal parking lots shall move only in
the direction as delineated.
47.
MOTORIZED SNOW & ALL-TERRAIN VEHICLE PROHIBITIONS
47.1
No person shall park a motorized snow, all terrain vehicle, extreme terrain
vehicle, off road vehicle or off road motorcycle, upon any highway or part
thereof on which, at any time.
47.2
No person shall drive a motorized snow, all terrain vehicle, extreme terrain
vehicle, off road vehicle or off road motorcycle on any boulevard lying within
the Town of Aylmer.
47.3
No person shall drive a motorized snow, all terrain vehicle, extreme terrain
vehicle, off road vehicle or off road motorcycle in any public park in the Town
of Aylmer.
48.
MOTORIZED SNOW & All-TERRAIN VEHICLE EXEMPTIONS
48.1
Section 47 of this By-law shall not apply to prohibit the operation of a
motorized snow or all-terrain vehicle upon the highway's under the jurisdiction
of the Corporation of the Town of Aylmer provided the operation of such
vehicles are done so in accordance with the provisions under the Ontario
Highway Traffic Act, Off-Road Vehicles Act, Motorized Snow Vehicles Act,
and in accordance with the provisions of this By-law when;
48.1.1
the need for the use of such motorized snow, all-terrain vehicle,
extreme terrain vehicle, off road vehicle or off road motorcycle is
created by an emergency as determined in the sole opinion of the
Chief of Police or their designate.
48.1.2
such motorized snow, all-terrain vehicle all-terrain vehicle, extreme
terrain vehicle, off road vehicle or off road motorcycle is only operated
on such highway for the purpose of crossing such highway from a
point on one side of the highway to a point on the other side of the
highway that is directly opposite thereto,
48.1.3
such motorized snow, all-terrain vehicle, extreme terrain vehicle, off
road vehicle or off road motorcycle is being driven in a parade or
contest that is held under the authority of a permit from the Chief of
Police or the Town of Aylmer;
48.1.4
such motorized snow, all-terrain vehicle, extreme terrain vehicle, off
road vehicle or off road motorcycle is actually engaged in works
undertaken by or on behalf of the Corporation of the Town of Aylmer
with written authorization for the utilization of the vehicle.
48.1.5
such motorized snow, all-terrain vehicle, extreme terrain vehicle, off
road vehicle or off road motorcycle is operating on a trail system that
is part of an established agreement with the Town as endorsed by
Aylmer Town Council.
48.2
The owner/operator of the motorized snow, all terrain vehicle, extreme terrain
vehicle, off road vehicle or off road motorcycle shall assume all responsibilities
and liabilities for personal or property damage which may result as a
consequence of his/her operation of such.
48.3
No motorized snow, all terrain vehicle, extreme terrain vehicle, off road
vehicle or off road motorcycle shall exceed a speed of 30 km/h upon any Town
roadways or lands.
48.4
All those in contravention of section 47 are guilty of an offence under this by-
law.
49.
PEDESTRIAN CROSSOVERS AND CROSSWALKS
49.1
Pedestrian Crossovers shall be constructed at the locations as set out in
Schedule "F" attached to this By-law according to these specifications:
49.1.1
the pedestrian crossover shall be indicated by pavement markings,
signs and flashing lights where applicable, in accordance with the
regulations of the Ontario Highway Traffic Act.
49.2
Crosswalks shall be constructed at the locations as set out in Schedule "F"
attached to this By-law according to these specifications:
49.2.1
the crosswalk shall be indicated by pavement markings, signs and
signals where applicable in accordance with the regulations of the
Ontario Highway Traffic Act.
50.
PROVISIONS FOR EARLY PAYMENT/PENALTIES
50.1
In this section "any provision of this By-law" means any provision of this By-
law for the contravention, of which the Municipal Act permits a procedure for
the voluntary payment of penalties out of court.
50.2
Except where otherwise expressly provided by this By-law or the Ontario
Highway Traffic Act, Off-Road Vehicles Act, Motorized Snow Vehicles Act,
any person who contravenes any provision of this By-law; or is the plate
holder of a permit or owner of a vehicle that is operated, parked, standing,
idling or stopped in contravention of any provision of this By-law is, upon
conviction, guilty of an offence and is liable to a penalty as provided for in the
Provincial Offences Act, R.S.O., 1990, c. P.33, as amended and in
accordance with Set Fine Schedules "Q" and "R" of this By-Law.
50.3
An early penalty payment out of court may be made on or before the date
specified on the infraction notice as outlined in the infraction notice.
50.4
If default is made in paying a penalty out of court in accordance with this
Section, any fine imposed under this by-law for the contravention thereof shall
be recoverable under the Provincial Offences Act, all the provisions of which
shall apply.
50.5
The court in which a conviction has been entered and any other court of
competent jurisdiction thereafter, may make an order prohibiting the
continuation or repetition of the offence by the person convicted and such
order shall be in addition to any other penalty imposed on the person
convicted.
50.6
Every person who contravenes this By-Law and its schedules and every
director or officer of a corporation who concurs in such contravention by the
corporation can be found guilty of an offence and upon conviction liable to a
fine not exceeding $500.
50.7
Should any section, clause or provision of this by-law be declared to be
invalid by a court of competent jurisdiction the same shall be deemed to
be severable and shall not affect the validity of the remainder of this by-law.
51.
HEADINGS NOT PART OF BY-LAW
51.1
The headings in the body of this By-law form no part of the By-law but are
inserted for convenience and reference only.
52.
SCHEDULES ADOPTED
52.1
The Schedules referred to in this By-law shall form part of the By-law and
each entry in a column of such a Schedule shall be read in conjunction with
the appropriate entry or entries across therefrom, and not otherwise.
53.
FORMER BY-LAWS REPEALED
53.1
By-law No. 37-17 and amendments thereto, and any other By-law of the
Corporation of the Town of Aylmer, or sections thereof, pertaining to the
regulation of traffic, parking, standing and idling within the limits of the Town,
that are inconsistent with the provisions and terms of this By-law are hereby
repealed.
54.
CONFLICT WITH PROVINCIAL LEGISLATION
54.1
In the event of conflict between the provisions of this By-law and the Ontario
Highway Traffic Act, Off-Road Vehicles Act, Motorized Snow Vehicles Act,
the provisions of the said Acts prevail.
55.
EXECUTIVE ACTS AUTHORIZED
55.1
The Mayor and the Town Clerk are hereby authorized to execute on behalf
of and under the seal of the Corporation any document or action necessary
to give effect to this By-law.
56.
EFFECTIVE DATE
56.1
That this By-law shall come into force and take effect on the date of its
passing.
