OFFICE CONSOLIDATION BY-LAW 92-93 To regulate the operation of Motorized Snow Vehicles within certain areas of the City of Brampton including any highways therein or any part or parts thereof and to repeal By-law 31-75 WHEREAS Section 7(2) of the Motorized Snow Vehicle Act, R.S.O. 1990, c. M. 44 provides that the Council of a city may pass by-laws regulating, governing or prohibiting the operation of motorized snow vehicles within the municipality including any highway or any part or parts thereof. AND WHEREAS due to the increasing area of residential development, it is necessary for Council to review the coverage areas from time to time a to which such by-law would apply. NOW THEREFORE the Council of The Corporation of the City of Brampton hereby ENACTS as follows: 1. In this by-law "Motorized Snow Vehicle" means a self propelled vehicle designed to be driven primarily on snow. 2. No person shall operate a motorized snow vehicle on any lands in the City of Brampton except on parcels of land in excess of five (5) acres (2 hectares) with the consent of the owner. 3. Notwithstanding Section 2, no person shall operate a motorized snow vehicle within 100 metres (330 feet) of a residential dwelling. 4. No person shall operate a motorized snow vehicle along any highway or part of any highway within the City of Brampton, except for the purpose of crossing a highway at a 90 degree angle to the direction of the highway. 5. Any person who contravenes any of the provisions of this by-law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act. REPEAL OF BY-LAWS 7. By-law 31-75, as amended, is hereby repealed. READ a FIRST, SECOND and THIRD TIME and PASSED in OPEN COUNCIL, this 26th day of May, 1993.
