The Corporation of the Township of Brock By-Law Number 1375-95-PP As Amended By By-Law Number 1459-97-PP Being a By-law for Regulating, Governing and Prohibiting the Operation of Motorized Snow Vehicles Within the Township of Brock Whereas the Motorized Snow Vehicles Act, R.S.O. 1990, chapter M.44, provides that the council of a local municipality may pass by-laws regulating, governing or prohibiting the operation of motorized snow vehicles within the municipality including any highways therein or any part of parts thereof; And Whereas the Council of the Corporation of the Township of Brock deems it expedient to regulate, govern or prohibit the operation of motorized snow vehicles within the Township of Brock; Now Therefore the Council of The Corporation of The Township of Brock Enacts as Follows: 1. a) "Boulevard" shall mean that portion of the highway, as herein defined, located between the travelled portion of the highway and the sidewalk as herein defined. b) "Highway" includes a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles and which are under the jurisdiction of the Corporation of the Township of Brock. c) "Motorized Snow Vehicle" means a self-propelled vehicle designed to be driven primarily on snow. d) "Municipality" means the Corporation of the Township of Brock. e) "Municipal property" means property owned, managed or controlled by or made available by lease, agreement or otherwise, to the Corporation of the Township of Brock or any local board thereof. f) "Park" means municipal property that is or hereafter may be established, dedicated, set apart or made available for use as a public park or garden by the Corporation of the Township of Brock. g) "Sidewalk" means municipal property that is or hereafter may be physically set apart or made available and intended for pedestrian use by the public as a sidewalk, or that is designated by Council for use as a park or Township sidewalk by by-law or otherwise. h) "Urban areas" mean the designated urban areas of Beaverton, Cannington and Sunderland and the hamlets of Game bridge, Port Bolster, Wilfrid, Manilla and Sonya as well as the settlement area known as Blackwater. 2. No person shall drive a motorized snow vehicle along or on any sidewalk or adjacent boulevard in the urban areas of the Township of Brock except when in the act of crossing over such sidewalk and/ or boulevard and such crossing shall be at an angle of approximately 90 degrees to the direction of the sidewalk or adjacent boulevard. 3. Any person licensed to drive a motorized snow vehicle may drive a motorized snow vehicle in a public park in the municipality except upon highways within a public park where public vehicular use is prohibited and except in those areas where driving of motorized snow vehicles is prohibited by signs or posters. 4. No person shall drive a motorized snow vehicle at a greater rate of speed than: a) 20 kilometres per hour, 1) on a highway where the speed limit established pursuant to the Highway Traffic Act is 50 kilometres per hour or less, or Page 2 of 2 2) in any public park or exhibition grounds; or b) 50 kilometres per hour, 1) on any highway which is open to motor vehicle traffic, where the speed limit established pursuant to the Highway Traffic Act is greater than 50 kilometres per hour, or 2) on a trail. 5. No person shall drive a motorized snow vehicle in the urban areas of the Township of Brock between the hours of one o'clock a.m. and six o'clock a.m. 6. No person shall drive a motorized snow vehicle in the Township of Brock, unless it is equipped with a muffler in good working order and in constant operation and no person shall drive a motorized snow vehicle which has a muffler cut-out, straight exhaust, gutted muffler, hollywood muffler, by-pass or similar device upon the motorized snow vehicle. 7. The owner of a motorized snow vehicle shall incur the penalties provided for any contravention of this by-law unless at the time of the contravention, the motorized snow vehicle was in the possession of some person other than the owner without the owner's consent, and the driver or operator of the motorized snow vehicle, not being the owner, shall also incur the penalties provided for any such contravention. 8. The provisions of this by-law shall not apply to a member of a police force operating a motorized snow vehicle while engaged in the performance of his or her duties. 9. Any person who contravenes any provision of this by-law is guilty of an offence and shall, upon conviction, be liable to a penalty as prescribed by the Provincial Offences Act, R.S.O. 1990, chapter P. 33. 10. That By-Law Number 1332-95-PP be and the same is hereby repealed.
